City of Lake Elsinore Staff recommends that the Planning Commission: 1. Adopt Resolution No. 2015-_; A Resolution of the Planning Commission of the City of Lake Elsinore, California, Finding that Conditional Use Permit No. 2015-06 Is Consistent With The Western Riverside County Multiple Species Habitat Conservation Plan 2. Adopt Resolution No. 2015-_; A Resolution of the Planning Commission of the City of Lake Elsinore, California, Approving Conditional Use Permit No. 2015-06 for the Conversion of a Previously Constructed Manufactured Home Sales Facility to a Private Wellness Center (Substance Abuse Rehabilitation Facility). Page 2 _1. Planning Commission Meeting Minutes August 18, 2015 Seniui Planner Justin Kirk presented his statt report on Conditional Use Perm No. 2015-06. He explained that the applicant has proposed to convert a previously constructed manufactured homes sales facility to a private wellness center (substance abuse rehabilitation facility.) He described wellness center would be the only occupant of the buildings with 42 beds for residential detoxification. Patients would be housed and evaluated for a period of four to eight days prior to being transferred to another facility. There are no visitors permitted and patients are not permitted to bring personal vehicles. The facility would be staffed 24 hours a day seven days a week by 12 staff members a shift, for the total 37 staff members. Security cameras will be located internal and external to the facility with security being provided trained behavioral health specialist.The proposed use has a required parking allotment of 19 spaces and has provided 19 parking spaces onsite and a additional nine spaces located in the adjacent commercial center that they have a shared parking agreement. He went over Conditions of Approval 14 and 15 that would be added. Condition No. 14 goes over parking requirements. Kirk advised the PC that prior to tonight's meeting, the applicant requested that the maximum number of units be reduced from 42 to 38 which had a impact on the parking, so that was adjusted that. Condition No. 15 get into more of the licensing requirement of the facility, they are required by the state of California rather then implicitly relying on that requirement, we are being explicit in including this as a Condition of Approval. Kirk said with these added Conditions of approval plus the Conditions of approval from building , fire and engineering divisions, the use is appropriate for the site. He He concluded his presentation with asking Planning Commission if there were any questions for himself, applicant or operator. Vice Chair Armit said 38 people in 5 homes is dense. Kirk explained he went back to the calculation of with occupancy limitations would be per the building code. Kirk referred to the Building and Safety Division Conditions of approval, Condition No. 27 describes an occupancy load per building, that is based upon the total square footage of each unit that will limit it even more so there. Commissioner Ray questioned if the facility was intended to be solely for habitation or is there going to be treatment. Kirk replied that he understood the facility was going to be for habitation as well as observation. The applicant Manuel Mancha the consultant that assisted West Coast Wellness to get their entitlement in the City and CEO Cathy Cloud introduced themselves to Planning Commission and said they a available for any questions. Vice Chair Armit recommended that Condition No. 6 would read, not to exceed 12 patients and a total average occupancy for all five, not to exceed an average of seven. Chairman Jordan questioned applicant if they agreed and understood Condition No. 6. Applicant agreed. Planning Manager MacHott explained that Condition No. 4 then would have to be changed to read, the maximum would be 36. Vice Chair Armit questioned if they were comfortable with having 38 patients with the amount of room they have. Cloud replied that they are very comfortable. She explained that their were seven buildings and the majority of the buildings will be limited to six people. Armit stated he was a little more comfortable at six people. Cloud explained that one unit is like a dormitory but the rest of the units are limited to six people. Senior Planner Kirk presented his staff report for Conditional Use Permit 2015-02 and Commercial Design Review (Minor Design Review) 2015-08 - A request by Verizon Wireless for the Construction of a 25 -Foot High Wireless Telecommunications Facility Designed as a Faux Pine Tree located at 35050 Canyon Hills Rd. Kirk provided Planning Commission with proximity and description of project. Kirk explained Condition of Approval No. 12 has been added for a landscape plan that details perimeter landscaping. The landscape plans will incorporate shrubs to reduce the visual impacts of the ground