Planning Commission Action
On March 19, 2019, the Planning Commission unanimously recommended approval of Tentative
Parcel Map No. 37465by a vote of 5-0.
Discussion
Project Request and Location
Tentative Parcel Map(TPM) No. 37465 is a subdivision of a 234.6-acre site into four (4) parcels
ranging in size from 16.3 acres to 92 acres for the purpose of Financing and Conveyance only
and to adjust lot lines to accommodate ultimate (i.e., long-range) improvements to NicholsRoad.
No grading permits, building permits orother development will be allowed with this approval.
TPM 37465 proposes toconsolidate the existing seven parcels (two parcels north ofNichols Road
and five parcels south of Nichols Road) into four separate parcels, with two parcels oneach side
of Nichols Road. The two parcels proposed north of Nichols Road would include 92acres and
65.2 acres. The two parcels proposed south of Nichols Road would include16.3acres and 61.1

acres. Additionally, TPM 37465 would adjust lot lines abutting Nichols Road toaccommodate
future improvements to this roadway as an Urban Arterial (120-foot ROW).
The Project is located on the easterly side of I-15 Freeway and westerly of Wood Mesa Court/El
Toro Road. (APNs: 389-200-035, 036, 038, 039, 389-210-008, 032, 034, and036).

General Plan Consistency
The Project has a General Plan Land Use designation ofGeneral Commercial (GC)and
Commercial/Specific Plan (C-SP) and Open Space (OS) of Alberhill Ranch Specific Plan (ARSP).
The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels for Financing
and Conveyance purposes only. No development is proposed with this application. Any future
development for this area is required to conform to all standards set forth in the applicable Specific
Planas well as theGeneral Plan.
Municipal Code Consistency
The current zoning for the subject site is Commercial Mixed Use(CMU)and Commercial/Specific
Plan (C-SP) and Open Space (OS) of Alberhill Ranch Specific Plan(ARSP). The Tentative Parcel
Map is a subdivision of a 234.6-acre site into four (4) parcels for Financing and Conveyance
purposes only. No development is proposed with this application. Any future development for this
area shall conform to all standards set forth in the Lake Elsinore Municipal Code (LEMC)andthe
applicable Specific Plan.
The TentativeParcelMap complies with Chapter 16.24(Tentative Map)of the LEMC and the
Subdivision Map Act.The Design Review Committee that includes staff from Planning, Building
and Safety, Fire, and Engineering have reviewed the proposed Project, and have conditioned the
Project to mitigate any potential concerns.
Environmental Determination
The proposed Tentative Parcel Mapis exempt from the California Environmental Quality Act (Cal.
Pub. Res. Code §§21000 et seq.: “CEQA”) and the CEQA Guidelines (14 C.C.R. §§ 15000 et
seq.) pursuant to Section 15315 (Class 15: Minor Land Divisions). Class 15 consists of the division
of property in urbanized areas zoned for residential, commercial, or industrial use into four or
fewer parcels when the division is in conformance with the General Plan and zoning, no variances
or exceptions are required, all services and access to the proposed parcels to local standards are

available, the parcel was not involved in a division of a larger parcel within the previous 2 years,
and the parcel does not have an average slope greater than 20 percent.The Tentative Parcel
Map is a subdivision of a 234.6-acre site into four (4) parcels for Financing and Conveyance
purposes only. All services and access to the proposed parcels are available, the parcel was not
involved in a division of a larger parcel within the previous 2 years, and the parcel does not have an
average slope greater than 20 percent. No grading permits, building permits, or other development
will be allowed with this approval.A subsequent tentative tract map or tentative parcel map shall
be required to subdivide this property. Any future development for this area shall conform to all

Fiscal Impact
The time and costs related to processing this Project have been covered by the Developer Deposit
paid for by the applicant. No General Fund budgets have been allocated or used in the processing
of this application. The approval of the Project does not fiscally impact the City’s General Fund.
Mitigation Measures to protect the City fiscally have already been included in the Conditions of
Approval.

