RESOLUTION NO. 2007-70
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF LAKE ELSINORE, CALIFORNIA,
APPROVING A MINOR DESIGN REVIEW FOR A
SINGLE FAMILY RESIDENCE LOCATED AT 414 E.
HILL STREET (APN: 377-312-006).
WHEREAS, Eduardo Rocha filed an application with the City of Lake
Elsinore requesting approval of a Minor Design Review for a conventionally built
Single-Family Residence and an attached two car garage located at 414 E. Hill
Street (APN: 377-312-006) (the "Project"); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has
been delegated with the responsibility of considering and approving, conditionally
approving, or denying Minor Design Review requests for residential projects; and
WHEREAS, public notice of the Project has been given and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public meeting held with respect to
this item on April 3, 2007.
NOW THEREFORE, THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE,
AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed
design for the single family residence and has found it acceptable. The Planning
Commission finds and determines the Project is consistent with the Lake Elsinore
Municipal Code and the Historic Elsinore Architectural Design Standards.
SECTION 2. The Planning Commission finds and determines that the
Project is categorically exempt from the California Environmental Quality Act
(Cal. Pub. Res. Code §§ 21000 et seq.: "CEQA") and the CEQA Guidelines (14
C.C.R. §§ 15000 et seq.) pursuant to a class 3(a) exemption for new construction
or conversion of small structures because the Project involves construction of one
single-family residence. (See 14 C.C.R. § 15303(a)).
SECTION 3. That in accordance with Lake Elsinore Municipal Code
Chapter 17.82, the Planning Commission makes the following findings for the
approval of the Project:

PROJECT REQUEST
The applicant is requesting Minor Design Review consideration for a
conventionally built Single-Family residence pursuant to Chapters 17.82 (Design
Review); Chapter 17.14 (Residential Development Standards); Chapter 17.23 (R-1
Single Family Residential District) of the Lake Elsinore Municipal Code (LEMC);
and the Lake Elsinore Historic Downtown District and Architectural Design
Standards.
PROJECT LOCATION
The project is located at 414 E. Hill Street within the City's Historic Downtown
Overlay District and zoned as "MD" Medium Density Residential.

1. The Project, as approved, will comply with the goals and objectives of the
General Plan and the Zoning District in which the Project is located.
The Project complies with the goals and objectives of the General Plan in that
the approval of the residence will assist in achieving the development of a well-
balanced and functional mix of residential, commercial, industrial, open space,
recreational and institutional land uses as well as encouraging the development
and maintenance of a broad range of housing types for all income groups and
age categories.
2. The Project complies with the design directives contained in Section 17.82.060
and all other applicable provisions of the Municipal Code.
The Project is appropriate in the size and design in that the residence will
complement the quality of existing development and will create a visually
pleasing, non-detractive relationship between the proposed and existing
projects. The architectural design, color and materials proposed exceed the
size and design of the homes in the surrounding area.
3. Subject to the attached Conditions of Approval, the Project is not anticipated to
result in any significant adverse environmental impacts.
A Class 3 CEQA exemption may be invoked when the development proposal
involves construction of one single family residence. Pursuant to CEQA
Guidelines 15303(a), the Project is exempt from environmental review because
it involves the construction of one single family residence.
Moreover, the Project has been reviewed by all City divisions and departments,
which have imposed certain conditions of approval on the Project to ensure
that no adverse impacts occur. In light of those conditions of approval, as well
as the design features of the Project itself, the Project will not have a significant
effect on the environment.
4. Conditions and safeguards pursuant to Chapter 17.82.100 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the Project to ensure development of the
property in accordance with the objectives of Chapter 17.82.

ENVIRONMENTAL DETERMINATION
The proposed project has been deemed categorically exempt from the California

RECOMMENDATION
It is recommended that the Planning Commission adopt Resolution No. 2007-_
approving the proposed Minor Design Review for a 2,425 square foot
conventionally built residence and a 420 square foot attached two-car garage, for a
total of 2,845 square feet of building area to be located at 414 E. Hill Street. This
recommendation is based on the following Findings, Exhibits, and attached
Conditions of Approval.

Architectural Style
The Historic Overlay District Standards require that new residential construction
include elements of various 1920's styles including Bungalow; Craftsman, and
Prairie. The architectural design proposed reflects a "Craftsman Architectural
Style" which includes a low-pitched gabled roof, wide overhang eaves, exposed
rafters, decorative (false) brackets under gables, incised porch (beneath main roof),
tapered-square columns, sash windows, and hand- crafted stone or woodwork,
meeting the intent of the Historic Standards.

The applicant has provided a Preliminary Landscape Plan that proposes treatments
along the front and rear of the property. A Condition of Approval has been
incorporated into the staff report, requiring street trees, additional shrubbery, and
an automatic sprinkler system at the front of the property. The applicant is also
providing a six (6') foot high CMU perimeter wall.
ANALYSIS
Staff has determined that the proposed project meets the minimum requirements of
the Lake Elsinore Municipal Code (LEMC) and the Historic Elsinore Architectural
Design Standards. Additionally, this home will meet or exceed the quality of the
existing homes in the area, both in size and design.

Pursuant to Lake Elsinore Municipal Code Section 17.82.100, the Project has
been scheduled and considered for approval by the Planning Commission.
SECTION 4. Based upon all of the evidence presented, the findings above,
and the conditions of approval imposed on the Project, the Planning Commission
hereby approves the Minor Design Review.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

PROJECT DESCRIPTION
The project site is located on a 7,405 square foot vacant lot, which is
approximately 325 lineal feet north of Pottery Street and approximately 275 lineal
feet south of Flint Street within the Historic Overlay District. The property is also
located within the Redevelopment Agency Area Number 3. The applicant plans to
construct a two-story 2,425 square foot conventionally built residence with a 420
square foot attached two-car garage for a total of 2,845 square feet of building area
which would cover a maximum of thirty-two percent (32%) of the 7,405 square
foot lot.
