ORDINANCE N0. 733
AN ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, AMENDING TITLE 6, CHAPTER 6.04,
OF THE LAKE ELSINORE MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES ORDAIN
AS FOLLOWS:
SECTION ONE.
The following Sections and Subsections are hereby added to the Lake
Elsinore Municipal Code, Chapter 6:
Section 6.04.010 - Definiti
(K) "Exotic Animals" means any non-domestic animal and/or any
animal not native to the Southern California area.
Section 6.04.100 - Animal control officers--Enforcement duties--
Entrance upon private property. It shall be the duty of all peace officers
to cooperate with and assist the animal control officer in the enforcement of
the provisions of this chapter. Unless otherwise prohibited by law, all persons
whose duty it is to enforce the provisions of this chapter are hereby empowered
to enter upon private property where any animal is kept or believed to be kept
for the purpose of ascertaining whether any animal is harbored in violation of
any of the provisions of this chapter, subject to constitutional and statutory
search and seizure laws.
Section 6.04.160 - Keeping of Exotic Animals. It is hereby unlawful
for any person, firm or corporation to have, keep, harbor or possess any exotic
animal, the possession of which requires a California Department of Fish and
Game Welfare Permit, Game Breeder's License, Scientific Collector's Permit, or
a Letter Permit, within the City Limits.
Section 6.04.170 - Keeping of Exotic Animals--Exceptions.
A. Any animal harbored, owned or possessed prior to the passing of
this ordinance shall be allowed to be kept as per signed agreement
between the owner/keeper and the Lake Elsinore Animal Control
Department.
B. An Educational Institution may ;,;for an approved, temporary time,
have any animal contained with a Scientific Permit through the
Department of Fish and Game. Such a request shall be made, in
writing', to the Lake Elsinore Animal Control Department, at least
five (5) working days prior to possession of such animal as listed
in Exhibit A attached hereto and made a part hereof.
Section 6.04.180 - Violation--Penalty. Any person violating any of the
provisions of this chapter shall be guilty of an infraction and upon conviction
thereof shall be punished by fine(s) established by a resolution of the City
Council.
SECTION TWO.
This ordinance shall take effect as provided by law.

AN ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, AMENDING ORDINANCE N0. 717 AND
CHAPTER 17.65 OF THE LAKE ELSINORE MUNICIPAL
CODE, IN VARIOUS PARTICULARS, CONCERNING
PRIVATE ENCROACHMENT, VIOLATIONS, AND IMPO-
SITION OF FINES.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES ORDAIN
AS FOLLOWS:
SECTION ONE.
Those portions of Section Two of Ordinance No. 717 codified as Lake
Elsinore Municipal Code Sections 17.65.030 B, 17.65.115 A, and 17.65.115 B, and
Lake Elsinore Municipal Code Sections 17.65.030 B, 17.65.115 A and 17.65.115 B
are hereby amended to read, respectively, as follows:
Section 17.65.030 B:
"B. Private Encroachment - Private Encroachment shall include, but
not limited to, any and every person who willfully or negligently
commits a trespass by any of the following acts:"
Section 17.65.115 A:
"A. Littering - Any person found in violation of littering shall
be fined fifty dollars ($50.00) for the first offense, one hundred
dollars ($100.00) for the second offense, and each additional
offense may be treated and charged as either an infraction or a
misdemeanor as determined by the Court."
Section 17.65.115 B:
"B. Private Encroachment - Any person found in violation of private
encroachment shall be fined fifty dollars ($50.00) for the first
offense, one hundred dollars ($100.00) for the second offense, and
each addiitonal offense may be treated and charged as either an
infraction or a misdemeanor as determined by the Court."
SECTION TWO.
There is hereby added to Section Two of Ordinance No. 717 and codified
as Lake Elsinore Municipal Code Section 17.65.065 - Violations, which is to read
as follows:
"Section 17.65.065 - Violations
"It shall be unlawful to litter, commit private encroachment, illegally
park a vehicle, all as defined herein, or to utilize property in a
manner prohibited by Section 17.65.060. Violations of this Ordinance
shall be treated as an infraction offense for the first two (2)
of any such violations anal any subsequent .violation may be treated
and charged as either an infraction or a misdemeanor as determined
by the Court."
SECTION THREE.
This ordinance shall take effect as provided by law.