Elsinore(City)requesting approval of Tentative Parcel Map (TPM) No. 37465fora subdivision of
a 234.6-acre site into four (4) parcels ranging in size from 16.3 acres to 92 acres for the purpose
of Financing and Conveyance only and to adjust lot lines to accommodate ultimate (i.e., long-
range) improvements to Nichols Road. No grading permits, buildingpermits or other development
will be allowed with this approval. The Project is located on the easterly side of I-15 Freeway and
westerly of Wood Mesa Court/El Toro Road. (APNs: 389-200-035, 036, 038, 039, 389-210-008,
032, 034, and 036); and,
Whereas,Section 6.0 of the Multiple Species Habitat Conservation Plan (MSHCP)requires that
all discretionary projects within a MSHCP Criteria Cell undergo the Lake Elsinore Acquisition
Process (LEAP) and the Joint Project Review (JPR) to analyze the scope of the proposed
development and establish a building envelope that is consistent with the MSHCP criteria; and,
Whereas,Section 6.0 of the MSHCP further requires that the City adopt consistency findings
demonstrating that the proposed discretionary entitlement complies with the MSHCP Criteria Cell,
and the MSHCP goals and objectives; and,
Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24(Tentative Map) the
Planning Commission(Commission)has been delegated with the responsibility of making
recommendations to the City Council (Council) pertaining to the tentative mapreview; and,
Whereas,on March 19, 2019,at a duly noticed Public Hearing the Commission has considered
evidence presented by the Community Development Department and other interested parties with
respect to this item; and,
Whereas,pursuant to Section 16.24.120 of the LEMC, the Council has the responsibility of
making decisions to approve, conditionally approve, or disapprove recommendations of the
Commission for tentative maps; and,
Whereas,on April 9, 2019, at a duly noticed Public Hearing, the Council has considered the
recommendation of the Commission as well as evidence presented by the Community
Development Department and other interested parties with respect to this item.
NOW THEREFORE, THECITY COUNCILOF THE CITY OF LAKE ELSINOREDOES HEREBY
RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section1:The Council has considered the Project and its consistency with the MSHCP prior to
adopting Findings of Consistency with the MSHCP.
Section2:That in accordance with the MSHCP, the Council makes the following findings for
MSHCP consistency:
1.The Project is a project under the City’s MSHCP Resolution, and the City must make an

MSHCP Consistency finding before approval.
The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading permits, building permits, or other
development will be allowed with this approval.Therefore, does not constitute as aproject
under the City’s MSHCP Resolution.MSHCP Consistency findings will be made witha
subsequent tentative tract map or tentative parcel map to subdivide this property.
2.The Project is subject to the City’s LEAP and the Western Riverside County Regional
Conservation Authority’s (RCA) Joint Project Reviewprocesses.
The Tentative Parcel Mapisa subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading permits, building permits, or other
development will be allowed with this approval. The LEAP or JPR processeswill be completed
with a subsequent tentative tract map or tentative parcel map to subdivide this property.
3.The Project is consistent with the Riparian/Riverine Areas and Vernal Pools Guidelines.
The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only.No grading or other development is proposed with
this subdivision. As such, the Riparian/Riverine Areas and Vernal Pool Guidelines as set forth
in Section 6.1.2 of the MSHCP are not applicable.
4.The Project is consistent with the Protection of Narrow Endemic Plant Species Guidelines.
The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading or other development is proposed with
this subdivision.Therefore, Protection of Narrow Endemic Plant Species Guidelines as set
forth in Section 6.1.3 of the MSHCP are not applicable.
5.The Project is consistent with the Additional Survey Needs and Procedures.
The Tentative Parcel Mapisa subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading or other development is proposed with
this subdivision. Therefore, the provisions of MSHCP Section 6.3.2 are not applicable.
6.The Project is consistent with the Urban/Wildlands Interface Guidelines.
The Tentative Parcel Mapisa subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading or other development is proposed with
this subdivision. Therefore, the Urban/Wildlands Interface Guidelines of MSHCP Section 6.1.4
are not applicable.
7.The Project is consistent with the Vegetation Mapping requirements.
The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading or other development is proposed with
this subdivision.Therefore, the mapping requirements set forth in MSHCP Section 6.3.1.are
not applicable.
8.The Project is consistent with the Fuels Management Guidelines.

thissubdivision.Therefore, the Fuels Management Guidelines of MSHCP Section 6.4 are not
applicable.
9.The Project will be conditioned to pay the City’s MSHCP Local Development Mitigation Fee.
The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading or other development is proposed with
this subdivision.The Project will be required to pay the City’s MSHCP Local Development
Mitigation Fee with a subsequent tentative tract map or tentative parcel map to subdivide this
property.
10.The Project is consistent with the MSHCP.
The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels for
Financing and Conveyance purposes only. No grading permits, building permits, or other
development will be allowed with this approval. As described above, MSHCP Consistency
findings will be madewith a subsequent tentative tract map or tentative parcel map to
subdivide this property.
Section 3: Based upon the evidence presented, both written and testimonial, and the above
findings, the Council hereby finds that the Project is consistent with theMSHCP.
Section4:This Resolution shall take effect immediately upon its adoption.
Section 5:The City Clerk shall certify to the adoption of this Resolution and enter it into the book
of original Resolutions.

