Recommendation
Adopt by title only and waive further reading of AN Ordinance OF THE CITY COUNCIL OF THE
CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING CHAPTER 2.20 OF THE LAKE
ELSINORE MUNICIPAL CODE (LEMC) REGARDING DISASTER RELIEF.
Background
At its Regular meeting on December 13, 2022, the City Council introduced by title only and waived
further reading of the Ordinance.

ORDINANCE NO. 2022-
AN ORDINANCE OF THE OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, AMENDING CHAPTER 2.20 OF THE LAKE
ELSINORE MUNICIPAL CODE (LEMC) REGARDING DISASTER RELIEF
Whereas, Chapter 2.20 of the Lake Elsinore Municipal Code was amended and restated
on September 12, 2006 by Ordinance No. 2006-1192;
Whereas, on April 14, 2020, the City Council adopted Urgency Ordinance No. 2020-1425
amending sections of Chapter 2.20 to change the City Council’s periodic review of the continuing
emergency from every 14 days to every 60 days consistent with the California Government Code
and clarifying the enforcement authority of the Riverside County Public Health Officer relating to
orders, quarantine regulations, and rules prescribed by the State Department of Public Health
and other rules and regulations issued under the provisions of the California Health and Safety
Code;
Whereas, since the adoption of Ordinance No. 2006-1192, the location of the Emergency
Operation Center (EOC) and secondary EOC have been relocated, and the EOC Manager has
reassigned to the Emergency Services Manager; and
Whereas, the following amendments are proposed to reflect the proper authority,
terminology, and execution of duties identified within Chapter 2.20 of the Lake Elsinore Municipal
Code (LEMC) regarding “Disaster Relief”.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE
HEREBY ORDAINS AS FOLLOWS:
Section 1. The foregoing recitals are true and correct and are hereby incorporated into the body
of this Ordinance as substantive findings of the City Council.
Section 2. LEMC Chapter 2.20 “Disaster Relief,” Section 2.20.030 “Disaster Director” subsection
B is amended as follows:
“B. The City Emergency Services Manager, who shall be designated by the City Manager
and who shall serve as Vice-Chair of the Council; and
Section 3. LEMC Chapter 2.20 “Disaster Relief,” Section 2.20.120 “Emergency Operating
Centers” is amended as follows:
The EOC Manager is the City Emergency Services Manager. The primary EOC is located
at the City’s Public Works Yard, alternate EOC is located at the Rosetta Canyon Fire Station.
Section 4. CEQA. This Ordinance is exempt from the California Environmental Quality Act in
accordance with Section 15061(b) (3) there is no possibility that the activity in question may have
a significant effect on the environment.
Section 5. Severability. If any provision of this Ordinance or its application is held invalid
by a court of competent jurisdiction, such invalidity shall not affect other provisions, sections, or
applications of the Ordinance which can be given effect without the invalid provision or
application, and to this end each phrase, section, sentence, or word is declared to be severable.
Section 6. Effective Date. This Ordinance shall take effect 30 days after its adoption.

Section 7. Certification. The City Clerk shall certify to the passage of this Ordinance and shall
cause this Ordinance to be posted or published as prescribed by law.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council of the
City of Lake Elsinore, California, on this ___ day of ____________ 2022.
