The original expiration date of TPM 37364 was April 14, 2022. On March 28, 2022, the applicant filed a request to extend the expiration date of TPM 37364 by three years to April 14, 2022. The applicant has stated that the time extension is necessary to finalize preparation of the Covenants, Conditions, and Restrictions (CC&Rs) document associated with the newly formed Property Owner’s Association. In accordance with the Lake Elsinore Municipal Code and the Subdivision Map Act, subdividers may apply to the City Council for multiple extensions to the life of a tentative map for a period or periods not exceeding a total of six years.1 Therefore, if EOT 2022-02 is approved for three years, the tentative map will still be eligible for up to three additional years in discretionary extensions. Discussion TPM 37364 is a proposal to convert a 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes. The subject property consists of five existing one-story retail buildings attached by common walls. The Project is located within the Lake Elsinore Square Shopping Center, northeasterly corner of Collier Avenue and Central Avenue, mor e specifically 18294 and 18298 Collier Avenue. (APNs: 377-070-035 and 036). Staff is neither proposing nor recommending major modifications to the original conditions of approval because substantial changes have not occurred with respect to the project, site conditions, or the regulatory circumstances under which the project will be undertaken. 1 LEMC §16.24.160.B and Government Code §66452.6.e EOT for TPM 37364 June 14, 2022 Environmental Determination The proposed Project is exempt from the California Environmental Quality Act (Cal. Pub. Res. Code §§21000 et seq.: “CEQA”) and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.) according to Section 15301 (Class 1: Existing Facilities). Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Tentative Parcel Map is proposing to convert the 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes. Under Section 15301(k), the Tentative Map is proposing a subdivision of an existing commercial retail building consisting of five (5) units attached by common walls. No physical changes will occur as part of this project and no expansion of use will result. The Project is consistent with the Western Riverside County Mul tiple Species Habitat Conservation Plan (MSHCP). The Project has been completely disturbed by the development of the existing retail center. The Tentative Map is proposing to convert the 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes. The Project site is not located in a Criteria Cell and was not required to be processed through the Lake Elsinore Acquisition Process (LEAP) and Joint Project Review (JPR) processes. The Project complies with all other applicable requirements of the MSHCP. Fiscal Impact The time and costs related to processing this extension of time request have been covered by the application fee paid by the applicant. No General Fund budgets have been allocated or used in the processing of this application. Exhibits A – EOT Resolution B – Conditions of Approval C – Vicinity Map D – Aerial Map E – TPM 37364 RESOLUTION NO. 2022-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING A THREE-YEAR EXTENSION OF TIME FOR TENTATIVE PARCEL MAP NO. 37364 TO APRIL 14, 2025 Whereas, on April 14, 2020, the City Council approved Planning Application No. 2017-61 (Tentative Parcel Map No. 37364) to convert a 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes located at Assessor’s Parcel Numbers 377-070-035 and 377-070-036; and, Whereas, on March 28, 2022, Pascal Apotheloz, DRC Engineering Inc., applied for an Extension of Time (EOT 2022-02) to extend the expiration date of Tentative Parcel Map (TPM) No. 37364 by three years from April 14, 2022 to April 14, 2025; and, Whereas, on June 14, 2022, at a duly noticed Public Hearing the City Council (Council) has considered the recommendation of City staff as well as evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1: The Council has reviewed and analyzed the proposed extension of time for TPM No. 37364 prior to making its decision to extend the life of the map for a period of three years. Section 2: The Council hereby finds and determines that the Project is categorically exempt from California Environmental Quality Act (Cal. Publ. Res. Code §§21000 et seq. “CEQA”) and the State CEQA Guidelines (14. Cal. Code Regs §§15000 et seq.), specifically pursuant to Section 15301 (Class 1: Existing Facilities). Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Tentative Parcel Map is proposing to convert the 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes. In accordance with Section 15301(k), the Tentative Map is proposing a subdivision of an existing commercial retail building consisting of five (5) units that are attached by common walls. No physical changes will occur as part of this project and no expansion of use will result. Section 3: That in accordance with the California Subdivision Map Act (Cal. Gov. Code Section 66000 et. seq.) and the City of Lake Elsinore Municipal Code Section 16.24.160, the City Council makes the following findings for the approval of an extension of time for TPM No. 37364: 1. The proposed subdivision, together with the provisions for its design and improvements, is consistent with the City of Lake Elsinore General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). The Project has a General Plan Land Use designation of General Commercial (GM) and is located within the Business District. The GM Land Use designation provides for retail, services, restaurants, professional and administrative