HomeMy WebLinkAboutCC Reso No 2007-169RESOLUTION N0. 2007- i69 RESOLUTION OF THE CITY COUNCIL OF TWE CITY OF LAKE ELSINORE, CALIFORNIA, REQUESTING THE RIVERSIDE COUNTY LOCAL AGENCY FORMATION COMMISSION (LAFCO) TO CQMMENC~ PROCEEDINGS TO ANNEX THE TERRITORY DESIGNATED AS ANNEXATION NO. 81 INTO THE COF2PORATE BOUNDARIES OF THE CITY OF LAKE ELSINORE WHEREAS, the City of Lake Elsinore (the "Cit~') has initiated proceedings to annex into the City's corporate boundaries approximately three hundred twenty (320) acres of land which is located within the Citys Sphere of Influence, south of State Route 74 (Centrai Avenue), west of Waterford Street, and east of Dexter Avenue and Camino del Norte ("Annexation No. 81") and which is depicted in Exhibit B attached hereto; and WHEREAS, the annexation request is made pursuant to the provisions of the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (Government Code §§ 56000 et seq.: the "Cortese Knox AcY'); and WHEREAS, consistent with the requirements of Government Code Sections 56375 and 65859, the City shall process a pre-annexation zone change subsequent to the approval of the City's General Plan Update, that will determine the zoning that will apply to the property upon annexation into the City; and WHEREAS, the reasons for the proposed annexation are: (1) Riverside LAFCO has previously identified the City of Lake Elsinore as the logical service provider for the propose annexation territory; (2) annexation of the 320-acre territory is an integral part of the City of Lake Elsinore's plan to implement a new land use pattern in the annexation area which compliments existing and planned projects in the area; and (3) existing and future residents of the annexation area will receive a higher level of municipal services through City-provided municipal services; and WHEREAS, the Planning Commission of the City of Lake Elsinore held a public hearing on Annexation No. 81 at a duly noticed public hearing on September 18, 2007; and WHEREAS, public notice of said application has been given, and the City Council has considered the Planning Commission's recommendation, and evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on September 25, 2007. NOW, THEREFORE, THE CITY COUNCIL ~F THE CITY OF LAKE ~LSINORE, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the request for annezation prior to making a decision to commence proceedings to annex the Property. SECTIf~N 2. That in accordance with Cortese Knox Act, State Planning and Zoning law, and the Lake Elsinore Municipal Code, the City Council makes the following findings to support the request to commence annexation proceedings for Annexation No. 81: 1. The proposed annexation area is contiguous to the City of Lake Elsinore, is within the City of Lake Elsinore Sphere of Influence, and will not create pockets or islands. The Annexation No. 81 territory is bordered on three sides by the City of Lake Elsinore, and is within the City of Lake Elsinore's Sphere of lnfluence. The annexation proposes a ~easonable and desirable extension of the City boundary area in that, at its completion, pockets or islands of County jurisdiction will be transferred to the City. 2. The proposed annexation will not result in any adverse significant impacts on the environment. The Riverside Local Agency Formation Commission has previously identi~ed the City of Lake Elsinore as the logical service provider for the proposed annexafion territory. Annexation No. 81 is an integral part of the City's plan to implement a new land use pattern in the annexafion area which complimenfs existing and planned projects. Annexation No. 81 will incorporate the approved Land Use Plan of the Cify's General Plan Update. Therefore, evenfua! development of the Property will be consistent with the City's new Genera/ Plan. Environmental issues will be considered and addressed by the Draft General Plan Update Environmental Impact Report. Existing and future residenfs of the annexation area will receive a higher level of municipal services fhrough City-provided services. 3. The proposed annexation will eliminate an existing undesired pocket of the county and will assist in the efficient provision of governmental services. Annexafion No. 81 proposes a reasonab/e and desiraBle extension of the city boundary area in that, at its completion, pockets or islands of County jurisdiction will be transferred to the City. SECTION 3. Based upon all of the evidence presented, both written and tesYimonial, and the above findings, the City Council hereby commences annexation proceedings for the territory shown in Exhibit B. SECTION 4. That LAFCO take proceedings for the annexation of territory shown in Exhibit B, according to the terms and conditions stated above and in the manner provided by the Cortese-Knox Act. 2 SECTION 5. This resolution shall take effect from and after the date of its passage and adoption. PASSED, APPROVED, AND ADOPTED, this 25~' day of September 2007, by the following vote: AYES: MAYOR ROBERT E.