AN ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, AMENDING A PORTION OF ORDINANCE
N0. 268 AND LAKE ELSINORE MUNICIPAL CODE
SECTION 10.08.010 CONCERNING ENFORCEMENT -
GENERAL PROVISIONS.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIAN DOES ORDAIN
AS FOLLOWS:
SECTION ONE.
Article 2, Section 1, Subsection (a) of Ordinance No. 268 and Lake
Elsinore Municipal Code Section 10.08:010 are hereby amended to read as follows:
"It shall be the duty of the City's law enforcement agency including
Code Enforcement Officers to enforce the provisions of Chapters
10.04 through 10.28. Officers of the City's law enforcement agency
are hereby authorized to direct all traffic, either in person or by
means of visible or audible signal, and it shall be unlawful for any
person to refuse or fail to comply with any lawful order, signal, or
direction of a traffic sign or police officer, City law enforcement
officer, including Code Enforcement officer.
SECTION TWO.
This ordinance shall take effect as provided by law.

ORDINANCE N0. 737
AN ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, ADDING CHAPTER 13 TO TITLE 6
OF THE LAKE ELSINORE MUNICIPAL CODE, REGU-
LATING THE KEEPING OF BEES.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES
ORDAIN AS FOLLOWS:
SECTION ONE.
Due to a large concentration of bees, not properly maintained, there-
by creating stress to persons allergic to bee sting, limiting use of outdoor
activities of neighboring properties, and to protect the public safety, health
and welfare, there is hereby added to the Lake Elsinore Municipal Code, Chapter
6.13 Bee Keeping and the following Sections:
Section 6'.:13.010 - Purpose.
To regulate the keeping of bees to protect public safety, health and
welfare.
Section 6.13.020 - Permitted Use - Bee Keeping - Apiaries.
Not more than two (2) bee colonies or beehives, with no more than
two (2) supers or honey collecting cells per colony, shall be be permitted
provided the following conditions are met:
A. A hive or colony shall maintain a minimum distance of
fifty feet (50') from any neighboring property; and
B. Such hives or colonies shall be the property of, or maintained
by, the resident/owner of the property upon which the hives or
colonies are located; and
C. Adequate water supply shall be provided on-site at all
times; and
D. All hives or colonies are to be registered with the Riverside
County Agricultural Commissioner.
Section 6.13.030 - Exception.
Exceptions to Section 6.13.020 may be made by the granting of a
conditional use permit.
ection 6.13.040 - Violation--Penal
Any person violating any of the provisions of this chapter shall be

fine(s) established by a resolution of the City Council.

SECTION ONE:
Section 1 of Article IV of. Ordinance 301 and Section 10.16.030 of the
Lake Elsinore Municipal Code are hereby amended to read as follows:
"10.16.030 -.Two-hour time limit - Southerly side of East Graham
Avenue. The operator of a vehicle shall not park such vehicle,
nor shall the registered owner thereof permit the same to be parked
'for longer than two (2) hours between the hours of eight a.m. and
six p.m. of any day, except sundays and holidays, on the southerly
side of East Graham Avenue between Main Street and two hundred
fifty feet (250') easterly thereof."
SECTION TWO.
Section 5, subsection (a) of Article IV of Ordinance 268 and Section
10.16.020 of the Lake Elsinore Municipal Code are hereby amended to read as
follows:

AN URGENCY ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, ADDING CHAPTER 56 TO TITLE 8 OF THE LAKE
ELSINORE MUNICIPAL CODE PROHIBITING STORAGE OF
HAZARDOUS SUBSTANCES AND MATERIALS, AND THE PARKING
OF VEHICLES TRANSPORTING HAZARDOUS SUBSTANCES OR
MATERIALS, IN RESIDENTIAL NEIGHBORHOODS WITHIN THE
CITY OF LAKE ELSINORE.
I
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION ONE.
The following sections and subsections are hereby added to the Lake
Elsinore Municipal Code, Chapter 56, Title 8:
Section 8.56.010 - Definitions.
A. "Hazardous Substance and Material" shall be defined as any substance
or material which is toxic, corrosive, flammable, an irritant, a
strong sensitizer, which generates pressure through decomposition,
heat or other means, if such a substance or material may cause sub-
stantial personal injury, serious illness or harm to wildlife,
during, or as a proximate result of, any leakage or dispersal of
such substances or materials.

