RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, APPROVING
COMMERCIAL DESIGN REVIEW NO. 2007-OS FOR THE
CINGULAR WIRELESS MONO-PALM CELLULAR TOWER
FACILITY
WHEREAS, Mark Johns, Cingular Wireless, has initiated proceedings for
Commercial Design Review No. 2007-OS for the design and consriuction of a
sixty-five foot (65') tall mono-palm wireless antenna tower facility with an
associated two-hundred and forty (240') square foot equipment shelter and
landscaping improvements on an existing vacant lot located at 800 East Franklin
Street, APN 377-330-01 l; and
WHEREAS, the Planning Commission of the City of Lake Elsinore at
a regular meeting held on March 6, 2007 made its report upon the desirability and
made its recommendarion in favor of the project by adopting Planning Commission
Resolution No. 2009-44 Recommending to the City Council approval of
Commercial Design Review No. 2007-05; and
WHEREAS, public notice of said application has been given, and the City
Council has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on March 27, 2007.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
SECTION 1. The City Council has considered the proposed project prior to
making a decision to approve Commercial Design Review No. 2007-05. The City
Council finds and deternunes that the project is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) pursuant to a
Class 3 exemption for the construction and location of new small facilities because
the project has all necessary public facilities and is not located in an
environmentally sensitive area.
SECTION 2. That in accordance with State Planning and Zoning Law and
the Lake Elsinore Municipal Code, the City Council makes the following findings
for the approval of the Commercial Design Review No. 2007-05:

l. The project, as approved, will comply with the goals and objectives of the
General Plan, Specific Plan and the Zoning District in which the project is
located.
The Commercial Design Review complies with the goals and objectives of
the General Plan in that the approval of this cellular telecommunications
facility project will assist in achieving the development of a well balanced
and functional mix of residential, commerctial, industrial, open space,
recreational, and institutional land uses as well as improve wireless
communication coverage for the general public and City of Lake Elsinore
residents in the general area.
2. The project complies with the design directives contained in the General
Plan Urban Design Element and all other applicable provisions of the Lake
Elsinore Municipal Code.
The Commercial Design Review is appropriate to the site and surrounding
developments in that the cellular telecommunications facility has been
designed in consideration of the size and shape of the property. Suff cient
setbacks and enhanced onsite landscaping have been provided thereby
creating interest and varying vistas as a person moves along abutting
streets. Further, the project, as proposed, will complement the quality of
existing development and will create a visually pleasing, non-detractive
relationship between the proposed development and existing projects in that
the cellular tower has been camouflaged to represent a date palm tree and
other additional landscape improvements have been added including two
live palm trees and perimeter plantings which serve to enhance the
aesthetics of the proposed facility.
3. Subject to the attached Conditions of Approval, the proposed project is not
anticipated to result in any significant adverse environmental impacts.
Notwithstanding the fact that the Project is exempt from CEQA pursuant to
a Class 3 categorical exemption, the Project was reviewed and conditioned
by all applicable City departments to ensure that the telecommunications
facility blends into the existing natural landscape and creates the least
amount of disturbance, and does not negatively impact the residents or
businesses of Lake Elsinore. The Project will not result in any significant
adverse environmental impacts given the attached conditions of approval.

4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning
Code, including guarantees and evidence of compliance with conditions,
have been incorparated into the approval of the subject project to ensure
development of the property in accardance with the objectives of Chapter
17.82.
SECTION 3. This Resolution shall take effect from and after the date of its
passage and adoption.
PASSED, APPROVED AND ADOPTED this 27th day of March 2007, by
the following vote:
