Page 1 City of Lake Elsinore Printed on 5/9/2023 Page 1 of 2 REPORT TO CITY COUNCIL To:Honorable Mayorand Members of the City Council From:Grant Yates, City Manager Prepared By: Remon Habib, Acting City Engineer Date:January 8,2019 Subject:Amendment No. 2 to the Professional Services Agreement for Sustainable Civil Engineering Solutions, Inc. for the Main Street/I-15 Interchange Improvements Recommendation 1.Approve the change order submitted by Sustainable Civil Engineering Solutions, Inc., in the amount of $40,005.00. The change order includesthe revised scope of work required by Caltrans. 2.Authorize the City Manager to amendthe existing agreement with Sustainable Civil Engineering Solutions, Inc. for the additional scope and fee. Background Main Street intersectsInterstate 15 and has been identified as a significant alternative traffic route withfuture roadway realignment plans.Anticipateddevelopment, including the proposed Franklin Street interchangeand realignment of Camino Del Norte, warrants the construction of traffic signals and widening of rampsat MainStreet.The additional scope has been identified by the consultant in order to meet the Caltrans standards for the retaining wall design. Discussion The designer, Sustainable Civil Engineering Solutions, Inc, has submitted additional scope to the city summarizing unforeseen tasks. The consultant has acknowledged that the amendmentamount is needed to bring the project to full completion and provide a bid ready set of plans. Tasks requiring additional scope include data collection and design surveys, supplemental standard design documents, ADA construction details, utility plans and coordination, non-standard retaining walls, electrical plans, revisions to storm water data report, right of way certification, and additional administration efforts. Page 2 of 2 Consultant’s schedule shows that Mylars will be available for City Signature on March 11, 2019. Consultant will provide the city with all electronic design files following mylar acceptance by the city. Fiscal Impact Sufficient budget is contained in the adopted Capital Improvement Programbudget. RECITALS A.TheCityandConsultanthaveenteredintothatcertainAgreementforProfessional ServicesdatedasofJune23,2015,(the“OriginalAgreement”).Exceptasotherwisedefined herein,allcapitalizedtermsusedhereinshallhavethemeaningssetforthforsuchtermsinthe OriginalAgreement. B.TheOriginalAgreementprovidedforcompensationtoConsultantinanamountof TwoHundredThirtyEight ThousandSixHundredSixtyEightdollars($238,668). C.Amendment No. 1 provided for addition compensation to the Consultant in the amount of Eighty Seven Thousand Six Hundred Sixty Five dollars ($87,665) for additional scope of work. NOW,THEREFORE,inconsiderationofthemutualcovenantsandconditionssetforth herein,CityandConsultantagreeasfollows: 1.Section3,Compensation,oftheOriginalAgreementisherebyamendedtoadd thefollowing: CityherebyagreestopayConsultantasumnottoexceedatotal of$40,005(Forty ThousandFiveDollarsandnocents)forthe Second Amendmentbringingthetotalagreement amountof $366,338(ThreeHundredSixtySixThousandThreeHundredThirty EightDollarsandnoCents).CityshallpayConsultantforservices renderedpursuanttothisAgreementatthetimeandinthemanner setforthherein.AnytermsinExhibitA-2otherthanthepayment ratesandscheduleofpaymentarenullandvoid. 4. Exceptforthe changesspecificallyset forthherein,allothertermsandconditions oftheOriginalAgreementshallremaininfullforceandeffect.
