RESOLUTION NO. 2023-17
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, ADOPTING AN UPDATED MASTER DRAINAGE PLAN AND
FEE SCHEDULE
Whereas, the City of Lake Elsinore has established drainage fees for the Master Drainage
plan by Resolution 91-63 on August 13, 1991;
Whereas, the City awarded a Professional Services Agreement to Albert A. Webb
Associates on September 14, 2021 to update the City’s Master Drainage Plan and area drainage
fees;
Whereas, the updated Master Drainage Plan reduces the number of benefit areas to five
benefit areas, namely Alberhill Zone, Temescal Wash Zone, Lake Zone, East Lake Zone, and
West Elsinore Zone aiming to simplify administration of area drainage fee;
Whereas, the updated Master Drainage Plan identifies the impacts of new development,
the increased necessity for flood protection facilities and the required drainage mitigation projects;
Whereas, the updated Master Drainage Plan calculates the cost of such facilities and
spreads that cost among new development in each drainage area based on the impact of future
development per gross acre and proposes a new Drainage Fee Schedule based on the gross
acreage of the future development;
Whereas, the City intends to utilize funding provided by the drainage fee for drainage and
street improvement projects administered by the City and as reimbursement for developers where
drainage facilities built by the project provide additional benefit beyond the project site as
approved by the City Engineer;
Whereas, the City intends to implement the new area drainage fees recommended by the
consultant over three (3) years in order to lessen impact to the development community;
Whereas, the City of Lake Elsinore met with members of the Building Industry Association
(BIA) of Southern California – The Riverside Chapter on January 10, 2023 and presented the
updated Master Drainage Plan and new Drainage Fee Schedule;
Whereas, the City of Lake Elsinore, will apply a 3.0% yearly area drainage fee increase
effective July 1st, 2026 and on July 1st for every year thereafter; and
Whereas, the drainage area fee required to be paid by a development project will be
based on effective fee at the time payment is made to the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. The City hereby adopts the 2023 Master Drainage Plan and the updated fees
per the following schedule:

Section 2. The City Council makes the following findings:
(a) the Updated Master Drainage Plan identifies the impacts of new development, the
increased necessity for flood protection facilities and required drainage mitigation projects;
(b) the drainage lines identified are necessary to mitigate flood risk from future
development based on the benefit areas outlined in the Updated Master Drainage Plan;
(c) because drainage is a function of watershed and rainfall date corresponding to the
region, it is more appropriate to calculate the fee based on gross acreages rather than square
footage and density of future structures;
(d) drainage fees based on the gross acreage of future development are more
equitable as they are not functionally related to the size and density of development; and
(e) the updated Drainage Fee Schedule equitable spreads the cost of new facilities
based on impacts per gross acre of future development.
Section 3. This Resolution shall take effect immediately upon its adoption and the updated
Drainage Fees will become effective in accordance with the adopted schedule commencing July
1, 2023.
Section 4. The City Clerk shall certify to the adoption of this Resolution and enter it into
the book of original Resolutions.
Passed and Adopted at a regular meeting of the City Council of the City of Lake Elsinore,
California, this 25th day of April 2023.