offices, hotels and motels, mixed- use projects, public and quasi-public uses, and similar and compatible uses. The Tentative Map is proposing to convert the 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes The Tentative Parcel Map is consistent with the designated land use, development and design standards, and all other appropriate requirements contained in the General Plan and the Subdivision Map Act. 2. The site of the proposed division of land is physically suitable for the proposed density of development in accordance with the General Plan. The Project site contains an existing retail shopping center with five, one-story retail buildings that are attached by common walls. The Tentative Map is proposing to convert the 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes. The proposed Tentative Map is only proposing to convert this 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes and will not alter the previously approved density of development. 3. The effects that the Project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. The Tentative Map is proposing to convert the 5.45-acre lot into a one (1)-condominium lot with five (5) units for condominium purposes. The existing commercial retail center serves the surrounding residents in the area. The Project will not have a direct impact on housing. 4. The design of the proposed division of land or type of improvements is not likely to cause serious public health problems. The Project has been adequately conditioned by all applicable departments and agencies and will not result in any significant environmental impacts. The proposed Project, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. Section 4: Based upon the evidence presented, both written and testimonial, and the above findings, and the Conditions of Approval imposed upon the project, the Council hereby approves a three-year extension of time for TPM 37364 to April 14, 2025. Section 5: This Resolution shall take effect immediately upon its adoption. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, Agents, and its Consultants (Indemnitees) from any claim, action, or proceeding against the Indemnitees to attack, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning approval, implementation and construction of TPM 37364, which action is bought within the time period provided for in California Government Code Sections 65009 and/or 66499.37, and Public Resources Code Section 21167, including the approval, extension or modification of TPM 37364 or any of the proceedings, acts or determinations taken, done, or made prior to the decision, or to determine the reasonableness, legality or validity of any condition attached thereto. The Applicant's indemnification is intended to include, but not be limited to, damages, fees and/or costs awarded against or incurred by Indemnitees and costs of suit, claim or litigation, including without limitation attorneys' fees, penalties and other costs, liabilities and expenses incurred by Indemnitees in connection with such proceeding. The City will promptly notify the applicant of any such claim, action, or proceeding against the City. If the project is challenged in court, the City and the applicant shall enter into formal defense and indemnity agreement, consistent with this condition 3. Tentative Parcel Map No. 37364 shall comply with the State of California Subdivision Map Act and applicable requirements contained in the LEMC, unless modified by approved Conditions of Approval. Any proposed minor revisions to approved plans shall be reviewed and approved by the Community Development Director or designee. Any proposed substantial revisions to the approved plans shall be reviewed according to the provisions of the Municipal Code in a similar manner as a new application. 7. All future development proposals shall be reviewed by the City on a project-by-project basis. If determined necessary by the Community Development Director or designee, additional environmental analysis will be required. 8. Provisions of the City's Noise Ordinance (LEMC Chapter 17.176) shall be satisfied during all site preparation and construction activity. Site preparation activity and construction shall not commence before 7:00 AM and shall cease no later than 5:00 PM, Monday through Friday. Only finish work and similar interior construction may be conducted on Saturdays and may commence no earlier than 8:00 am and shall cease no later than 4:00 p.m. Construction activity shall not take place on Sunday, or any Legal Holidays. 9. If any of the conditions of approval set forth herein fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted, deny or further condition issuance of all future building permits, deny revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. PRIOR TO RECORDATION OF FINAL MAP 10. All lots shall comply with minimum standards contained in Chapter 17.124 (General Commercial (C-2)) of the LEMC. 11. Prior to Recordation of the Final Map, the applicant shall demonstrate that the building will be divided for different tenant spaces or units for Condominium purposes. The separation for each unit shall comply with the current California Building Code, California Fire Code, and the LEMC and is subject to a review and approval by the Building Official and the Fire Marshal. 12. A precise survey with closures for boundaries and all lots shall be provided per the LEMC. 13. The applicant shall meet all requirements of Elsinore Valley Municipal Water District (EVMWD). 14. The applicant/operator shall comply with all requirements of the Riverside County Fire Department Lake Elsinore Office of the Fire Marshal.