--~ tizer" shall be given the same meaning as in the California Haz-
ardous Substances Act, Chapter 13 (commencing with Section 28740)
of Division 21.
Section 8.56.020 - Unlawful Stora ec~.
A. No person, firm or corporation shall store, park, or leave un-
attended any vehicle containing hazardous substances, materials
or residuals within any residential neighborhood of the City of
Lake Elsinore as delineated on the City's General Plan.
B. No person, firm or corporation shall store any fifty (50) gallon
drums containing hazardous substances or materials within any
residential neighborhood in the City of Lake Elsinore as delineated
on the City's General Plan.
Section 8.56.030 - Unlawful Transportation.
J No person, firm or corporation shall transport any hazardous substances
or materials through any residential neighborhood within the City of
Lake Elsinore as delineated on the City's General Plan.
Section 8.56.040 - Enforcement.
It shall be the duty of all Peace Officers., Law Enforcement Officers
and Code Enforcement Officers to enforce the provisions of this chapter,
and unless otherwise .prohibited by law, shall be empowered to assure
compliance with all provisions herein and have the right to enter free
of charge, at any. time, upon any place or parcel of land, to investigate
and determine comp}fiance and/or to enforce and perform all the regula-
', tory provisions of this ordinance.
Section 8.56.050 - Violation--Penalty.
Any person, firm or corporation found to be in violation of any of the
provisions herein described shall be found guilty of an infraction, with
a penalty of $250.00 for the first offense; $500.00 fora second offense;
and $1,000.00 fora third offense.
SECTION TWO.
This ordinance shall take effect upon adoption.

The City Council of the City of Lake Elsinore,
California, does ordain as follows:
- SECTION ONE.
Ordinance No. 529, and Lake Elsinore Municipal
Code, Chapter 16, are hereby amended by adding Code Section
16.20.080 to read as follows:
MERGING OF CONTIGUOUS LOTS OR PARCELS
A. Notwithstanding other sections of Title 16,
four or fewer contiguous parcels under common ownership may
be merged without reverting to acreage, provided that the merger
is approved by the Director of Community Development and
an instrument evidencing such merger is recorded with the
County Recorder.
B. Applications to merge contiguous parcels shall
be made to the Director of Community Development on forms
provided by the Planning Department, and shall be accompanied
by the fee specified in Section 16.20.090 of this Ordinance,
and the following:
1. An exhibit, drawn to scale, delineating
the existing parcel boundaries and the
location of existing structures and
easements.
2. Copies of grant deeds for the existing
parcels.
3. An exhibit, drawn to scale, delineating
the boundaries of the parcel after the
merger.
4. A legal description of the new parcel
as merged.
5. Preliminary title report.
6. Written consent of all owners of record
interest.
C. The Director of Community Development shall
transmit a completed application to the City Engineer for
review and recommendation and shall grant approval of the
request for merger, if:
1. The parcels to be merged are, at the time
of merger, under common ownership and
written consent has been obtained from all
record owners.

2. The parcel as merged will be consistent
with the zoning of the property.
3. The parcel as merged will not conflict with
the location of any existing structures on
the property.
4. The parcel as merged will not be deprived

6. No new lot lines are created through the
merger.
D. The Director of Community Development shall sub-
mit to the County Recorder for recordation the new legal des-
cription and exhibit within 20 days after it has been approved
by the Director of Community Development.
SECTION TWO.
Ordinance No. 529 and Lake Elsinore Municipal Code,
Chapter 16, are hereby amended by adding Code Section 16.20.090
to read as follows:
A fee for the examination of lot merger application
shall be paid at the time of its filing to be deposited into
the general fund. The fee shall be in an amount as shown on
a schedule established by Resolution of the City Council and
shall be non-refundable.
SECTION THREE.
Notice to owners and opportunity for a hearing before
the Planning Commission shall be provided as specified in the
Subdivision Map Act. A determination of nonmerger may be made
by the City, whether or not the affected property meets the
standards for merger.
SECTION FOUR.
This Ordinance shall take effect as provided by law.

