Recommendation Approve and authorize the City Manager to Execute AmendmentNo. 2to Professional Services Agreement for on-call Surveyor Services with Dennis Janda Inc. in the amount of $100,000.00, subject to approve as to form by the City Attorney. Background On April 5, 2018 the City and Dennis JandaInc. entered into an agreement for initial on-call surveyor services in support of various City projects. On September 25, 2018, Amendment No. 1 was executed to provide for $55,000 in annualCritical to the construction phase of any project is accurate surveying services. Both on and off-site services are required to perform construction calculations, construction site layouts for above and below ground precision measurements. Surveying services provide horizontal and vertical control limits as detailed on the construction documents. Additional surveying services will include but not be limited to the below itemsCity wide services: Various field crew services Site control & elevation verification & demo limits Property boundaries Survey monuments and marking Site development for grading street curb and gutter Traffic Signal marking Water -domestic and fire appurtenances Sewer and storm drain marking and elevation verification Roads, sidewalks and ramps Light standards Electrical & gas lines Building locations and elevations per plan AmendmentNo. 2 -Dennis JandaInc. June 11, 2019 Page 2 Discussion At this time the survey services of Dennis Janda are currently utilized in an on-call status and will continue until the term of this agreement is ended or renewed.This Amendment No. 2 will provide for the surveying services to a wide variety of City projects and needs. Dennis Janda Inc. has been a part of a very specialized team of professionals providing services to the Cityfor design and site development for major City Capital Improvement Projects (Rosetta Canyon Sports Park, Launch Pointe RV Resort, Lincoln Road Realignment, Camino Del Norte Road, Neighborhood Center Building Remodel) and will continue providing needed on-call survey support. Fiscal Impact The surveying services will be funded with funds programmedin city-wide projects in the Capital Improvement Plan and applicable operating budgets. ON-CALL SURVEY SERVICES This AMENDMENT NO. 2 is made and entered into as of June 11, 2019by and between the City of Lake Elsinore, a municipal corporation (‘‘City") andDennis Janda Inc. ("Surveyor"). RECITALS A.On April 5, 2018, the City and Surveyorentered into that certain agreement entitled “Agreement for Surveyor Services (On-Call)” for needed citywide general surveyor services(“Original Agreement”). Except as otherwise defined herein, all capitalized terms used herein shall have the meanings set forth for such terms in the Original Agreement. B.The Original Agreement provided for compensation to Surveyorin an amount not to exceed $25,000 without additional written authorization from the City. C.Amendment No. 1increasedcompensation for such services to an amount not to exceed $55,000 annually. D.The parties now desire to increase compensation for such services to an amount not to exceed $100,000 annually. NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth herein, City and Surveyoragree as follows: 1.Section 3. Compensation of the Agreement is hereby amended as follows: Compensation to be paid to Surveyor shall be increased anadditional Thirty- Thousand Dollars ($30,000) such that annual compensation to Surveyor shall not exceed On HundredThousand Dollars and No Cents ($100,000) without additional authorization from the City. 2.Except for the changes specifically set forth herein, all other terms and conditions of the Original Agreement shall remain in full force and effect. ON-CALL SURVEY SERVICES AMENDMENT NO. 1 is made and entered into as of September 25, 2018 by and between the City of Lake Elsinore, a municipal corporation ("City") and Dennis Janda Inc. ("Consultant"). In consideration of the mutual covenants and conditions set forth herein, the parties agree as follows: 1. This Amendment is made with the respect to the following facts and purposes: A. On April 5, 2018, the City and Consultant entered into that certain on- call agreement entitled"Agreement for Professional Services" (the"Original Agreement"). 2. Section 3. Compensation of the Agreement is hereby amended to read as follows: The compensation to the agreement shall be increased by thirty thousand dollars and no cents ($30,000.00). The total compensation will equal fifty five thousand dollars and no cents($55,000.00). IN WITNESS WHEREOF, the parties have caused this Agreement to be executed on the date first written above.
