No. 1984-s. 688-732ORDINANCE N0. 688 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, TO AMEND ORDINANCE N0. 527 AND LAKE ELSINORE MUNICIPAL CODE SECTION 3.20.130 IMPOSING A SALES AND USE TAX TO BE ADMINISTERED BY THE STATE BOARD OF EQUALIZATION THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION ONE. Section 13 of Ordinance No. 527 and Lake Elsinore Municipal Code Section 3.20.130 are amended to read as follows: 3.20.130 EXCLUSIONS AND EXEMPTIONS. (a) The amount subject to tax shall not include any sales or use tax imposed by the State of California upon a retailer or consumer. (b) The storage, use, or other consumption of tangible personal property, the gross receipts from the sale of which have been subject to tax under a sales and use tax ordinance enacted in accordance with Part 1.5 of Division 2 of the Revenue and Taxation Code by any city and county, county, or city, in this state shall be exempt from the tax due under this Ordinance. (c) There are exempted from the computation of the amount of the sales tax the gross receipts from the sale of tangible personal property to operators of aircraft to be used or consumed principally outside the city in which the sale is made and directly and exclusively in the use of such aircraft as common carriers of persons or property under the authority of the laws of this state, the United States, or any foreign government. (d) In addition to the exemptions provided in Sections '. 6366 and 6366.1 of the Revenue and Taxation Code the storage, use, or other consumption of tangible personal property purchased by operators of aircraft and used or consumed by such operators directly and exclusively in the use of such aircraft as common carriers of persons or property for hire or compensation under a certificate of public convenience and necessity issued pursuant to the laws of this state, the United States, or any foreign government is exempted from the use tax. ' SECTION TWO. Section 13 of Ordinance No. 527 and Lake Elsinore Municipal Code Section 3.20.130 as amended by Section 1 of this Ordinance are hereby further amended to read as follows: 3.20.130 EXCLUSIONS AND EXEMPTIONS. SECTION THREE. Section One of this Ordinance shall be operative nunc pro tunc as of January 1, 1984. SECTION FOUR. Section Two of this Ordinance shall be operative on the operative date of any act of the Legislature of the State of California which amends Section 7202 of the Revenue and Taxation Code or which repeals and reenacts Section 7202 of the Revenue and Taxation Code to provide an exemption from city sales and use taxes for operators of waterborne vessels in the same, or substantially the same, language as that existing in subdivisions (i)(7) and (i)(8) of Section 7202 as those subdivisions read on October 1, 1983. SECTION FIVE. This Ordinance relates to taxes for the usual and current expenses of the City and shall take effect immediately upon adoption. -3- SECTION SIX.. This Ordinance is enacted pursuant to Government Code Section 36937 (b) as an Urgency Ordinance for the immediate preservation of the public peace, health or safety upon four-fifths vote of the City Council in order to ensure timely compliance with ~ ~ provisions of the Bradley-Burns Uniform Local Sales and Use Tax Law operative January 1, 1984, relating to operators of waterborne vessels and to avoid the potential loss of revenue which would adversely effect the preservation of the public peace, health and safety. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION ONE: Section Ten of Ordinance No. 657 and Lake Elsinore Municipal Code Section 5.08.200 are amended to read as follows: "For failure to pay a business license fee when due, the City shall add the following penalties: !'A. Ten percent of the business license fee on the fifteenth day of the month following the due date; twenty-five percent on the fifteenth day of the second month following the due date; and fifty percent on the fifteenth day of the third month after the due date thereof; provided that the amount of such penalties to be added shall in no event exceed fifty percent of the amount of the business license fee due." SECTION TWO: Section Twelve of Ordinance No. 657 and Lake Elsinore Municipal Code Section 5.08.230(6) are amended to read'.as fo1lows:` "B. If an applicant for an annual business license intends to conduct - a business for six months or less, said applicant may be granted a business license for six months or a fraction thereof to be determined by the City Manager or his designee on a case-by-case basis." SECTION THREE: Section Thirteen of Ordinance No. 657 and Lake Elsinore Municipal Code Section 5.16.020(6) and ~(C) are amended to read as follows: "B. Deleted." "C. At any time, the City Council may by resolution increase or decrease the business license fees, however, the fees shall be established at the November 9, 1982 fee schedule." SECTION FOUR: This ordinance shall take effect as provided by law. "Alarm Agent" shall mean any person who is self-employed or employed either directly or indirectly by an alarm business whose duties include any of the following: selling, maintaining, leasing, servicing, repairing, altering, replacing, moving, or installing an alarm system in or on any building, place or premises. f. "Alarm User" shall mean any person using an alarm system at his place of business. g. "Person" shall mean any individual, partnership, corporation, or other entity. h. "Sheriff" shall mean the Sheriff of the County of Riverside, his deputies, and designated employees. i. "Non-Priority" shall mean that law enforcement response to the activation of an alarm will not be given precedence over any other calls and will be predicated upon availability of law enforcement personnel and other service needs. CHAPTER 9.30.020 The provisions of this ordinance are not applicable to audible alarms affixed to motor vehicles, unless the vehicle alarm is connected to a central monitoring system. CHAPTER 9.30.030 It shall be unlawful for any person, partnership, corporation, or firm to own, manage, conduct or carry on the business of selling, leasing, installing, servicing, maintaining, repairing, replacing, moving, removing, or