HomeMy WebLinkAboutPC Reso No 2015-48 (6.16.15)RESOLUTION NO. 2015-48 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE ADOPTION OF AN AMENDMENT TO THE LAKE ELSINORE MUNICIPAL CODE DELETING SECTION 17.148.140 (C) AND SECTION 17.200.070 WHEREAS, the City of Lake Elsinore Municipal Code (LEMC) provisions regulating overnight camping are minimal, are not well written and difficult to enforce, and WHEREAS, the lake is an amenity to be protected and enjoyed by all while allowing camping subject to reasonable regulations; and WHEREAS, property owners should be allowed to use and enjoy their property for camping while not negatively impacting residences and businesses in the area; and WHEREAS, leasing property and/or conducting commercial campground activities should require specific restrictions subject to a conditional use permit; and WHEREAS, this ordinance is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code or Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Therefore, no environmental assessment is required or necessary; and WHEREAS, pursuant to Section 17.188.040 of the Lake Elsinore Municipal Code ("LEMC") the Planning Commission has been delegated with the responsibility of making recommendations to the City Council for changes to provisions of LEMC Title 17 - Zoning; and WHEREAS, on June 16, 2015 at a duly noticed public hearing the Planning Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has reviewed and analyzed the proposed zoning code amendment pursuant to the California Planning and Zoning Laws, the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and finds and determines that the proposed project is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal Code. PLANNING COMMISSION RESOLUTION NO. 2015-48 Page 2 of 3 SECTION 2. That in accordance with the California Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission hereby makes the following findings for the approval of the zoning code amendment: 1. The proposed amendment will not be detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City. 2. The proposed amendment will not be injurious to property or improvements in the neighborhood or within the City. 3. The proposed amendment is consistent with the General Plan Goals and Policies. 4. The proposed amendment will not have a significant effect on the environment. SECTION 3. Based upon the evidence presented, both written and testimonial, and the above findings, the Planning Commission hereby recommends approval of zoning code amendment deleting Sections 17.148.140 (c) and 17.200.070 as shown in Sections 1 and 2 of the attached draft ordinance. SECTION 4. This Resolution shall take effect from and after the date of its passage and adoption. PASSED, APPROVED AND ADOPTED on this 16th day of June 2015.
