and standards for certain types of industrial developments within proximity
to sensitive receptors
Recommendation
Establish a subcommittee consisting of two City Council Members to work with City staff to
develop recommendations regarding policies and standards for certain types of industrial
developments within proximity to sensitive receptors and report its findings to the City Council.
Discussion
By Memorandum to City Manager Jason Simpson dated June 28, 2022, City Council Member
Bob Magee outlined a “Proposed Good Neighbor Policy” to address issues regarding large
warehouse/logistic centers near sensitive receptors such as residential structures, schools, day
cares, hospitals, senior/assisted living homes, and outdoor recreational areas. The stated
purpose and intent of the Good Neighbor Policy is to “… preserve the City Council’s vision and
our 2040 plan.” A copy of the Memorandum is provided in Exhibit A.
Typically, policy level standards start at the General Plan level and are implemented through
Zoning Code/Specific Plan regulations. Policies do not eliminate requirements for project specific
review but can be used in conjunction with project-level environmental review and the City’s
zoning/specific plan regulations. Where policies are adopted to guide discretionary land use
decisions, those policies must be consistent with the adopted General Plan and applicable Zoning
Code/Specific Plans.
Notably, the City’s General Plan provides for warehouse uses in the City’s “Limited Industrial”
designations. These Limited Industrial areas are generally zoned M-1 or M-2. However, neither
the M-1 or M-2 contemplate warehouse styled logistic centers as either a permitted or conditional
use. The M-2 zone provides for “Warehousing excluding freight and truck terminals” as a
permitted use which forecloses a typical logistics center.
Given the current lack of specific direction in the City’s policies and land use documents for
warehouse operations that include a significant number of truck terminals, Council Member
Magee’s concerns are well taken.

City staff and the City Attorney have discussed the policy issues and recommend formation of a
City Council Subcommittee to discuss in greater detail both the proposed policy and potential
changes in the Lake Elsinore Municipal Code in order to more effectively im plement “good
neighbor” regulations.
A two-member City Council sub-committee could work with City Staff and receive input from the
public to explore the stated concerns, formulate recommendations, and provide a detailed report
to the full City Council. The City Council might then provide direction to the Planning Commission
and City staff.

Re: Proposed Good Neighbor Policy
In order to preserve the Council's Vision and our 2040 plan I believe that we need to establish
some guidelines for certain types of Industrial Development (i.e. Mega Warehouses). I have
drafted a modest set of standards that I would like to have considered by my colleagues on a
future agenda.
The City of Lake Elsinore's "Good Neighbor Policy"
for all Industrial Developments in excess of 250,000 sq. ft.
and Adjacent to Sensitive Receptors
1. Applicants proposing warehouse -type structures in excess of 250,000 square feet
adjacent to sensitive receptors (i.e. occupied residential structures, schools, day care
facilities, hospitals, senior or assisted living homes, outdoor recreation areas, etc.) shall
provide detailed justification supporting the proposed setback of less than 1,000 feet as
measured from structure to structure. In no case shall the minimum setback from an
existing sensitive receptor to a point where a Tractor Trailor rig can or may be
positioned, stored or operated be less than 500 feet.
2. Commercial trucks shall not be parked on the public right-of-ways or allowed to spill
over into residential areas. Adequate on-site parking and stacking/queuing must be
provided as part of the site design.
3. Hours of operation adjacent to sensitive receptors shall be limited to Monday thru
Friday 7:00 a.m. to 7:00 p.m. No work shall occur on the weekends or Legal Holidays.
4. Noise standard: At no time during normal business hours shall the noise generated
from the adjacent industrial operation exceed 65 dbs. as measured from the closest
occupied structure.
5. All construction and grading related activities shall comply with the current SCAQMD
Regulations in effect at the time work commences.
6. A Planning Department Representative shall conduct periotic on-site inspections during
and after construction to verify compliance or recommend better efforts toward
compliance during grading, construction and operational activities.