mounted equipment and trees to help the telecommunications tower blend into landscape. He gave staffs recommendation of approval for both CUP and Design Review and asked Planning Commission if there were any questions. Chairman Jordan asked for clarification on compliance report, will they have a parabolic dish or parabolic antenna. Kirk replied that it will be both for technology requirements. Commissioner Fleming had concerns regarding eight foot wall around project rear retaining wall would not be tall enough due to the slope on the hill and would not be protected from any vandalism. He would like a Condition to be added to have a eight foot wall above grade. Kirk responded to Fleming's request and said that a Condition of Approval can be added that illustrates what Planning Commission would like to see as follow through and he would work with the applicant get resolved. Vice Chair Armit would like a Condition to be added that structural material matches Canyon Hills Master Plan. Kirk replied that a Condition can be added that states that. Commissioner Ray questioned, when the existing building pad and sales center goes away. Is there intent to leave the existing asphalt drive to the site, he stated that he would like the road to stay, as well as maintained. Kirk suggested to require applicant to have some sort of asphalt access road in their easement area to be maintained and prior to restoration of the site they retain it and specify that it is within the 12 foot easement area. Applicant Andrea Urbas with Cortel, consultants to Verizon Wireless thanked staff for working with them. Urbas replied to comments and suggestions from Planning Commission and agreed to recommendations. City of Lake Elsinore Staff recommends that the Planning Commission: 1. Adopt Resolution No. 2014-_; A Resolution of the Planning Commission of the City of Lake Elsinore, California, Approving a Minor Design Review for a 1,900 Square -foot Garage/Workshop as an Ancillary Structure for an Existing House located at 518 North Spring Street. Page B Planning Commission Meeting Minutes August 18, 2015 Project Planner Agustin Resendiz presented his staff report on Minor Design Review - A request to allow the Development of a 1,900 Square Foot Garage/Workshop and Storage at the rear of an existing residential dwelling unit located at 518 North Spring St. He explained, the proposed 1,900 square -foot one-story structure is designed to have a 400 square -foot two -car garage with an approximately 1, 000 square foot woorkshop area, and a 480 square -foot storage area. Garage will also have an attic space located over the workshop area designed to comply with 2013 Building Code and Fire Department regulations. He concluded presentation by asking Planning Commission if there were any questions. Commissioner Ray asked if the lot was zoned for any commercial activity. Resendiz replied, yes the property zoned for Gateway Commercial under the Downtown Code. Ray questioned, does Gateway Commercial include the option or availability for multi -family housing. Planning Manager MacHott explained that none of the Commercial Codes within the City other then Commercial Mixed Use and Residential Mixed Use allow residential with the Commercial. Vice Chair Armit wanted clarification that the garage he was adding to his home was not for Commercial use. That it was just to be used as a place for his cars. Resendiz replied that was correct. Applicant Kenneth Chaffin introduced himself to Planning Commission. He told PC he is here to answer any questions they may have. Commissioner Fleming suggested to the applicant that he may want to consider include putting a toilet in this project. Commissioner Ray asked for affirmation that there was no intention or interest in converting this project into a single-family residence in the future or using the facility as a commercial endeavor. Mr. Chaffin replied absolutely not. Ray aked Mr. Chaffin if there wouldn't be a problem in doing a Condition of Approval to acknowledge those points. Chaffin replied, absolutely. Commissioner Ray would like a Condition of Approval to be added stating that the intention of the new facility falls in line with exactly what it's use is going to be and it needs to stay a personal storage with no conversion, with the instalation of a toilet. *Condition No. 19 - The garage/workshop shall not be used a residence. There are exciting things in the works and Staff is looking forward to bringing them to the Commission. COMMISSIONERS' COMMENTS Commissioner Fleming thanked staff for responding to his concerns on projects quickly, prior to the meeting. Chairman Jordan stated she was proud of the Planning Commission and the due diligence that the new Commissioners do, they are fitting in well and changing the Planning Commission. She thanked fellow Commissioners and said goodnight.