monitoring an alarm system in or on any building, place, or premises within the City of Lake Elsinore without first having registered with the Sheriff. Such registration shall not be required for any business which only sells said alarm systems from a fixed location unless such business services, installs, monitors or responds to alarm systems at the protected premises. Registration shall be accomplished by furnishing such information as may be required by the Sheriff, including but not limited to the full name of the business, the number of the license issued by the State Director of Consumer Affairs for the alarm business, and the name and business address of the manager of operations for the area which includes the City of Lake Elsinore. CHAPTER 9.30.040. It shall be unlawful for any person, including the owners of an alarm business, to engage directly in the selling, leasing, maintaining, servicing, repairing, altering, replacing, moving, or installing of an alarm system in or on any building, place, or premises within the City of Lake. Elsinore -2- without first having registered his name and filed with the Sheriff a copy of the alarm agent registration card issued to him by the State Director of Consumer Affairs pursuant to the provisions of Section 7514(g) of the California Business and Professions Code. Nothing herein shall require a person to so register who is merely a salesman for any business not required to obtain an alarm business permit under the provisions of Section 3, if such salesman is engaged in sales of alarm systems only. CHAPTER 9.30.050. Any alarm business registered with the Sheriff shall, within 5 days, report address or ownership of the business address of the manager of operations the City of Lake Elsinore. Any person as an alarm agent shall, within 5 da change of business address. to the Sheriff any change of or the name or business for the area which includes registered with the Sheriff ~s report to the Sheriff any CHAPTER 9.30.060. No person shall install, or cause to be installed, use, maintain or possess an alarm system on premises owned by or in the possession of or in control of such persons within the City of Lake Elsinore without first having obtained an Alarm User's Permit from the Department of Building and Safety of the City of Lake Elsinore, in accordance with this chapter. The application for an Alarm User's Permit shall be submitted on a form as prescribed by the Director, Department of Building and Safety and shall include the address of the premises wherein the system is to be located and the name, address and telephone number of the applicant, type or purpose of alarm, and the person who will render service or repairs during any hour of the day or night. The permit fee shall be determined by the Director, Department of Building and Safety. The permit shall be denied by the Director, Department of Building and Safety if the alarm system does not comply with the standards and regulations adopted pursuant to Section 7. CHAPTER 9.30.070. All alarm systems sold for installa- tion or installed in any place of business within the City of Lake Elsinore shall utilize approved Underwriter's Laboratories rated protection equipment. All electrical installations shall be in -3- accordance with applicable requirements of the Cit,Y of Lake. Elsinore Building Code and all necessary permits shall be obtained therefor. CHAPTER 9.30.080. Following law enforcement response to the activation of an alarm which investigation determines to be false and notification of said fact by the Sheriff, the alarm user shall file written report with the Sheriff within 72 hours upon notice to do so from the Sheriff. Such report shall contain all information pertaining to the activation of said alarm, any planned corrective action and projected date of correction. Where the alarm system is serviced by an alarm business, the report shall be made by such business and a copy forwarded to the alarm user by the alarm business. The investigation of any false alarm by any person other than members of the Sheriff's Department shall also result in the notification to the alarm user that such an incident. occurred and shall not relieve the alarm user or alarm business of the formal report responsibility provided for in this chapter. CHAPTER 9.30.090. Every place of business maintaining an alarm system shall either post or file with the Sheriff a notice containing the names and telephone numbers of the persons to be notified in case of emergency or alarm activation or to render service to the system during any hour of the day or night. The persons named shall include the occupant of the premises, or the alarm business or agents responsible for the maintenance of the system. If posted, such notice shall be placed near the front door of the structure containing the alarm system or at the front gate if the structure is fenced; said notice shall be posted in such a position as to be clearly legible from the ground level adjacent to the structure or fence. It shall be the duty of the alarm user to maintain current such notice whether posted or filed with the Sheriff. If service is unavailable, audible alarms which have emitted an alarm in excess of 30 minutes are hereby declared to be nuisances, and the Sheriff may cause such alarm to be disconnected -4- by a registered alarm agent, with the cost therefor to be a charge payable by the alarm user. CHAPTER 9.30.100. Every alarm business which monitors an alarm system located within the City of Lake Elsinore shall maintain on file a current listing of all such alarm systems including the name, address and telephone number of the individual or individuals from whom entry to the premises may be obtained. said information shall be available to the Sheriff upon request of any authorized representative thereof. CHAPTER 9.30.110. Every person engaged in installing, repairing, servicing, altering, replacing, moving or removing an alarm system as defined herein on any place of business within the City of Lake Elsinore, other than those owned or occupied by said person, shall carry on his person at all times while so engaged, a valid State of California Agents