Main Street Lake Elsinore, CA 92530 CALL TO ORDER The Regular Meeting of the Planning Commission was called to order at 7:03 p.m. PLEDGE OF ALLEGIANCE Chairman Dobler led the Pledge of Allegiance. ROLL CALL Present: 3 – Commissioners Peters and Klaarenbeek; Chair Dobler Absent: 2 – Commissioner Gray; Vice Chair Carroll PUBLIC COMMENTS - NON-AGENDIZED ITEMS - 3 MINUTES There were no speakers. PUBLIC HEARINGS 1.Planning Application No. 2021-25 (Jack in the Box El Toro) - A request for approval of a Commercial Design Review and two Conditional Use Permits to construct and operate two drive-through restaurants (2,649 sq. ft. and 624 sq. ft., respectively) located at the intersection of Highway 74 and El Toro Cut Off Road 1.Find and determine that the project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15332 (In-Fill Development Projects); Adopt A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ADOPTING FINDINGS THAT PLANNING APPLICATION NO. 2021-25 (CONDITIONAL USE PERMIT NO. 2022- 01, CONDITIONAL USE PERMIT NO. 2022-04 AND COMMERCIAL DESIGN REVIEW NO. 2022-01) IS CONSISTENT WITH THE WESTERN RIVERSIDE COUNTY MULTIPLE SPECIES HABITAT CONSERVATION PLAN; DocuSign Envelope ID: 5D85ACAD-2EE4-4783-8AA7-5DBFFB39D973 Planning Commission Minutes - Final February 21, 2023 City of Lake Elsinore Page 2 2.Adopt A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2022- 01 TO ESTABLISH A 2,649 SQUARE-FOOT DRIVE-THROUGH RESTAURANT AT APNS: 347-130-033 and 347-130-034; 3.Adopt A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2022- 04 TO ESTABLISH A 624 SQUARE-FOOT DRIVE-THROUGH RESTAURANT AT APN: 347-130-035; 4.Adopt A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING COMMERCIAL DESIGN REVIEW NO. 2022-01 PROVIDING BUILDING DESIGN AND RELATED IMPROVEMENTS FOR TWO DRIVE-THROUGH RESTAURANTS AT APNS: 347-130-033, 347-130-034 and 347-130-035. The Public Hearing was opened at 7:04 p.m. Associate Planner Beery presented the staff report. Kim Cousins was called to speak. The Public Hearing was closed at 7:11 p.m. A motion was made by Commissioner Klaarenbeek, seconded by Commissioner Peters that the four (4) Resolutions be Adopted. The Motion carried by the following vote: Aye: 3 – Commissioners Peters and Klaarenbeek; Chair Dobler Absent: 2 – Commissioner Gray; Vice Chair Carroll 2.Planning Application No. 2019-69 (Corydon Gateway) – A request for approval of Tentative Tract Map No. 38626 for condominium purposes to create an approximately 1.64-acre common area parcel and divide the building into six condominium units on an approximately 2.14-acre parcel 1. Find and determine that the proposed project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301(k) (Existing Facilities); and 2.Adopt A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING APPROVAL OF TENTATIVE TRACT MAP NO. 38626 FOR CONDOMINIUM PURPOSES TO CREATE AN APPROXIMATELY 1.64-ACRE COMMON AREA PARCEL AND DIVIDE THE BUILDING INTO SIX CONDOMINIUM UNITS ON AN APPROXIMATELY 2.14- ACRE PARCEL (APN: 370-050-041). The Public Hearing was opened at 7:12 p.m. Associate Planner Beery presented the staff report. Stan Heaton, Applicant, was called to speak. CITY ATTORNEY COMMENTS Assistant City Attorney Mann had no comments. COMMISSIONERS' COMMENTS Commissioners had no comments. ADJOURNMENT The Planning Commission adjourned at 7:18 p.m. to the next Regular meeting on Tuesday, March 07, 2023 in the Cultural Center located at 183 N.
