Page 1 of 2 REPORT TO CITY COUNCIL To:Honorable Mayor and Members of the City Council From:Jason Simpson, City Manager Prepared by:Barbara Leibold, City Attorney Date:April 11, 2023 Subject:Purchase of Real Property for Drainage Purposes (APN 375-351-036) Recommendation Adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING THE ACQUISITION OF ONE RIVERSIDE COUNTY TAX- DEFAULTED PROPERTY FOR THE APPROXIMATE PURCHASE PRICE OF $6,390.50 PLUS ASSOCIATED ADMINISTRATIVE COSTS FOR ASSESSOR PARCEL NUMBER 375-351-036 AND AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE THE AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH. Background APN 375-351-036 is available as a tax-defaulted property from the County of Riverside. In March 2023, the City Manager submitted the attached Application to Purchase Tax-Defaulted Property from the County. In response to the City’s Application, the County Tax Assessor–Tax Collector sent the attached Purchase Letter setting the purchase price of $6,390.50 and outlinng the requirements to proceed with the proposed purchase. These requirements include adoption of the attached Resolution offering to purchase the property and making certain findings. A vicinity map is attached as Exhibit A to the proposed Resolution. Discussion APN 375-351-036 is is located on Lakeshore Drive adjacent to City-owned property. Acquisition of the tax-defaulted property would allow the City to combine APN 375-351-036 with the adjacent City-owned parcels 375-351-035 and 375-350-056. The combined parcels will provide opportunities to address drainage issues and enhance public recreation and beach access consistent with the City’s General Plan and zoning ordinances. Attachments Attachment 1 - Resolution Exhibit A - Vicinity Map Attachment 2 - Application to Purchase Tax- Defaulted Property Attachment 3 - Riverside County Treasurer-Tax Collector Purchase Letter RESOLUTION NO. 2023-___ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING THE ACQUISITION OF ONE RIVERSIDE COUNTY TAX-DEFAULTED PROPERTY FOR THE APPROXIMATE PURCHASE PRICE OF $6,390.50 PLUS ASSOCIATED ADMINISTRATIVE COSTS FOR ASSESSOR PARCEL NUMBER 375-351-036 AND AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE THE AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH Whereas, the City of Lake Elsinore expresses interest in acquiring tax-defaulted property from the County of Riverside, California under Chapter 8 of the State Revenue and Taxation Code; and Whereas, the tax-defaulted property referred to as Assessor Parcel Number 375-351-036 is located on Lakeshore Drive adjacent to other City-owned property within the City of Lake Elsinore as depicted on and more specifically described in Exhibit A attached hereto and incorporated by reference herein; and Whereas, the City objects to the public sale of Assessor Parcel Number 375-351-036; and Whereas, the intended purpose of the City’s acquisition is to combine the tax-defaulted property with adjacent City-owned property to enhance public open space and recreation opportunities and other public purposes consistent with and in furtherance of the City’s mission statement to be the “ultimate lake destination where all can live, work, and play, build futures and fulfill dreams”; and Whereas, the in addition to the purchase price of $6,390.50 plus associated administrative costs for the property, the cost for the Notice of the Agreement to Purchase Tax-Defaulted Property shall be paid by the City of Lake Elsinore. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. Incorporation of Recitals. The Recitals set forth above are true and correct and incorporated herein by reference. Section 2. Interest to Acquire. The City of Lake Elsinore hereby offers to purchase the tax- defaulted property identified as Assessor Parcel Number 375-351-036 in the amount of $6,390.50 plus associated administrative costs, through a Chapter 8 Agreement of Sale. Section 3. Notice of Agreement. The City of Lake Elsinore shall pay the cost of giving notice of the Agreement to Purchase Tax Defaulted Property as required by the County of Riverside and applicable state law. Section 4. Intended Use. The intended purpose of acquisition for the tax-defaulted property identified as Assessor Parcel Number 375-351-036 is to combine the tax-defaulted property with adjacent City-owned property to enhance public open space and recreation opportunities and other public purposes. The City Manager is authorized to proceed with the acquisition and execute all related documents including an Agreement to Purchase Tax-Defaulted Property through the County of Riverside Treasurer-Tax Collector. Section 6. Effective Date. This Resolution shall take effect immediately upon its adoption. Section 7. Certification. The City Clerk shall certify to the adoption of this Resolution and enter it into the book of original Resolutions.