Registra- tion Card and shall display such to any Peace Officer or Code Enforcement Officer upon request. CHAPTER 9.30.120. No person shall use or cause to be used any telephone device or telephone attachment that automat- ically selects a public telephone trunk line to the Sheriff's Department and then reproduces any pre-recorded message to report any unlawful act or emergency. CHAPTER 9.30.130. The Sheriff may designate an alarm system at a specific location as a nuisance if such alarm system actuates excessive false alarms. It is hereby determined that four (4) false burglar alarms within any three (3) consecutive calendar month period or two (2) false robbery alarms within any three (3) consecutive calendar month period is excessive and thereby constitutes a public nuisance. The Sheriff shall not consider any false alarm in his computation of nuisance alarms if such false alarm was generated by natural disaster, and not the result of the negligence of the alarm user, his agents or employees or a defect in the alarm system. The Sheriff shall suspend the permit of an alarm user whose alarm has been so designated a nuisance. The Sheriff shall serve the permittee with a written order of suspension, which shall state the reason for such suspension. The said order shall be effective immediately if personally served, or 48 hours after the same has been deposited with postage prepaid in the United States Mail. - 5 - Immediately upon such an order of suspension becoming effective, the alarm system shall receive non-priority response from the Sheriff's Department. The suspension of the alarm user's permit shall become a revocation fifteen (15) days after the order of suspension becomes effective unless the permittee presents to the Sheriff written verification that the system has been completely evaluated and the problem located and corrected, and the documentation exists that the alarm system of the alarm user falls within the acceptable alarm activation limit set forth in this chapter. Notice of revocation shall be served by personal service or by certified mail. If an alarm user's permit is revoked pursuant to this chapter, the permittee shall surrender said permit to the Sheriff. CHAPTER 9.30.140. Violation of this ordinance is an infraction and is punishable by a fine of not more than five hundred dollars ($500.00). Revocation of a permit shall not be a defense against prosecution. The conviction or punishment of any person for violation of the provisions of this ordinance or for failing to secure a permit as required by this ordinance shall not relieve such person from paying the permit fee due and unpaid at the time of such conviction, nor shall payment of any permit fee prevent criminal prosecution for violation of any of the provisions of this chapter. All remedies shall be cumulative and the use of one or more remedies by the County or by the City of Lake Elsinore shall not bar the use of any other remedy for the purpose of enforcing the provisions of this ordinance. The amount of the permit fee shall be deemed a debt to the City of Lake Elsinore. An action may be commenced in the name of the City of Lake Elsinore, in any court of competent jurisdiction for the amount of any delinquent permit fee. All permit fees shall be deemed delinquent thirty (30) days after they are due and payable. -6- CHAPTER 9.30.150. If any chapter, subchapter, sentence, clause, or phrase of this ordinance as herein enacted or the application thereof to any person or circumstances is held invalid or unconstitutional by decision of any court of competent jurisdiction, such invalidity shall not affect the other provisions or applications of this ordinance, or any chapter or portion of chapter hereof, which can be given effect without the invalid provisions or application and of this chapter are, and are intended Council hereby declares that it would and each chapter, subchapter, clause, irrespective of the fact that any one subchapters, clauses or phrases may b unconstitutional. to this end the provisions to be, severable. The City have passed this ordinance or phrase thereof or more other chapters, __ declared invalid or CHAPTER 9.30.160. The provisions of this ordinance and the requirements therein shall become operative ninety (90) days after the effective date of this ordinance for those persons conducting an alarm business or engaged as an alarm agent within the City of Lake Elsinore on such effective date; provided, however, the aforementioned persons who have filed an application as required herein for an alarm business permit may continue doing business after such operative date until such application has been processed. All persons not conducting an alarm business or engaged as an alarm agent within the City of Lake Elsinore on the effective date of this ordinance shall not commence such operation until the necessary alarm business permit required by this ordinance has been issued or the registration required by this ordinance for an alarm agent has been completed. The provisions of this ordinance relating to the alarm users permit shall become operative one hundred twenty (120) days after the effective date of this ordinance for those persons using, maintaining, or possessing an alarm system on premises owned or in the possession or control of such person within the City of Lake Elsinore if said system was installed or in operation prior to the effective date of this ordinance. Any person -7- installing, or causing to be installed an alarm system on premises owned or in possession or control of such person within the City of Lake Elsinore on or after the effective date of this ordinance shall not commence such installation until the necessary alarm users permit required by this ordinance has been issued. CHAPTER 9.30.170. This Ordinance shall become effective thirty (30) days after its adoption. CHAPTER 9.30.180. This ordinance shall take effect as provided by law. Any parcel in the Lakeshore Over- lay District may be occupied by a principal use listed in Section 17.65.040, or, when authorized by the City Council, by a Conditional Use listed in Section 17.65. 