Notice of Violation
August 5, 2022
Pursuant to the Lake Elsinore Municipal Code 2019-1416 and the 2019 California Fire Code Section 109, the
building located at 18860 Dexter Avenue, in the City of Lake Elsinore inspected on April 21, 2022 has been
found in violation. It is unlawful for a person, firm or corporation to erect, construct, alter, repair, remove, demolish
or utilize a building, occupancy, premise or system regulated by this code, or cause same to be done, in conflict
with or in violation of any of the provisions of this code. The following conditions have been deemed in violation:
1. 2019 California Fire Code (CFC) 507.5.5 Clear space around hydrants. A 3-foot(914 mm) clear
space shall be maintained around the circumference of fire hydrants, except as otherwise required or
approved.
Upon inspecting the property, identified the north and south fire hydrants do not have 3 feet of
clearance around the circumference of the fire hydrants. Fire hydrants are located on the street.
Modify the fence and remove the bushes around the fire hydrants to ensure they are accessible and
visible. IMMEDIATE
2. 2019 California Fire Code (CFC) 507.5.2 Inspection, testing, and maintenance. Fire hydrant
systems shall be subject to periodic tests as required by the fire code official. Fire hydrant systems
shall be maintained in an operative condition at all times and shall be repaired where defective.
Additions, repairs, alterations, and servicing shall comply with approved standards. Records of tests
and required maintenance shall be maintained.
Upon inspecting the property, identified the wharf hydrant is missing the protective cap and the test
reports are not available. Mr. Klein (property manager) stated the wharf hydrants have never been in
service.
Inspect, test, and maintain the wharf hydrant in accordance with Title 19. Provide a current copy of
the 5-year fire hydrant inspection test report to the fire department and/or, provide documentation that
the wharf hydrant is not required. Install missing protective cap. IMMEDIATE
Immediate items shall be corrected immediately, all additional items shall be corrected within (10) days of
this notice.
Persons, firms, or corporations violating any of the provisions or failing to comply with any of the mandatory
requirements of the Ordinances of Lake Elsinore shall be guilty of a misdemeanor. Any person convicted of a
misdemeanor under the Ordinances of Lake Elsinore shall be punished by a fine of not more than one thousand
dollars ($1,000.00), or by imprisonment not to exceed one hundred eighty (180) days, or both such fine and
imprisonment. Such person shall be guilty of a separate offense for each and every day during any portion of which
any violation of any provision of the Ordinances of Lake Elsinore is committed, continued, or permitted by any such
person, and shall be punished accordingly.