COMPREHENSIVE PLAN OF LITTER CONTROL AND
MAINTENANCE OF PUBLIC AND PRIVATE PROPERTY
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
CHAPTER 8.18
Chapter 818:O10t=:'Definitions: For the purpose of this
Chapter, the following definitions will apply:
A. "Litter" is any quantity of uncontainerized paper,
metal, plastic, glass or miscellaneous solid waste
which may be classed as trash, debris, rubbish,
refuse, garbage or junk.
B. "Public Property" includes, but is not limited to,
the following exterior locations: Streets, street
medians, roads, road medians, catch basins,
sidewalks, strips between streets and sidewalks,
lanes, alleys, public rights-of-way, public parking
lots, school grounds, municipal housing project
grounds, municipal vacant lots, parks, beaches,
playgrounds, other publicly-owned recreation
facilities, and municipal waterways and bodies of
water.
C. "Private Property" includes, but is not limited to,
the following exterior locations owned by private
individuals, firms, corporations, institutions or
organizations: Yards, grounds, driveways,
entranceways, passageways, parking areas, working
areas, storage areas, vacant lots and recreation
facilities.
D. "Containers" are locally-approved metal, heavy-duty
paper or plastic receptacles used for the disposal
and storage of solid waste.
8.18.020: It shall be unlawful for any person to throw,
discard, place or deposit litter in any manner or amount on any
public or private property within the corporate limits of the City
of Lake Elsinore, except in containers or areas lawfully provided
therefor.
8.18.030: In the prosecution charging a violation of
Section 8.18.020 from a motor vehicle, proof that the particular
vehicle described in the complaint was the origin of the litter,
together with proof that the defendant named in the complaint was
at the time of such violation the registered owner of said
vehicle, shall constitute in evidence a presumption that the
registered owner was the person who committed the violation.
8.18.040: It shall be the duty of every person
distributing commercial handbills, leaflets, flyers or any other
advertising and information material to take whatever measures
that may be necessary to keep such materials from littering public
or private property.
8.18.050: In the prosecution charging a violation of
Chapter 8.18.060, lack of adequate covering shall in itself
constitute proof a violation has been committed.
8.18.060: Any owner or occupant of an establishment or
institution at which litter is attendant to the packing and
unpacking and loading and unloading of materials at exterior
locations shall provide suitable containers there for the disposal
and storage of such litter and shall make appropriate arrangements
for the collection thereof.
8.18.070: Further, it shall be the duty of the owner or
occupant to remove at the end of each working day any litter that
has not been containerized at these locations.
8.18.080: It shall be unlawful for the owner, agent or
contractor in charge of any construction or demolition site to

cause, maintain, permit or allow to be caused, maintained or
permitted the accumulation of any litter on the site before,
during or after completion of the construction or demolition
project.
8.18.090: It shall be the duty of the owner, agent or
contractor to have on the site adequate containers for the
disposal of litter and to make appropriate arrangements for the
collection thereof, or for transport by himself, to an authorized
facility for final disposition.
8.18.100: The owner, agent or contractor may be required
at any time to show proof of appropriate collection, or if
transported by himself, of final disposition at any authorized
facility.
8.18.110: All residences located in any area in which
collection is by the City or approved contractors shall have
sufficient container capacity to accommodate their normal volume
of solid waste between collections.
8.18.120: All items too large to fit into containers,
such as, but not limited to, appliances, furniture and mattresses,
shall be disposed of by free or free-payment bulk collection
service, self-transport of such items to end-disposal facilities
or by collection for recycling.
8.18.130: Containers shall be kept covered at all times.
8.18.140: Any container which does not conform to the
prescribed standards or which has defects likely to hamper
collection or injure the person collecting the contents thereof or
the public generally shall be replaced promptly by the owner or
user of the container upon receipt of written notice of such
defects from the City or approved contractor. Failure to do so
within five (5) days of such notification shall constitute a
violation of this section.

8.18.150: It shall be unlawful for any resident to
deposit household solid waste in any receptacle maintained on a
sidewalk or at any other location for disposal of litter by
pedestrians.
8.18.160: Before building permits shall be issued for
construction of commercial buildings and multiple-dwelling units,
plans for the adequacy, location and accessibility of solid waste
containerization and storage facilities must be approved by the
City and the approved contractor.
8.18.170: No approval of occupancy shall be permitted
for said premises until approval, by the City, of these facilities
has been obtained.
8.18.180: It shall be the duty of the owner, agent,
occupant or lessee to keep exterior private property free of
litter. This requirement applies not only to removal of loose
litter, but to materials that already are, or become, trapped at
such locations as fence and wall bases, grassy and planted areas,
borders, embankments and other lodging points.
8.18.190: Owners, agents, occupants or lessees whose
properties face on municipal sidewalks and parkways shall be
responsible for keeping those sidewalks, parkways and alleys free
of litter.
8.18.200: It shall be unlawful to sweep or push litter
from sidewalks and parkways into streets. Sidewalk and parkway
sweeping must be picked up and put into household or commercial
solid waste containers.
8.18.210: It shall be unlawful for any person owning,
leasing, occupying or having charge or possession of any premises.
in this City to maintain such premises in such manner that any of
the following conditions are found to exist thereon:

j ~ (1) Buildings which are abandoned, boarded up, partially
destroyed, or left in a state of partial

construction for a period of time in excess of 12
months;
(2) Unpainted buildings causing dry rot, warping and
termite infestation;
(3) Broken windows constituting hazardous conditions and
inviting trespassers and malicious mischief;
(4) Overgrown vegetation causing detriment to
neighboring properties;
(5) Dead trees, weeds and debris:
(a) Constituting unsightly appearance, or
(b) Dangerous to public safety and welfare;
(6) Inoperable or abandoned motor vehicles stored on the
premises visible from ground level from the public
street or neighboring properties. All of the
provisions of Sections 22660 through 22671 of the
California Vehicle Code are hereby adopted by
reference as a part of this Ordinance and provisions
of Section 22660 through 22671, the provisions of
Sections 22660 through 22671 shall prevail;
(7) Attractive nuisances dangerous to children in the
form of:
(a) Abandoned and broken equipment,
(b) Hazardous pools, ponds and excavations, and
(c) Neglected machinery;
(8) Broken or discarded furniture and household
equipment in yard area;
(9) Clothes lines in front yard areas;
(10) Garbage cans stored in front or side yards and
visible from public streets;
(11) Packing boxes and other debris stored in yards and
`~ visible from public streets for unreasonable periods;
(12) Neglect of premises causing a detrimental affect
upon the enjoyment or use of neighboring property;

(13) Maintenance of premises in such condition as to be
detrimental to the public health, safety or general
welfare or in such manner as to constitute a public
nuisance as defined by Civil Code Section 3480;
(14) Property including but not limited to building

exteriors which are maintained in such condition as
- to become so defective, unsightly, or in such
condition of deterioration of disrepair that the
same causes depreciable diminution of the property
values of surrounding property or is materially
detrimental to proximal properties and
improvements. This includes but is not limited to
the keeping or disposing of or the scattering over
the property or premises of any of the following:
(a) lumber, junk, trash or debris,
(b) abandoned, discarded or unused items of
equipment such as furniture, stoves
refrigerators, freezers, cans or containers,
c
(c) stagnant water, or excavations,
(d) any device, decoration, design, fence,
structure, clothes line or vegetation which is
unsightly by reason of its condition or its
inappropriate location;
(15) Maintenance of premises so out of harmony or
conformity with the maintenance standards of
adjacent properties as to cause substantial
diminution of the enjoyment, use, or property values
of such adjacent properties.
' 8.18.220: The City Code Enforcement Officer and the
Riverside County Sheriff's Department are jointly empowered to
~' enforce the provisions of this ordinance.
8.18.230: Any person, firm, or corporation violating any
provision of this Ordinance shall be guilty of an infraction.

Penalties shall be those specified from time to time by resolution
of the City Council of the City of Lake Elsinore.
8.18.240: Payment of any penalty herein provided shall
not relieve a person, firm or corporation from the responsibility
of correcting the condition consisting of the violation.
8.18.250: Zf any provision of this Ordinance, or any
section thereof, in any circumstances is held invalid, the
validity of the remainder of the Ordinance and the application of
any of the other provisions or sections shall not be affected.

THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES ORDAIN
AS FOLLOWS:
SECTION ONE.
Section 2 of Ordinance No. 539 and Section 2.24.020 of the Lake Elsinore
Municipal Code are hereby amended to read as follows:
"SECTION 2.24.020 - Membership
"The Planning Commission shall consist of five members who shall not be
officials or employees of the City and shall legally reside within the
City limits of the City of Lake Elsinore or be the owner of a business
that is established and currently licensed inside the City limits."
SECTION TWO.
This ordinance shall not affect members of the existing Planning Commission
but shall affect present members upon completion of current terms of office.
SECTION THREE.
This ordinance shall take effect as provided by law.