050. An additional purpose of the Lakeshore Overlay District is to implement the relevant General Plan Programs and give enforcement of violators thereof as herein defined. Section 17.65.020 - Lake Shoreline Area Defined The Lakeshore Overlay District shall apply to the lake shoreline area defined as extending from Lakeshore Drive right-of-way southwesterly to the State Park ownership boundary or elevation 1240' MSL and from Main Street northwesterly to Iowa Street, a distance of approximately 3.45 miles. Section 17.65.030 - Definitions For the purpose of this title, certain words and terms are defined as set out in this chapter. A. Littering - Litter shall include, but not limited to, willful or negligent throwing, dropping, placing, depositing, or sweeping, or causing any such acts, of any waste matter or materials on any land or water in other than specified approved storage/waste containers, as so designated. B. Trespassing - Trespassing shall include, but not limited to, any and every person who willfully or negligently commits a trespass by any of the following acts: 9 1. Enters upon any private land, owned by any other person; 2. Any person entering upon any private land, not owned by that person; 3. Entering upon any land, owned by another or not by that person, whether posted or not by any person; and _ 4. Entering upon ,any land, owned by another or not by that person, posted or not, whether unenclosed or enclosed by prohibitive/ restrictive entrance, by any person. C. Illegal Parking of Vehicle - "Vehicle" shall be defined as outlined within the State of California Vehicle Code. Illegal Parking shall include, but not limited to, any person(s) in control of a vehicle, who willfully or negligently commits a parking violation by any of the following acts: 1. A vehicle which has entered upon/in or onto any private land, owned by another or not owned by that person, posted or not, whether unenclosed or enclosed by prohibitive/restricted entrance; 2. A vehicle, which has entered upon/in/along or onto any public lands, streets or right-of-way, that is posted in vergiage, stating, "No Parking, Stopping or Standing - Tow Away Zone," or as prescribed by law, including State Highways. Section 17.65.040 - Permitted Uses Uses permitted in the Lakeshore Overlay District shall be as follows: A. Floats and dolphins for private pleasure craft; boating marinas and fishing facilities; boat rentals. B. Boating, at designated locations. C. Swimming, at designated locations. D. Fishing, at designated locations. E. Publicly owned park, when in conformance with the Lake Elsinore General Plan. F. Existing occupied single-family residences and existing operated businesses. G. Jet ski rentals. H. Piers and docks for private pleasure craft. I. Restaurant, but excluding: 1. Establishments serving customers within their automobiles on -2- the premises or preparing food/drink for consumption off of, or drive-away/through the premises; and 2. Establishments primarily preparing food/drinks intended for consumption off the premises. J. Overnight camping is limited to authorized/established State/private facility, per City Ordinances No. 410 and No. 430; and, registered private owners,. by approved Special Camping Permit, issued by the City. All other camping, day or night, shall be prohibited and shall be enforced as provided herein. Section 17..65.050 - Conditional Uses The following uses are allowed in the Lakeshore Overlay District pro- vided a Conditional Use Permit has been granted by the City Council, after notice and public hearing before the Planning Commission and City Council: A. Campgrounds and picnic grounds (also requiring additional compliance with California State Code, Title 25). B. Tennis courts. C. Athletic fields. D. Play grounds. E. Hiking and bicycle trails-tracks. F. Recreational vehicle/trailer. parks (also requiring additional com- pliance with California State Code, Title 25). G. Motels. H. Other retail uses as deemed similar to the above mentioned uses. Section 17.65.060 - Prohibited Uses Any uses not specifically listed as allowed, either by ownership right within Permitted/Conditional Use or Special Permit, are prohibited, but not limited to: new residential dwellings, off-site advertising structures, storage of any kind unless connected with existing occupied .residential dwellings but will be applicable to all other City Codes, parking lots and unauthorized vending/peddling and selling. Section 17.65.070 - Development Standards A. Ten thousand (10,000) square feet minimum lot area. B. One hundred (100) feet minimum lot width. C. Minimum yard setback requirements shall be as follows: 1. All uses shall maintain a minimum setback of thirty (30) feet from Lakeshore Drive; 2. Side yard setback shall be five (5) feet; and -3- 3. Rear yard setback shall be established by the City Council on a case by case basis. D. Fences may be erected within the Lakeshore Overlay District, subject to approval of architectural theme determined by Planning Commission. No fees required to review. E. Stumps and dead trees to conform with existing Municipal Codes. F. Access for any use must be approved by the Planning Division based upon: 1. Safety of approach; 2. Adequate facilities; and 3. Conformance to requirements as listed in the Lake Elsinore Municipal Code. G. Any use approved as a Conditional Use must conform to the Lake Elsinore General Plan. and requirements for Scenic Corridors. Section 17.65.080 - Parki Parking shall be allowed in conjunction, or maintained in accordance with, Sections 17.65.040, 17.65.050, and 17.65.070, in addition to meeting all other City Codes. No other parking shall be permitted and is prohibited as defined within Sect ion 17.65.030. C. Violations shall be enforced as herein provided. Section 17.65.090 - Materials to be Submitted In addition to all materials and procedures required by the City's sub- division, zoning, building and grading regulations, and environmental review pro- cedures applicable to lake shoreline development projects falling within the scope of this Chapter, the following application materials shall be required to be sub- mitted for lake shoreline development projects: A. A plot plan reflecting the proposed project