Agreement for Tire RecyclingEvent Management
Recommendation
Authorize the City Manager to execute Amendment No. 2extending the term for an additional 2
years, through September30, 2021 to run concurrent with the grant cycle, in anamount of
$13,600.00in such final form as approved by the City Attorney.
Background
The City Council approved an Amendment to theProfessional Services Agreement with KJ
Services Environmental Consultingfor a term endingJune 30, 2019. CalRecycle has modified
the grant terms and the grant cycles now run on a two-year term. KJ Servicesassists City staff
in the planning of tire collection eventsandprovidesevent staff, event equipment (canopies,
tables, chairs, and banners) along with the appropriate safety equipment.
Discussion
KJ Services Environmental Consulting will provide the City’s administrative staff a complete
report describing the number of event participants, number of tires collected, total scrap tire
weight and a description of any problems or significant issues that arose during the event. KJ
Services will assist the City’s administrative staff in preparing the reporting requirements for
reimbursement to CalRecycle, Department of Resources Recycling and Recovery.
This year the City received an award of $20,000.00 in grant fundingfor the purposesof putting
on these recycling events. In addition, for the purposes of managing the agreement and the
grant, an amendmentto the term is being requested so that it runs concurrentwith the term of
the grant funding.
Fiscal Impact
All costs incurred are paidfor through the Local Government Waste Tire Cleanup and Amnesty
Event Grant Program. The City of Lake Elsinore received a grant awardfor $20,000 for use in
the fiscal years 2019-2021.

ThisAmendmentNo.2toAgreementforProfessionalServices(“AmendmentNo.2”)
ismadeandenteredintoasofDecember10,2019,byandbetweentheCityofLake
Elsinore,a municipalcorporation (“City),andKJServicesEnvironmentalConsulting
(“Consultant”).
RECITALS
A.TheCityandConsultanthaveenteredintothatcertainAgreementfor
ProfessionalServicesdatedasofSeptember22,2015,(the“OriginalAgreement”).Except
asotherwisedefinedherein,allcapitalized termsusedherein shallhave themeaningsset
forthforsuchtermsintheOriginalAgreement.
B.TheOriginalAgreementprovidedforcompensationtoConsultantinan
amount
$35,000(GrantAwardAmount).
C.Amendment No. 1 was approved September 12, 2017, to amend the
Consultant’s compensation in the amount of $32,620 (Grant Award Amount) and extend the
contract duration to run concurrently with the grant cycle.
D.The partiesnowdesiretomodifythe scopeofservicesandincreasethe
payment and contract durationforsuchservicesassetforthinthisAmendmentNo2 to match
the current grant terms.
NOW,THEREFORE,inconsiderationofthemutualcovenantsandconditionsset
forthherein,CityandConsultantagreeasfollows:
1.Section1,ScopeofServices,oftheOriginalAgreementisherebyamendedto
addthefollowing:
ConsultantshallalsoperformtheservicesdescribedinConsultant’s
November 18,2019Proposal(attachedtothisAmendmentNo.2as
ExhibitA-2).Consultantshallprovidesuchservicesatthetime,place,
andinthemanner specifiedinExhibitA-2,subjecttothedirectionof
theCitythroughitsstaffthatitmayprovide fromtimetotime.
2.Section3,Compensation,oftheOriginalAgreementisherebyamendedtoadd
thefollowing:

thefeessetforthinConsultants’ProposaldatedNovember18,2019

InnoeventshallConsultant’scompensationrelatedtoExhibitA-2
toAmendmentNo.2 exceedThirteen ThousandSixHundred
dollars($13,600) withoutadditionalwrittenauthorizationfrom the City.
Notwithstandingany provisionofConsultant’sProposal and/or
Consultant’sNovember18,2019Proposaltothecontrary,outof
pocketexpensessetforthinExhibitAandExhibitA-2,respectively,
shallbereimbursedatcostwithoutaninflatororadministrative
charge.PaymentbyCityunderthisAgreementshallnotbedeemed
awaiverofdefects,evenifsuchdefectswere knowntothe Cityatthe
timeofpayment.
3.Exceptforthe changesspecificallysetforthherein,allothertermsand
conditionsoftheOriginalAgreementshallremaininfullforceandeffect.
INWITNESSWHEREOF,thepartieshave causedthisAmendmentNo.2tobe
executedontherespectivedatessetforthbelow.
