Applicant: James Dakan, Inland Boat Center Recommendation Adopt A RESOLUTION OF THE PLANNING COMMISSION APPROVING A LAND USE DETERMINATION ESTABLISHING RECREATIONAL VEHICLE SALES AND SERVICE, INCLUDING OUTDOOR DISPLAY AS A PERMITTED USE SUBJECT TO THE APPROVAL OF A CONDITIONAL USE PERMIT WITHIN THE LAKE ELSINORE OUTLET CENTER SPECIFIC PLAN. Discussion Background The applicant has requested a land use determination by the Planning Commission to allow for the retail sales and service of boats with the accessory use of outdoor boat display within the existing Lake Elsinore Outlet Center. The Lake Elsinore Outlet Specific Plan (LEOSP) does not identify this land use as either a permitted or conditionally permitted use. In accordance with the LEOSP, all uses that are not identified as permitted or conditionally permitted are considered prohibited. However, the LEOSP specifies that other uses, either permitted or conditionally permitted, may be allowed subject to the Planning Commission finding that the use is consistent with the purpose and intent of the Community Commercial Category for permitted uses within the Specific Plan. Analysis The City of Lake Elsinore’s Municipal Code (LEMC) identifies recreational vehicle sales and services as a permitted use within the Commercial Manufacturing (CM) and General Commercial (C2) zones, subject to the approval of a Conditional Use Permit. The City’s zoning code (Title 17 of the LEMC) defines recreational vehicles to include boats. In addition, several land uses within the LEOSP were identified as being consistent with the request, specifically including retail sales, personal services, service stations and light industrial uses. These uses were identified as they share similar operational characteristics including sales and service as well as similar frequency of customers. Use Determination (Outlets) 07/20/2021 Page 2 of 2 Because the proposed use is generally consistent with other uses identified in the LEOSP, it is recommended the Planning Commission adopt a resolution establishing recreational vehicle sales and service, including outdoor display and storage as a permitted use, subject to the approval of a Conditional Use Permit. It is recommended that the use be subject to a Conditional Use Permit to ensure the operational characteristics do not present detrimental impacts to existing and future uses.