including repre- sentations of property lines, all records and proposed pro- perty lines., all recorded and proposed easements, and public right-of-way. B. A topographical map of the project site and adjacent terrain located within 150 feet of the project boundaries. C. A complete grading plan for the project. D. A landscaping plan which shall accurately show the final disposition of all existing trees on the project site and the type and extent of proposed vegetation. E. If the development project is within an area of special flood hazard, developer shall also submit a properly -4- executed flood hazard deed notification document, which shall be recorded by the City to provide constructive notice to all future purchasers and encumbenances con- cerning the flood hazard. ion 17.65.100 - Non-Conforming Uses Any structure or use within the Lakeshore Overlay District which does not comply with the provisions of this Ordinance, but which is legally in existence, shall upon such date acquire the status of a lawfully non-conforming structure or use, subject to all Municipal Godes and Ordinances. A. Unoccupied structures and buildings subject to Section 15.08.020. B. Campgrounds, unless a Conditional Use Permit is granted - one (1) year is given to bring into conformance with all City Codes and State of California, Title 25. C. Foundations, wa11s and other concrete structures, not used for retaining purposes, not in conjunction or necessary with existing or developed property, shall be removed within six (6) months. D. Open storage, storage structures, storage of materials, trailers, vehicles and boats not related to existing residential. structures are prohibited unless stored. in a legal manner to City Codes. E. Stumps and dead trees, if not under water, shall be removed immedi- ately. F. Refuse materials shall be removed immediately. Section 17.65.110 - Enforcement Authori The City's Law Enforcement Agency and Code Enforcement Officers are appointed inspectors to assure compliance with all provisions herein and have the right to enter free of charge, at any time, upon any place or parcel of land, to investigate and determine compliance and/or to enforce and perform all the regu- latory provisions of Chapter 17.65.010 through 17.65.120. In Addition, the Code Enforcement Officers are hereby empowered to issue written citations/tickets to trespassers, persons who litter and illegally parked vehicle-violators, as defined in Section 17.65.030.A, B, and C, whether the vio- lator is physically present or not, found within the areas as defined within Section 17.65.020; these violation(s) shall constitute a prima facia presumption that the trespasser, person who litters and last registered owner bf record of vehicle, not having complied with the provisions of Section 17.65.030.A, B, and C, is responsible for such and is thereby liable for the cost of a fine as imposed and established hereafter. -5- Section 17.65.115 - Imposition of Fines Any person or registered owner in control of a vehicle found in violation of any provisions herein defined and described, shall be fined with the following schedule: A. Littering - Any person found in violation of littering shall be fined not less than fifty dollars ($50.00) plus thirty-two (32) hours of community service cleaning up litter for the first offense, and an additional one hundred dollars (.$100.00) plus sixty-four (64) hours of community service cleaning up litter for each additional offense thereafter, up to a maximum of five hundred dollars ($500.00). B. Trespassing - Any person found in violation of trespassing shall be guilty of a misdemeanor with a maximum penalty of five hundred dollars ($500.00) or six (6) months in jail. C. Illegal Parked Vehicle - A minimum fine of fifteen dollars ($15.00) shall be set for vehicle(s) found in violation. Section 17.65.120 -.Administrative Appeal A. Any person aggrieved by or dissatisfied with the provisions of this Ordinance, may file a written appeal to the City Council as per City Codes and Ordinances. B. Any person aggrieved by or dissatisfied with the enforcement of this Ordinance, may appeal to the Municipal Court as structured within due process of California law. Section 17.65.1.25 - Liberal Construction - Conflict The provisions of this ordinance shall be liberally construed to effectuate their purposes. If there is a conflict between this ordinance and any other provi- lions of the Municipal Code, the provisions of this ordinance shall prevail. SECTION TWO. This ordinance shall take effect as provided by law. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES ORDAIN AS FOLLOWS: Chapter 5.25.010 - Definitions: For the purpose of this chapter, the following definitions will apply: A. "Security Services", means persons-who, for consideration, are guarding, protecting or patroling property or protecting, defending or guarding persons, or any other persons defined in Chapter 11 (commencing with Section 7500) of Division 3 of the Business and Professions Code. B. "Security Guards", means private investigators, private patrol operators, uniformed employees of private patrols, night watchmen, protection dog operators and any other person defined in Chapter 11 (commencing with Section 7500) of Division 3 of the Business and Professions Code. C. "Chief Law Enforcement Officer", means Chief of Police or contract ranking officer of Lake Elsinore Riverside County Sheriff's Station. 5.25.020 - Permit Required: No person or company shall operate a Security Service in the incorporated area of the City of Lake Elsinore unless he holds a current, unrevoked permit issued to expire at the end of one year from time of issue. The annual fee therefor shall be One Hundred Dollars ($100.00), which may be prorated on a quarterly basis for the first year. 5.25.030 - Permit Application: Applications fora permit to operate a security service shall be made to the City upon the form provided which shall include the following; A. Name, residence address of the applicant, address of business and the fictitious name, if any, under which the applicant proposes to do business. Any change of business or residence address shall be reported within ten (10) working days to the responsible City staff member handling applications. -1- B. The experience of the applicant in the operation of Security Services. C. A complete description of each vehicle to be operated by the applicant or his employee. 