Canyon View Estates formerly known as Rancho San Jacinto) 32200 Crooked Arrow Dr Wildomar RE: Development Agreement No. 2022-01 (Canyon Hills Estates). Lake Elsinore City Council Meeting 5/25/2022 This letter is inform the council and all interested parties that I object to the City of Lake Elsinore and TRU MARK moving forward with Development Agreement No. 2022-01 (Canyon Hills Estates) I respectfully request that the current project, Tentative tract Map and entire Environmental Impact Report be reviewed for accuracy and veracity and that the entire project be terminated until such time that accurate information can be obtained and reviewed by the City of Lake Elsinore and all concerned citizens. There are several reasons to object to any part of this project moving forward, but I personally am most concerned with the project's third phase which would directly border my properties within 50 feet from my property lines. The same third phase plans in their current form would gravely impact our entire community adversely by giving secondary vehicle access to Canyon Hills Estates third phase Via Navajo Rd. a private unmaintained dirt road within Canyon View Estates in the City of Wildomar. 1. It is my opinion that the City of Lake Elsinore (via the planning office) and the developer are both aware that the current published plans cannot be put into place due to the significant change in access needed to accommodate the third phase. Navajo Road cannot be used as access per the City of Wildomar. This would denote a significant change in the scope of the project and would trigger a need to complete a Supplemental Environmental Impact Report after new tract plans are completed and pass through the review process before moving forward with any aspect of the project as it would no longer be in compliance with CEQA standards. 2. It is my opinion that during the initial EIR 2006-02, adopted by the City of Lake Elsinore 1/23/2007, never addressed the probable well water contamination to the rural communities bordering the proposed project. Canyon View Estates homes all depend on well water not only for human consumption, but also for livestock and agricultural needs. This would denote a new environmental impact, not previously reviewed and would require that a Supplemental Environmental Impact Report be completed before moving forward with this project. CEQA guidelines 3. It is my opinion that sufficient time has passed 15.5 years that the entire EIR is no longer valid. The report was completed for a project that was due to be completed within 4 yrs and did not take into account a 15.5 year passage of time nor significant changes in the environment prior to the start of the project This extended period of time from completion of the EIR and the beginning of the project in itself triggers the need for a completely new EIR to be done before any aspect of this project can move forward. CEQA guidelines 4.It is my opinion that significant environmental changes have occured within the scope of the project to warrant updated surveys to be completed for a. Fire safety and emergency services access and availability due to a huge change in population, increased traffic circulation and an increasingly severe drought all worsened during this 15.5 year time frame. CEQA guidelines b. Traffic circulation (massive local traffic issues on Canyon Hills Rd at Lost Rd and where Canyon Hills Rd becomes Holland Rd, Menifee) due to population growth during this time and the improvements to Canyon Hills Rd creating a better access from Southern Menifee via Holland Rd to Interstate 15 access. The traffic volume capacity ratio is no longer anywhere near the projected 0.90. The explosion of growth in Lake Elsinore (2006-41,239 to 2022-72,979 up 75%) and in the surrounding communities of Wildomar and Menifee has led to dangerous traffic conditions in this area and past mitigation ideas are no longer viable. CEQA guidelines c. Water Quality Management Plan due to significant drought issues and with special focus of the water table and how the project will affect the well water patency and potability for local residents depending on it for human and animal consumption and the irrigation of crops. 5. It is my opinion that the current EIR did not appropriately document nor mitigate significant aesthetic issues in regards to the rural communities bordering this project. In the EIR an artist's rendering of the view from Canyon Hills Estates towards the project is from the farthest property from the project and in no way represents the 10 plus properties that will directly border the third phase of the project. If the current plans,without appropriate agreed upon mitigation, move forward 10 of the properties within Canyon Hills Estates will have homes within 50 feet of their property boundaries. Each of these properties within Canyon View Estates is 2.5 acres with only one allowed home per parcel. There is a potential for multiple new homes to border property lines with the current TRU MARK plans to have on average 2.9 homes per developed acre. This would denote a new environmental impact, not previously reviewed and would require that a Supplemental Environmental Impact Report be completed before moving forward with this project. CEQA guidelines 6. It is my opinion that by allowing this project to move forward it would significantly devalue all the rural, Very Low Density, homes and properties within Canyon View Estates. The fire safety, vehicle circulation (traffic), change in aesthetics, potential for well water contamination all as a result of this project will put an undue financial burden on this entire community. 7. It is my opinion that the City of Lake Elsinore did not properly notify all concerned citizens during the planning review phase prior to the 5/2/2022 meeting, recently undertaken by the Planning Committee. No members of our community were notified of this event (many fall within the 300 feet range and this community and HOA have strongly objected to this project on numerous occasions and are known as interested parties. At the 5/2/2022 meeting I was told that the next phase would be a review by the City Council in late June 2022. I was notified by mail (received 5/16/2022) that this review was moved up to 5/25/2022 giving me less than 10 days to prepare a response. The notice itself was sent with a significant error in regards to the date of the meeting (Tuesday the 25th vs Wednesday the 25th)When I called to verify the date with Ms Damaris Abraham, the City Planning Manager, she informed me that this project and Development Agreement had been given preferential treatment and expedited focus due to a pending deadline in July 2022 and that the City Council review had to be moved up to ensure the deadline was met. In my opinion the Developer and possible city revenue should not infringe on the rights of individual citizens to participate in this matter. The seven areas listed above each individually require that the City of Lake Elsinore and TRU MARK, the developer, must take action to ensure the safety of the environment is paramount if the proposed project is to move forward in the future.The seven areas combined together, especially the 15.5 year span of time (a decade and a half) screams the need for a complete re-evaluation of this project.