SECTION ONE.
There is hereby added to Chapter 16 of Title 10 of the Lake Elsinore
Municipal Code anew section designated as Section 10.16.160 to read as follows:

"VI. CITY EMPLOYEE PARKING FACILITY -
WESTERLY OF THE INTERSECTION OF MAIN .STREET AND SULPHUR STREET
"Section 10.16.160 - City employee parking facility.
"A. Any person permanently or temporarily employed by the City of Lake
Elsinore may park their mode of transportation to work within the
set perimeters of the City parking area so designated to be one
hundred feet (100') westerly of the intersection of Main Street
and Sulphur. Said vehicles may be parked within this lot for a
period not to exceed a twenty-four hour employment period on a
Monday through Friday calendar day basis.
"B. No said vehicle owned or operated by any City employee shall be
parked within the designated facility longer than a forty-eight
(48) hour work period beginning at 8:00 a.m, and ending at 5:00
p.m. on weekdays inclusively. All overnight parking will be pro-
hibited on weekends and holidays.
"C. The City does hereby restrict the type, class and weight of all
vehicles .parked within the subject parking facility to the
recognized State of California Motor Vehicles registration
entitlement of Class 3. This facility shall not permit the
parking of boats, motorhomes, trailers, nor trucks over one-ton
capacity on the premises.
"D. The City will not be held responsible, nor deemed liable, for any
personal or vehicle accidents, injuries, vandalism, theft, and
general conflicts resulting from the normal use of this facility
during any time period that the lot is accessible by the public
or City employees."
E. No non-City employee shall park in City employee designated
parking space(s)."

This ordinance shall take effect as provided by law.

ADDING CHAPTER 50, ADOPTING THE 1984 EDITION OF THE
STATE OF CALIFORNIA VEHICLE CODE, AND CHAPTER 60, REGU-

ZONES, TO THE LAKE ELSINORE MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION ONE.
The following sections are hereby added to the Lake Elsinore Municipal
Code, Chapter 50 and Chapter 60, respectively, of Title 10:
"Section 10.50.010 - Adapted--Filing.
"The City Council adoptes all of the California Vehicle Code, 1984
Edition, three (3) copies of which are certified as true copies and
are on file in the office of the City Clerk and which said standards
and specifications are adopted by reference and made a part of this
Code as though set forth at length in the ordinance codified herein."
"Section 10.60.010 - Parking violations in commercial zones for vehicle
sell purposes.
"The parking of motor vehicles, trailers, boats or other stationary
and non-stationary vehicles, as defined by the State of California
Vehicle Code, within commercially zoned parcel(s) or public right(s)-
of way within the corporate City limits, which has have) not been
approved nor authorized as an approved sales lot for vehicle sell
purposes shall be prohibited.
"Section 10.60.020 - Permitted vehicle sell purposes.
"All motor vehicles, trailers, boats or other stationary and non-
stationary vehicles, as defined by the State of California Vehicle
Code, offered for sale shall only be located within an approved
commercially zoned car lot, unless otherwise noted by this Code or
' a more restrictive Code or ordinance that regulates such uses.
"Section 10.60.030 - Penalty and fee.
"Any person, firm, or corporation violating Sections 10.60.010 and/
or 10.60.020 shall be guilty of an infraction and upon citation shall
be subject to a fine in the amount of fifteen dollars ($15.00}.
"Section 10.60.040 - Enforcement.
"The City Code Enforcement Officers and the Riverside County Sheriff's
Department are jointly empowered to enforce the provisions of
Sections 10.60.010 through 10.60.030."
SECTION TWO.
This ordinance shall take effect as provided by law.

eighteen months."

At the conclusion of eighteen months, from the
effective date of this Ordinance, City Council
will review this ordinance and make final deter-
mination regarding the Design Review Board.
SECTION THREE.

ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE ESTABLISHING EMERGENCY
RULES AND REGULATIONS RELATING TO THE USE
OF CERTAIN PORTIONS OF LAKE ELSINORE
WHEREAS, the City of Lake Elsinore is authorized by law
to adopt measures governing the use and equipment, and matters
relating thereto, of boats and vessels on Lake Elsinore; and
WHEREAS, the water level of Lake Elsinore has decreased
to a point that the continued operation of boats and vessels on
certain portions of the Lake are no longer safe and constitute a
hazard to the general health, safety and welfare of persons
utilizing those areas of Lake Elsinore; and
WHEREAS, those areas of Lake Elsinore described above are
attached to and made a part of this resolution as Exhibit "A"; and;
WHEREAS, the City of Lake Elsinore is authorized by
Harbors and Navigations Code Section 660 to adopt emergency rules
and regulations required to insure the safety of persons and
property.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Lake Elsinore as follows:
1. That the above recitals are true and correct.
2. It shall be unlawful to operate a boat or vessel
within the territory described as Exhibit "A" to this Ordinance.
3. Appropriate markings designating said area of non-use
shall be placed in a manner to adequately provide notice of said
area of non-use.
4. This Ordinance shall be effective immediately and shall remain
in effect for sixty (60) days after adoption.
5. First offense would be deemed an infraction, subject to a
sixty-five dollar ($65.00) fine; second offense would be deemed a misde-
meanor.
6. Any property owner subject to the exception in Exhibit A,
attached hereto, would be required to mark his private property by posting
said property with blue and white buoys.

COUNTY, CALIFORNIA, AMENDING'ORDINANCE
N0. 268, BY ADDING THE PRIMA FACIE SPEED
LIMIT ON COLLIER AVENUE, CORYDON STREET,
GRAND AVENUE, LAKESHORE DRIVE AND MISSION
TRAIL AND DECLARING THE URGENCY THEREFORE
BE IT ORDAINED by the City Council of the City
of Lake Elsinore as follows:
SECTION ONE:
Section I of Article VII of Ordinance No. 400,
amended Ordinance No. 268, and Lake Elsinore Municipal
Code, Chapter 10.24, are hereby amended by adding there-
to the following:
"Collier Avenue from Central Street to Minthorn
Street, in the City of Lake Elsinore, the prima facie
speed limit is 45 miles per hour."
"Corydon Street from Mission Trail to Palomar Street,
in the City of Lake Elsinore, the prima facie speed limit
is 45 miles per hour."
"Grand Avenue from Bonnie Lea Drive to Riverside Drive,
in the City of Lake Elsinore, the prima facie speed limit
is 40 miles per hour."
"Grand Avenue from Riverside Drive to Machado Street,
in the City of Lake Elsinore, the prima facie speed limit
is 35 miles per hour."
"Lakeshore Drive from Robb Road to Machado Street, in
the City of Lake Elsinore, the prima facie speed limit is
45 miles per hour."
"Lakeshore Drive from Machado Street to Riverside Drive,
in the City of Lake Elsinore, the prima facie speed limit
is 40 miles per hour."
"Lakeshore Drive from Riverside Drive to Manning
Street, in the City of Lake Elsinore, the prima facie
speed limit is 35 miles per hour."
"Lakeshore Drive from Manning Street to Wilson Street,
in the City of Lake Elsinore, the prima facie speed limit
is 45 miles per hour."
"Lakeshore Drive from Wilson Street to Graham Avenue,
in the City of Lake Elsinore, the prima facie speed limit
is 35 miles per hour."
"Lakeshore Drive from Graham Avenue to Main Street,
in the City o£ Lake Elsinore, the prima facie speed
limit is 25 miles per hour."
"Lakeshore Drive (Railroad Avenue) £rom Main Street
to Railroad Canyon Road, in the City of Lake Elsinore,
the prima facie speed limit is 35 miles per hour."
"Mission Trail from Railroad Canyon Road to Sedco
Blvd, in the City of Lake Elsinore, the prima facie
speed limit is 40 miles per hour."
"Mission Trail from Sedco Blvd. to Corydon Street,
in the City of Lake Elsinore, the prima facie speed
limit is 45 miles per hour."
SECTION TWO:
Urgency. This urgency Ordinance is deemed necessary
to protect the health, safety and welfare of the residents
of the City of Lake Elsinore.
SECTION THREE:
Effective Date. This Ordinance shall become effective
upon its adoption.