5.25.040 - Permit Investigation: Upon the receipt of a completed application, the Chief Law Enforcement Officer of the City shall conduct an investigation to determine that the public health, safety, welfare, convenience and necessity require the granting of the permit and shall further determine if the applicant meets all the require- ments of the Chapter and the Laws of California. Upon completion of said investigation by the Chief Law Enforcement Officer of the City, he/she shall recommend to the City that the permit be granted or denied. 5.25.050 - Permit Hearing: If the City determines that a permit shall not be issued, the applicant has the right to demand a public hearing. A Request for Hearing shall be made in writing to the City within fifteen calendar days following notification of the decision of the City to deny the permit. Upon receipt of a written request, the City shall set the matter for Hearing not more than thirty (30) days following receipt of the writen request.. At the Hearing the applicant shall have the burden of proof to show facts of why a permit should be issued and why it meets the requirements of this Chapter and the Laws of the State of California. 5.25.060--_Pe.rmit Renewal: Permits to operate a Security Service may be renewed annually by the Chief Law Enforcement Officer of the City upon application by a permittee if the Chief Law Enforcement Officer determines that the permittee remains in compliance with the provisions of this Chapter. 5.25.070 - Permit Transfer: No permit shall be transfered to another person except upon prior approval of the City and upon the recommendation of the Chief Law Enforcement Officer of the City. 5.25.080.- Permit - Prereouisite of Issuance: Prior to issuance of the permit the applicant shall: A. Pay the first years fee, or prorate a portion thereof. _p_ B. File copies. of certification or licenses required by the California Business and Professions Code in Chapter 11 (commencing with Section 7500) of Division 3, for each security guard employeed. The applicant will supply, with- in five working days, copies of certificates and licenses of each new employed security guard during time of permit. C. .The applicant shall furnish a letter agreeing that the City is not obligated to pay for any costs or damages incurred by their service. 5.25.090 - Equipment Requirements: A. Uniforms shall not resemble the Law Enforcement Agency of the City. B. Badges shall not resemble or represent in design the Law Enforcement Agency of the City. C. Vehicles shall not have emblems on-doors that resemble the Law Enforcement Agency of the City. Vehicles may have "Security" in three inch (3")'letters on the. trunk lid. D. Lighting on vehicle shall conform to the California Vehicle Code. E. The Chief Law Enforcement Officer of the City shall have final approval of uniforms, badges and 'vehicles to insure compliance with this Section. 5.25.100 - Permit Issuance: lJpon issuance of a permit, the permittee shall have the right to provide Security Services for which he has been granted a permit. 5.25.110 - Permit - Grounds For Denial, Revocation: The granting of a permit, or a renewal may be denied and an existing permit may be revoked or suspended for any of the following grounds: A. The permittee or applicant has made false statements or fails to disclose facts in a material matter either in his application or in any reports or other documents furnished to the City. B. The permittee does not maintain and operate his vehicles -3- and other equipment in the manner and in the condition required by this Chapter. C. The permittee knowingly employs persons. who do .not meet the standards or requirements or have the certificate, licenses required. by this Chapter. D. The permittee or applicant is not the real party in interest in the business. E. Any other grounds or conduct as defined in Chapter 11 (commencing with Section. 7500) of the Business and Professions Code of California, which are violations. F. If the permittee. or applicant: 1. Is required to register as a sex offender under 290 of the California Penal Code. 2. Habitually uses, or is addicted to the use of, or uses narcotic or dangerous drugs or has been convicted of any offense relating to the use, sale, possession or transportation of narcotics or habit forming drugs within the past ten (10) years. 3. Is a habitual user of intoxicating beverages to excess. Habitual to be at least three arrests and convictions of Drunk in Public or Driving While Under the Influence in a two (2) year period. 4. Has.. been .convicted. of any offense involving Moral Turpitude. 5. Convicted of any offense relating to theft within the past ten (10) years. 6. Has operated a motor vehicle in violation of the California Vehicle Code relating to Security Services. 5.25.120.- Permit - Revocation or Suspension: A. Every permit granted under. this Chapter is granted and accepted by all parties with the express understanding that the permit may be revoked or suspended for any cause -4- specified in this Chapter by the Chief Law Enforcement Officer of the City after ten (10) working days notice to the permittee to be heard on the matter. B. If, after such Hearing, the Chief Law Enforcement Officer finds that grounds for revocation or suspension still exist he/she may then revoke or suspend the permit. If a permit is suspended, the permittee shall cease operations until the Chief Law Enforcement Officer removes the suspension. C. Failure to cease operations shall be a violation and is a misdemeanor with a punishment of thirty (30) days in jail and or a One Hundred Dollar ($100.00) fine for each day of violation. 