Subject:Amendment No. 1 to the Professional Services Agreement with Bureau
Veritas for Plan Checking Services
Recommendation
Authorize the City Manager to execute the Amendment No. 1 to the Bureau Veritas Professional
Services Agreement for plan check services in the amount of $198,000.
Background
On December 13, 2016, Council approved a Professional Services Agreement in an amount not
to exceed $300,000 with Bureau Veritas for engineering plan check services. Development
activity has increased the number of plan checks provided by Bureau Veritas andto date
Bureau Veritas has been providing high-quality plan check services for the City.
Discussion
Due to the increasing developer plan check workload, the contract requires an amendment to
authorize an additional $198,000. Services will be provided at the same rates set forth in the
December 2016 Professional Services Agreement.

Fiscal Impact
The amendment to the Professional Services Agreement for plan checking services in the
amount of $198,000 will be funded by developer paid fees. Sufficient funds have been
approved in the Fiscal Year 2018/19budget for this amendmentand is funded by plan check
revenues.

AMENDMENTNO. 1TO AGREEMENT
BETWEEN THE CITY OF LAKE ELSINORE
AND BUREAU VERITAS
FOR PLAN CHECKSERVICES
AMENDMENTNO.1 is made and entered into as of April 23, 2019 by and between the
City of Lake Elsinore (“City)a municipal corporation, andBureau Veritas(“Consultant”). In
consideration of the mutual covenants and conditions set forth herein, the parties agree as
follows:
1.This AmendmentNo. 1is made with the respect to the following facts and
purposes:
a.On December 13, 2016the City and Consultantentered into that certain
agreement entitled “City of Lake Elsinore for Professional Services” (the “Original Agreement”)
for a two and a half (2.5) year term, subject to annual review by the City Manager.
b.The Original Agreement provided for compensation to Consultant in an
amount not to exceed $300,000 for Fiscal Year 2016-19 and the parties now desire toincrease
the payment for servicesby allocating an additional $198,000 and amend the Original
Agreement as set forth in this AmendmentNo. 1.
2.The first sentence of subparagraph c of Section 2.“Time of Performance”of
the Original Agreement is hereby amended and restated in its entirety to read as follows:
The term of this Agreement shall commence upon execution of this Agreement
and shall continue shall continue through June 30, 2019.
3.Section 3. Compensation of the Original Agreement is hereby amended and
restated in its entirety to read as follows:
Compensation to be paid to Consultant shall be in accordance with the fees set
forth in Consultants’ Proposal (Exhibit A). In no event shall Consultant’s
compensation exceed four hundred ninety-eight thousand dollars ($498,000)
without additional written authorization from the City. Notwithstanding any
provision of Consultant’s Proposal to the contrary, out of pocket expenses set
forth in Exhibit A shall be reimbursed at cost without an inflator or administrative
charge. Payment by City under this Agreementshall not be deemed a waiver of
defects, even if such defects were known to the City at the time of payment.
3.Except for the changes specifically set forth herein, all other terms and conditions
of the Original Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the Parties have executed this Agreement as of the day and year first
set forth above, which date shall be considered by the Parties to be the effective date of this
Agreement.
