develop a new mixed-use commercial and residential development (123,026
sq. ft. in total) on a 12.60-acre site

Recommendation
Open the Public Hearing, receive testimony, if any, and continue the item to August 9, 2022.
Discussion
The California Subdivision Map Act and applicable Planning and Zoning Laws impose specific
notice and hearing requirements for tentative tract maps, conditional use permits, and other land
use entitlements. These requirements are incorporated into the Lake Elsinore Municipal Code.
They require two public hearing notices to be provided at least ten days before the hearing: 1)
publication in the newspaper and 2) mailed notice to property owners within 300 feet of the real
property that is the subject of the hearing.
Under these requirements, the City mailed the notice to the surrounding property owners ten days
before the hearing date. The notice was also submitted to the newspaper for publication ten days
before the hearing date. However, the notice was not published correctly in the newspaper due
to a generating error on the newspaper page on which the notice was supposed to appear.
Staff is requesting a continuance of this item, so there is adequate time to correctly publish it in
the newspaper for the August 9, 2022, hearing. An updated notice will also be mailed to the
surrounding property owners notifying them of the August 9, 2022, hearing date.