5 25 130 - Permit -.Hearing Upon Nonrenewal or Revocation: If renewal of a permit is denied or if revoked by the Chief Law Enforcement Officer, the permittee shall have the right to demand a Hearing thereon. A request fora Hearing shall be made in writing to the City within fifteen (15) calendar days following notification of the denial or revocation of the permit. .Upon receipt of a written request the City shall set the matter for hearing on a date not more than sixty (60) days following receipt of the written request and give notice to the appellant and the Chief Law Enforcement Office of the date of Nearing. At the Nearing the parties may present evidence relevant to the decision for denial or revocation. The Hearing may be public or closed depending on request of permittee. With. fifteen (15) working days, following_the: conclusion of the Hearing, a written decision will be given. 5.25.140 - Punishment For Violating Chapter: Operating in violation of this Chapter is a misdemeanor punishable by thirty (30) days in jail or one hundred (100) hours of community service and One Hundred Dollars ($100.00) for each day of violation. Section 2: CREATION OF PUBLIC SAFETY COMMISSION. A Public Safety Commission of the City of Lake Elsinore, California, is hereby established. Section 3: MEMBERSHIP. The Commission shall consist of five (5) members, who shall live inside the City of Lake Elsinore or be the owner of a business that is established and currently licensed inside the City limits. Section 4: APPOINTMENT - REMOVAL. The members of the Commission shall be :appointed by the Mayor and ratified by a majority vote of the members of the City Council and may be removed by the Mayor at his/her pleasure, but subject to the approval by a majority vote of the members of the City Council. Section 5: TERM OF OFFICE. The members of the Public Safety Commission shall be appointed fora term of two (2) years. Section 6: DUTIES AND RESPONSIBILITIES. The Commission shall have the duty and responsibility to: 1. Initiate studies and surveys relating to the general field of Public Safety and report the findings and recommendations to the City Council and appropriate departments of the City. 2. Conduct hearings, investigations, or both, at the request of the City Council, City Manager, or a Public Safety Department Head; for the purpose of ascertaining whether additional legislation or changes in legislation is needed for the health, safety, peace and welfare of the citizens of the City and make findings and recommendations to City Council and City Manager for action. 3. Upon request, assist any Public Safety Department Head in matters pertaining to the respective department as submitted for consideration and recommendation. 4. If a Commissioner cannot attend a meeting or is going to be late, he shall contact the City Manager's office. The Commission shall be authorized to meet twice a month, but not less then once a month. 6. The Chief of Police and the Fire Chief, or members of their staff shall attend the regularly scheduled meetings, but are not voting members of the Commission. Section 8: COMPENSATION. WHEREAS, the City Council of the City of Lake Elsinore does have numerous requests from citizens to hold "Special Events"; and WHEREAS, the City Council of the City of Lake Elsinore does not have established definitions, guidelines and permit procedure for the review and processing of "Special Event" requests; and WHEREAS, "Special Events" have proven to be of benefit and enjoyment to the citizens of the City of Lake Elsinore. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, DOES ORDAIN AS FOLLOWS: SECTION ONE: At the discretion of the City Manager, the following sub-sections shall be used as a guideline to determine if a request shall be classified as a "Special Event". A "Special Event" Permit shall be required if the request/nature is found to be in conformance or similar to, any of the below listed sub-sections: A. Definition of a "Special Event". "Special Event" shall be defined, by way of example, but not limited to an exhibit, display, gathering assembly, attraction, concert, performance, rally, congregation or collection of more than fifty (50) persons at any one time. B. Time. The scheduled event is intended to be held no more than two (2) time per calendar year; or, the scheduled event is intended to be held from one (1) to seven (7) consecutive days; or, the scheduled event is intended to be held between or within the hours of 8:00 a.m. - 1:00 a.m. on any one day. C. The scheduled event will not be held within a structure - or building, currently approved and authorized as acceptable for assembly by agencies. D. The scheduled event will necessitate the use of por- table toilet/s. (The gathering or anticipated attrac- tion of fifty (50) or more persons at any one time, will require/necessitate the use of portable toilet/s). One (1) portable toilet will be required for the first fifty (50) persons, an additional portable toilet shall be required for every twenty-five (25) persons in attendance or fraction thereafter. E. The scheduled event will necessitate the use of portable trash bins/waste receptacles. (The gathering or antici- pated attraction of fifty (50) or more persons at arnI one time, will require/necessitate the use of portable trash bins/waste receptacles). Fifty (50) persons -three (3)-twenty (20) gallon trash receptacles and three (3) additional. t~:enty (20) gallon trash receptacles for every twenty-five (25) persons +lzereafter or one trash bin for every fifty (50) persons in attendance or fraction thereafter. F. The scheduled event may require payirent/collection/ donation of monies or equivalent, or any item for ad- mission/right-of-entry to or upon the property, location or place. G. The scheduled event may have offered, displayed or trade for free or sale or offered for sale, exchange, trade swap or exhibit for display of sale or future sale any merch- andise, wares, animals or any items, or any food/drink for human or anunal cons~tion. sECrlora T[tiU: A request fora "Special Event" shall be made on forms as provided by the City of Lake Elsinore (~~RT'r "A"), stating all pertinent facts. In- complete permit applications shall be deemed un-acceptable, at the discretion of the City Manager. SECTION THREE: Said r~uest fora "Special Event", on a permit application, shall be sulinatted at least sixty (.6Q~ calendar days in advance of the scheduled event. SECTION FOUR: All. requirements/conditions