HomeMy WebLinkAboutResolution 2021-17 TTM 33725 Revision 1 Approval RESOLUTION NO. 2021-17 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVE TENTATIVE TRACT MAP NO. 33725, REVISION NO. 1 Whereas, Dan Bott, SPT-AREP III, Tuscany Associates, has filed an application with the City of Lake Elsinore (City) requesting approval of Revision No. 1 to Tentative Tract Map (TTM) No. 33725 proposing to revise the previously approved tentative map to include the construction of a sewer lift station on Lot 205, offsite sewer line extension, construction of a water pipeline extension along Greenwald Avenue, and revise the intersection of the proposed D Street and Little Valley Road and the intersection of Little Valley Road and Greenwald Avenue. To accommodate the new roadway alignment, the residential lots in the subdivision have been reconfigured, and the overall total was reduced to 204 lots. TTM 33725, Revision No. 1 will now reflect a subdivision of 52.7 acres into 204 single family residential lots, three (3) water quality basins, 15 open space lots, and one (1) sewer lift station. The Project is located west of Greenwald Avenue and south of Little Valley Road within Ramsgate Specific Plan (APNs: 349-240-006, 043 thru 047, 054, 055, 056, 349-380-024 and 025); and, Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative Map) the Planning Commission (Commission) has been delegated with the responsibility of making recommendations to the City Council (Council) pertaining to revisions to the tentative map; and, Whereas, on April 20, 2021, at a duly noticed Public Hearing, the Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1: Prior to making a recommendation to the Council, the Commission has reviewed and analyzed the proposed project pursuant to the appropriate Planning and Zoning Laws, the Ramsgate Specific Plan, and Chapter 16 (Subdivisions) of the LEMC. Section 2: On April 20, 2021, after consideration and evaluation of all written reports and comments and oral testimony presented by the Community Development Department and other City departments, property owners, residents and other interested parties and such other matters as are reflected in the record of the noticed Public Hearing on the Project, the Commission adopted a resolution finding that Addendum No. 1 to MND No. 2006-04 (SCH No. 2006071012) is adequate and is prepared in accordance with the requirements of CEQA. Section 3: That in accordance with State Planning and Zoning Law and the LEMC, the Commission makes the following findings for approval of TTM 33725, Revision No. 1: 1.The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). The land uses and densities associated with the Ramsgate Specific Plan provide a variety of lot and home size product type in order to implement the objectives of the City’s General Plan and the project proponents. TTM 33725 was previously approved for the development of 221 single family residential lots. Revision No. 1 to TTM 33725 includes modification to the previously approved tentative map to construct a sewer lift station, offsite sewer line extension, a water pipeline extension, and configuration of roadways within the subdivision. The proposed revision reduces the proposed units to 204 homes. The proposed revision is consistent with the Ramsgate Specific Plan. The Ramsgate Specific Plan was found to be consistent with the General Plan. Therefore, the Project is consistent with the General Plan. b.All offsite mitigation measures have been identified in a manner consistent with the General Plan. c.All recreational amenities have been provided in a manner consistent with the General Plan. 2.The site of the proposed subdivision of land is physically suitable for the proposed density of development in accordance with the General Plan. a.The overall density and design is consistent and compatible with the adjacent communities. 3.The effects that this project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. a.TTM 33725, Revision No. 1 is consistent with the Ramsgate Specific Plan land use plan, development and design standards, and programs, and all other appropriate requirements contained in the General Plan. TTM 33725, Revision No. 1 is consistent with Housing Element Policy 3.1 to “Use the City’s General Plan, Municipal Code, other land use and development plans, and the development process to provide housing sites that meet the identified local need.” 4.Subject to the attached Conditions of Approval, the proposed division of land or type of improvements is not likely to result in any significant environmental impacts. a.Addendum No. 1 to Mitigated Negative Declaration No. 2006-04 (SCH #2006071012) has been prepared for the proposed modification since none of the conditions described in CEQA Guidelines Sections 15162 or 15163 calling for the preparation of a subsequent or supplemental Mitigated Negative Declaration have occurred. The addendum to the previously adopted MND demonstrated that the environmental analysis, impacts, and mitigation requirements identified in the previously approved MND remain substantively unchanged despite minor project refinements. The addendum supports the finding that the proposed project does not raise any new issues and does not exceed the level of impacts identified in the previously approved MND. 5.The design of the proposed division of land or type of improvements is not likely to cause serious public health problems. No. 2021-17 Page 3 of 4 a.TTM 33725, Revision No. 1 has been designed in a manner consistent with the General Plan and does not divide previously established communities. 6.The design of the proposed division of land or type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed division of land. a.All known easements or request for access have been incorporated into the design of TTM 33725, Revision No. 1. b.The map has been circulated to City departments and outside agencies, and appropriate Conditions of Approval have been applied to the Project. Section 4: Based upon all of the evidence presented, the above findings, and the conditions of approval imposed upon the Project, the Commission hereby recommends that the Council approve TTM 33725, Revision No. 1. Section 5: This Resolution shall take effect immediately upon its adoption.
