As I pointed out, the language in the biological assessment regarding burrowing owls has remained unchanged in all three submittals to RCA. For the following 2 reasons, I am requesting that you revise your comments to delete this new requirement: a. The fact that the determination that “no suitable habitat is present due to the lack of small mammal burrows and manmade structures that could be utilized as burrows, such as earthen berms; cement, asphalt, rock, or wood debris piles; or openings beneath cement or asphalt pavement” has been acceptable in the past. b. A pre-construction survey for burrowing owl is required. Thank you. Richard J. MacHott, LEED Green Assoc. City of Lake Elsinore PH:(951) 674-3124, 209 From: Richard J. MacHott, LEED Green Assoc. Since I know I’ll be asked, why wasn’t a Step II Focused Burrowing Owl Survey requested in either your Round 1 or Round 2 comments, since the language regarding the burrowing owl in all three submittals is unchanged? Use Caution. Hi Richard, We have reviewed the supporting application materials for JPR 23-04-11-01 (LEAP 2022-03 / Mission Trails at Lemon Project) including a General Biological Assessment for APNs 370-050-019, 020 and 032 (May 2023) prepared by Hernandez Environmental Inc., and GIS shapefiles. We have identified some additional questions and requests for further information. Additionally, the attached “Comments Tracking Table” is being requested in order to provide complete and accurate documentation that supports the record for this project’s consistency with the MSHCP. The Permittee/Applicant should pay close attention to the notes provided in the attached Comments/Responses Table, located above the Table. These notes and the overall approach have changed slightly. The Table and revised JPR documentation OR the Table-only (if the Permittee/Applicant chooses this latter approach) should be sent to me via email, with a copy to Tricia Campbell (tcampbell@rctc.org), Carol Thompson (cthompson@rctc.org), and Leslie Levy (llevy@rctc.org) at the RCA and Britney Schultz (bschultz@dudek.com) at Dudek. This JPR will be placed “on hold” to allow you adequate time to address the comments. Feel free to call or email me if you have any questions. Thank you!
