Notice of Violation
December 6, 2022
Pursuant to the Lake Elsinore Municipal Code 2019-1416 and the 2019 California Fire Code Section 109, the
building located at 39415 Ardenwood Way, in the City of Lake Elsinore inspected on September 28, 2022, has
been found in violation. It is unlawful for a person, firm or corporation to erect, construct, alter, repair, remove,
demolish, or utilize a building, occupancy, premise, or system regulated by this code, or cause same to be done,
in conflict with or in violation of any of the provisions of this code. The following conditions have been deemed in
violation:
1. 2019 California Fire Code (CFC) 907.8.5 Inspection, testing and maintenance. The building
owner shall be responsible to maintain the fire and life safety systems in an operable condition at all
times. Service personnel shall meet the qualification requirements of NFPA 72 for inspection, testing
and maintenance of such systems. Records of inspection, testing and maintenance shall be
maintained.
Upon inspecting the property, identified documentation for the annual inspection, testing, and
maintenance of the fire alarm system was not available.
Inspect, test, and maintain the fire alarm system in accordance with NFPA 72. Provide a copy of the
fire alarm test report to the fire department. IMMEDIATE
2. (California Code of Regulations, Title 19, Division 1, §904(a)(1)]Required Inspection, Testing
and Maintenance Frequencies. (1) Water-based fire protection systems shall be inspected, tested,
and maintained in accordance with the frequencies required by NFPA 25(2011 edition) including
Annexes A, B, C, D, E, F and G as amended by the State of California. (Published as NFPA 25, 2013
California Edition.)
Upon inspecting the property, identified documentation for the annual inspection, testing, and
maintenance of the fire sprinkler system was not available.
Inspect, test, and maintain the fire sprinkler system in accordance with NFPA 25. Provide a copy of
the fire sprinkler system test report to the fire department. IMMEDIATE

and Maintenance Frequencies. (1) Water-based fire protection systems shall be inspected, tested,
and maintained in accordance with the frequencies required by NFPA 25(2011 edition) including

Inspect, test, and maintain the fire hydrants in accordance with NFPA 25. Provide a copy of the fire
alarm test report to the fire department. IMMEDIATE

Inspect, test, and maintain the standpipes in accordance with NFPA 25. Provide a copy of the
standpipe test report to the fire department. IMMEDIATE
5. 2019 California Fire Code (CFC) 705.2 Inspection and maintenance. Opening protectives in fire-
resistance-rated assemblies shall be inspected and maintained in accordance with NFPA 80.
Opening protectives in smoke barriers shall be inspected and maintained in accordance with NFPA
80 and NFPA 105. Openings in smoke partitions shall be inspected and maintained in accordance
with NFPA 105. Fire doors and smoke and draft control doors shall not be blocked, obstructed, or
otherwise made inoperable. Fusible links shall be replaced promptly whenever fused or damaged.
Opening protectives and smoke and draft control doors shall not be modified.
Upon inspecting the property, identified documentation for the annual inspection, testing, and
maintenance of the fire/smoke doors was not available.
Inspect, test, and maintain the fire alarm system in accordance with NFPA 80 & 105. Provide a copy
of the fire door test report to the fire department. IMMEDIATE
6. 2019 California Fire Code (CFC) 1031.10.2 Power test. Battery-powered emergency lighting
equipment shall be tested annually by operating the equipment on battery power for not less than 90
minutes.
Upon inspecting the property, identified documentation for the annual inspection, testing, and
maintenance of the emergency lighting was not available.
Inspect, test, and maintain the emergency lights in accordance with the California Fire Code. Provide
a copy of the emergency light test report to the fire department. IMMEDIATE
7. 2019 California Fire Code (CFC) 907.8.1 Maintenance required. Where required for compliance
with the provisions of this code, devices, equipment, systems, conditions, arrangements, levels of
protection or other features shall thereafter be continuously maintained in accordance with applicable
NFPA requirements or as directed by the fire code official.
Upon inspecting the property, identified the fire alarm panel has a NAC DISABLED & KNOX BOX
TROUBLE ALARMS. Located in building "N".
Have a qualified contractor repair the TROUBLE ALARMS. IMMEDIATE

8. 2019 California Fire Code(CFC) 509.1 Identification. Fire protection equipment shall be identified in an
approved manner. Rooms containing controls for air-conditioning systems, sprinkler risers and valves, or other
fire detection, suppression or control elements shall be identified for the use of the fire department.Approved
signs required to identify fire protection equipment and equipment location shall be constructed of durable
materials, permanently installed and readily visible.
Upon inspecting the property, identified the sprinkler floor isolation valves are not easily identified for buildings F,
G, and H.
Install the following signs on the street side of the buildings. Sign shall be 12"x 18" in size,with white letters on a
red background. IMMEDIATE

Immediate items shall be corrected immediately, all additional items shall be corrected within (10) days of
this notice.
Persons, firms, or corporations violating any of the provisions or failing to comply with any of the mandatory
requirements of the Ordinances of Lake Elsinore shall be guilty of a misdemeanor. Any person convicted of a
misdemeanor under the Ordinances of Lake Elsinore shall be punished by a fine of not more than one thousand
dollars ($1,000.00), or by imprisonment not to exceed one hundred eighty (180) days, or both such fine and
imprisonment. Such person shall be guilty of a separate offense for each and every day during any portion of which
any violation of any provision of the Ordinances of Lake Elsinore is committed, continued, or permitted by any such
person, and shall be punished accordingly.