ORDINANCE N0. 753
AN ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, REGULATING THE USE OF CERTAIN
PORTIONS OF LAKE ELSINORE.
WHEREAS, the City of Lake Elsinore is authorized by law to adopt
measures governing the use and equipment, and matters relating thereto, of
boats and vessels on Lake Elsinore; and
WHEREAS, there are certain portions of Lake Elsinore within which
submerged obstacles exist; and
WHEREAS, there obstacles constitute a hazard to the general health,
safety and welfare of persons utilizing those portions of Lake Elsinore; and
WHEREAS, the City of Lake Elsinore is desirous of protecting the
public from those submerged hazards.
NOW, THEREFORE, the City Council of the City of Lake Elsinore does hereby
ordain as follows:
`, SECTION ONE.
The above recitals are true and correct.
SECTION TWO:
The area that this ordinance shall regulate is as follows:
All properties at or below the elevational mark of 1265'
mean sea level southeasterly of the State Recreational
Area Boundary (1240' MSL) and within the perimeter streets
of Lakeshore Drive to the north, Mission Trail to the
northeast, Corydon Road to the southeast and the City
Boundary Line to the south and southwest.
Excepting therefrom any property within the described area
above, that has a valid existing Conditional Use Permit or
City Business License, as .long as said property owner stays
on his own property and maintains same in a safe manner.
SECTION THREE:
It shall be unlawful to operate a boat or vessel within the territory
described in Section. Two.
SECTION FOUR:
Appropriate markings designating said area of non-use shall be placed
in a manner to adequately provide notice of said area of non-use.
SECTION FIVE:
First offense shall be deemed an infraction, subject to a sixty-five
dollar ($65.00) fine; second offense shall be deemed a misdemeanor.
SECTION SIX:
Any property owner subject to the exception in Section Two shall be
required to mark his private property by posting said property with blue and
white buoys.
SECTION SEVEN:
This ordinance shall take effect as provided by law.

ORDINANCE N0. 755
AN URGENCY ORDINANCE OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, REGULATING THE LOCATION AND ESTABLISH-
MENT OF ADULT BUSINESSES
WHEREAS, adult businesses may have certain adverse impacts on
properties adjoining them;
WHEREAS, the location and proliferation of adult businesses
within certain areas of the City may result in a general reluctance to invest
in those areas; and
WHEREAS, the inappropriate location of adult businesses may have
a negative impact on certain segments of the community.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION ONE.
The above recitals are true and correct.
SECTION TWO.
"Adult Business" shall mean any massage parlor, motel, studio,
bookstore, theater, cabaret, or sexual encounter center which is not customarily
open to the general public under the age of eighteen (18) as a prevailing
business practice, due to the nature and explicitness of sex related subject
matter..
SECTION THREE.
Uses classified as adult businesses shall not be permitted within
the City's Central Business District as herein defined:
On the east and west sides of Main Street between Lakeshore
Drive to the south and the Interstate 15 Freeway to the north
and along the north and south sides of Graham Avenue between
Main Street to the east and Chaney Street to the west.
SECTION FOUR.
Uses classified as adult businesses may be permitted in the C-2
(General Commercial) and CM (Commercial Manufacturing) Zoning Districts out-
side the Central Business District, subject to obtaining a Conditional Use
Permit and meeting the following requirements:
1. No adult businesses shall locate within five hundred feet (500')
of the boundary of a residential district as shown on official
City maps, or within five hundred feet (500') of any residential
use.
2. No adult businesses shall locate within one thousand feet (1,000")
of any other adult business.
3. No adult businesses shall locate within one thousand feet (1,000')
of any public or private school, park, playground, civic or
cultural building, church. or beach.
4. All development standards of the base district shall be applied.
5. The interior of any bookstore shall be adequately lighted and
constructed so that every portion thereof is readily visible
to the clerk ar other supervisory personnel from the counter
or other regular station.
6. Lobby and entrance areas shall be designed so as to minimize
obstruction of sidewalks during operating hours.
7. Advertisement, displays, or other promotional materials shall
not 6e shown or exhibited so as to be visible to the public, from
pedestrian sidewalks or walkways, or from other areas public or
semi-public; and such displays shall be considered signs.
8. All-signage, window and other, shall be approved by the Planning
Division.
SECTION FIUE.
If any provision or clause of this ordinance or the application
thereof to any person or circumstances is held to be unconstitutional or other-
wise invalid by any court of competent jurisdiction, such invalidity shall not
affect other provisions or clauses or applications of this ordinance which can
be implemented without the invalid provision, clause or application; and to
this end, the provisions of this ordinance are declared to be severable.
SECTION SIX.
This ordinance shall be effective immediately and shall remain
in effect for sixty (60) days after adoption.
