HomeMy WebLinkAboutItem No. 08 - Amendment No. 1 to the Agreement for Lake Water Testing Page 1 of 2 REPORT TO CITY COUNCIL To:Honorable Mayor or Members of the City Council From:Jason Simpson, City Manager Prepared by:Johnathan Skinner, Community Services Director Date:January 24, 2023 Subject:Amendment No. 1 to the On-call Services Agreement with Wood Environment & Infrastructure Solutions, Inc. for Lake Water Testing Recommendation Approve and authorize the City Manager to execute Amendment No. 1 to the On-Call Services Agreement with Wood Environment & Infrastructure Solutions, Inc. USA (now Operating as WSP Environment & Infrastructure Solutions, Inc.) in such final form as approved by the City Attorney. Background On August 25, 2020 the City of Lake Elsinore entered into an agreement (Exhibit A) with Wood Environment and Infrastructure Solutions to assist the City of Lake Elsinore with services relating to in-lake water quality on an on-call basis including but not limited to the following: a. Collection of water quality samples and analysis as needed b. Lake water quality consultation and support as needed c. Habitat restoration support as needed (e.g. bathometry and sediment sampling) d. Special projects related to in-lake water quality e. Grant writing support The original contract is for three years at $30,000 per year with two optional 1-year extensions. Discussion Due to the recent algae bloom and resulting lake closure, the City has utilized WSP for bi-weekly lake water testing and, thus, the maximum contract amount of $30,000 for FY22/23 has nearly been exhausted. Since the timeframe of current and future algae blooms is unknown, the proposed amendment increases the annual allotment by $20,000. It is expected that this amount will cover the additional testing incurred this fiscal year to date and will allow for the same frequency of testing during the current and future harmful algae blooms through the two one-year extension periods, as well. Additionally, Wood is now operating as WSP Environment & Lake Water Testing Page 2 of 2 Infrastructure Solutions, Inc., with the name change reflected in the proposed amendment, as well. Fiscal Impact Approval of this item will result in an annual increase from not-to-exceed $30,000 to not-to exceed $50,000 for the next three fiscal years for a total increase of $60,000 to the agreement. Attachments Attachment 1- Amendment No. 1 Attachment 2 – Original Agreement AMENDMENT NO. 1 TO THE AGREEMENT FOR CONTRACTOR SERVICES WITH WOOD ENVIRONMENT & INFRASTRUCTURE SOLUTIONS FOR ON-CALL SERVICES Pursuant to Section 2(c) of the AGREEMENT entitled, "Agreement for Contractor Services, Wood Environment & Infrastructure Solutions, Inc., On -Call Services" dated August 25, 2020; and Whereas this Agreement includes a three-year term with the option to extend for two (2) additional one-year terms not to exceed $30,000 per year. Therefore, the City and Contractor as named in the Agreement (Exhibit A), hereby agree to the following changes: 1. Increase the annual amount of the agreement to not to exceed $50,000, to include the current fiscal year (FY23-24) and to include the optional two additional one-year terms (FY24-25 and FY25-26). II. Acknowledge that Wood Environment & Infrastructure Solutions, Inc. is now operating as WSP Environment & Infrastructure Solutions, Inc. Except as otherwise expressly amended herein, all of the terms, conditions, and provisions of the Agreement (Exhibit A) shall continue in full force and effect. IN WITNESS WHEREOF, the parties hereto have executed this Amendment No. 1 to the "Agreement for Contractor Services, Wood Environment & Infrastructure Solutions, Inc., On -Call Services" on the dates set forth below.
