Tim spoke with Wayne in regards to COA 109. From what I’m told all items are addressed in his soil

Almost everything in the COA is generic, with very limited project-specific comments
For OA: Condition 35: Will there be any problem with meeting the requirement for 10% voluntary
green measures?
Storm water drainage: The document makes no mention of the offsite drainage situation. The
project is receiving storm flows from I-15 and El Toro Road, capturing the flows into the large box
culvert along the NW property line as shown on the grading and storm drain plans, and discharging
thru a new properly-sized culvert across Collier into the vacant Blue Sky property SW of Collier. In
previous internal discussions we have agreed that:
1. The City should bear some responsibility for the large on-site box culvert.
2. At the very least, the box culvert should become a publicly-maintained facility in an easement
dedicated on the parcel map.
3. The City should be responsible for the outfall
a. At a minimum secure the missing easement that was shown on the 1991 Webb plans
for Collier
b. Should they purchase the Blue Sky property (recently shown to be in tax-defaulted
condition) and make it into a water quality basin, thus significantly reducing the
project’s on-site cost of construction.
Condition 100 could be a concern re: installing storm drain filters on “all new storm drain inlet
facilities. . .” Does this include the massive inlet in El Toro road and the trap channel from the east on
Collier?
Condition 109 contains some very specific seismic study requirements that should be addressed by
EnGEN, to be sure that the scope of their current study will be sufficient. We will forward the draft
COA’s to EnGEN.
Condition 112 will be met once we have answers from the City regarding the drainage matter
discussed above.
I know we have previously conveyed our concern for the long-term maintenance of Grove 142, along
the east property line; it may not be mentioned in the COA’s, but there certainly should be some sort
of documentary agreement between the project’s POA and the City or it’s going to be an on-going
eyesore.
For Mark and Tim: Condition 142 speaks to the required annexation to Elsinore’s CFD for
maintenance of the offsite landscaping (center median in Collier, street lighting on both streets). The
annexation is done by a City consultant, Shane Spicer, Spicer Consulting Group, who collects a non-
refundable deposit of $15K, prior to recording of the final map. Larry may have some thoughts on
this; I’ve always felt that Spicer has a niche that is only marginally justified, but I don’t expect there’s
much that can be done other than writing the check. Perhaps an argument can be made to roll the
Grove 142 matter into the CFD?
Vince, I’ll send the COA’s to you separately. Can you please let us know ASAP of any concerns you
may have concerning the landscape conditions.