15315(Class 15: Minor Land Divisions). Class 15 consists of the division of property in urbanized
areas zoned for residential, commercial, or industrial use into four or fewer parcels when the
division is in conformance with the General Plan and zoning, no variances or exceptions are
required, all services and access to the proposed parcels to local standards are available, the

Section3:Thatin accordance with State Planning and Zoning Lawand the Lake Elsinore
Municipal Code, the Councilmakes the following findings for approvalofTentativeParcelMap
No. 37465:
1.The proposed subdivision, together with the provisions for its design and improvement, is
consistent with the General Plan. The proposed subdivision is compatible with the objectives,
policies, general land uses and programs specified in the General Plan (Government Code
Section 66473.5).
The Project has a General Plan Land Use designation of General Commercial (GC) and
Commercial/Specific Plan (C-SP) and Open Space (OS) of Alberhill Ranch Specific Plan
(ARSP). The Tentative Parcel Map is a subdivision of a 234.6-acre site into four (4) parcels
for Financing and Conveyance purposes only. No development is proposed with this
application. Any future development for this area is required to conform to all standards set
forth in the applicable Specific Plan as well as the General Plan.
2.The site of the proposed subdivision of land is physically suitable for the proposed density of
development in accordance with the General Plan.
The Project has a General Plan Land Use designation of General Commercial (GC) and
Commercial/Specific Plan (C-SP) and Open Space (OS) of Alberhill Ranch Specific Plan
(ARSP). The Tentative Parcel Mapisa subdivision of a 234.6-acre site into four (4) parcels
for Financing and Conveyance purposes only. No development is proposed with this
application. Any futuredevelopment for this area is required to conform to all standards set
forth in the applicable Specific Plan as well as the General Plan.
3.The effects that this project are likely to have upon the housing needs of the region, the public
service requirements of its residents and the available fiscal and environmental resources
have been considered and balanced.

Financing and Conveyance purposes only. No development is proposed with this application.
The Project will not have a direct impact on housing.
4.The design of the proposed division of land or type of improvements is not likely to cause
serious public health problems.
The TentativeParcelMaphas been adequately conditioned by all applicable departments and
agencies and will not result in any significant environmental impacts.The proposed
subdivision, together with the conditions applicable thereto,will not be detrimental to the public
health, safety, or welfare or materially injurious to properties or improvements in the vicinity.
Section 4: Based upon all of the evidence presented, the above findings, and the conditions of
approval imposed upon the Project, the Council hereby approvesTentative ParcelMap No.
37465.

2.The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, Agents, and its Consultants
(Indemnitees) from any claim, action, or proceeding against the Indemnitees to attack, set
aside, void, or annul an approval of the City, its advisory agencies,appeal boards, or
legislative body concerning approval, implementation and construction of TPM 37465, which
action is bought within the time period provided for in California Government Code Sections
65009 and/or 66499.37, and Public Resources Code Section 21167, including the approval,
extension or modification of TPM 37465or any of the proceedings, acts or determinations
taken, done, or made prior to the decision, or to determine the reasonableness, legality or
validity of any condition attached thereto. The Applicant's indemnification is intended to
include, but not be limited to, damages, fees and/or costs awarded against or incurred by
Indemnitees and costs of suit, claim or litigation, including without limitation attorneys' fees,
penalties and othercosts, liabilities and expenses incurred by Indemnitees in connection
with such proceeding. The City will promptly notify the applicant of any such claim, action,
or proceeding against the City. If the project is challenged in court, the City and the applicant
shall enter into formal defense and indemnity agreement, consistent with this condition
3.Within 30 days of project approval, the applicant shall sign and complete an
"Acknowledgment of Conditions" and shall return the executed original to the Community
Development Department for inclusion in the case records.

tentative tract map or tentative parcel map shall be required to subdivide this property.Any

7.The applicant/operator shall comply with all requirements of the Riverside County Fire

ENGINEERING DIVISION
8.This four (4)parcel tentative map is for financing and conveyance purposes only. A subsequent
tract map or parcel map shall be required to further subdivide these properties. Specific
conditions of approval related to traffic circulation, grading, drainage, right-of-way dedications,
mitigation fees, conservation easements and other related engineering requirements and/or
mitigations shall be required when the property is subdivided or at time of development. The
development of each Planning Area and/or Phase shall be subject for specific review and
conditions of approval.
9.Each parcel shall have access to public right-of-way.
10.The processing of this map shall conform to the requirements of the Subdivision Map Act.
11.The developer shall be responsible for acquiring any necessary right-of-ways in which the
developer or the City has no legal title or interest.