of approval shall be met, and written proof thereof exhibited, one (1) week in advance of the scheduled event. The citizen/applicant shall be responsible to notify and obtain all necessary written agency approvals. Those agencies include, but are not Limited to: Health, Fire and Sheriff Departrnents. SECTION FIVE: The City Manager, or his/her designee, shall issue said "Special Events" permit upon complete compliance with provisions established within this Ordinance. SECTION SIX: A fee of Two Hundred .Dollars ($200.00) shall be set to process and review a request for a "Special Event". All requirements/conditions of approval costs shall be the seperate responsibility of the applicant. SECTION SEVEN: The employ of any City employee to attend/monitor a "Special Event" shall be paid by the citizen/applicant, in an amount sufficient to cover all costs and benefits of City employee. This cost is over and above the "Special Event" permit cost, as stated within Section six. SECTION EIGHT: At the discretion of the City Manager, a bond of liability naming the City of Lake Elsinore, its employee, may be required. The amount sha71 be de- termined according to the nature of the "Special Event". SECTION NINE: The traffic circulation or parking of a "Special Event" shall not be injurious or detrimental to surrounding properties in the vicinity or zone. The applicant shall submit and provide, in writing, proof of sufficient on- site parking and mitigation measures to be enforced on traffic circulation to and from the "Special Event", from the chief law enforcement officer of the City. SECTION TEN: Non-compliance of this Ordinance or any section thereof, shall void the "Special Event" permit, and shall be a misdemeanor punishable by a fine of up to One-Thousand Dollars ($1,000.00), plus six (6) months in jail for each day of violation. BE NT FURTHER ORDAINED, that any citizen/applicant aggreived by the decision of the City Manager shall have the right of appeal to the City Council upon compliance with Sections two, three, six, and eight. Such appeal shall 6e taken by filing with. the City Clerk, within fourteen (14) days after the decision of the City Manager, a written statement setting forth fully the grounds for appeal. WHEREAS, the City Council of the City of Lake Elsinore, desires to formally adopt a Code of Ethics for all members of the Public Service of the City. NOW, THEREFORE, BE IT RESOLVED that the following be a "Code of Ethics for the Public Service of the City of Lake Elsinore": Section 2.09.01. Declaration of Policy. The proper operation of democratic government requires that public officials and employees be independent, impartial, and responsible to the people; that governmental decisions and policy be made in the proper channels of the governmental structure; that public office not be used for personal gain; and that the public have confidence in the integrity of its government. In recognition of these goals there is hereby established a Code of Ethics for all officials and employees by setting forth those acts or actions that are incompatible with the best interests of the City and by directing disclosure by such officials and employees of private financial or other interests in matters affecting the City. The provisions and purpose of this Code and such rules and regula- tions as may be established are hereby declared to be in the best interests of the City of Lake Elsinore. Section 2.09.02. Responsibilities of Public Office. Public officials and employees are agents of public purpose and hold office for the benefit of the public. They are bound to uphold the Constitution of the United States and the Constitution of this State and to carry out impartially the laws of the nation, state and municipality and thus to foster respect for all government. They are bound to observe in their official acts the highest standards of morality and to discharge faithfully the duties of their office regardless of personal considerations, recognizing that the public interest must be their primary concern. Their conduct in both their official and private affairs should be above. reproach. Section 2.09.03. Dedicated Service. All officials and employees of the City should be loyal to the political objectives expressed by the electorate and the programs developed to attain those objectives. Appointive officials and employees should adhere to the rules of work and performance established as the standard for their positions by the. appropriate authority. Officials and employees should not exceed their authority or breach the law or ask others to do so, and they should work in full cooperation with -1- other public officials and employees unless prohibited from so doing by law or by officially recognized confidentiality of their work. Section 2.09.04. Fair and Eaual Treatment (a) Interest in Appointments. Canvassing of members of the Council, directly or indirectly, in order to obtain preferential consideration in connection with any appointment to the municipal service shall disqualify. the candidate. for appointment except with reference to positions filled by appointment by the Council. (b) Use of Public Property. No official or employee shall request or permit the use of City-owned vehicles, equipment, materials, or property for personal convenience or profit, except when such services are available to the public generally or are provided as municipal policy for the use of such official or employee in the conduct of official business. (c) Obligations to Citizens. No official or employee shall grant any special consideration, treatment, or advantage to any citizen beyond that which. is available to every other citizen. Section 2.09.05. Conflict of Interest. No councilman or other official or employee, whether paid or unpaid, shall engage in any business or transaction or shall have a financial or other personal interest, direct or indirect, which is incompatible with the proper discharge of his official duties in the public interest or would tend to impair his independence of judgment or action in the performance of his official duties. Personal as distinguished from financial interest includes an interest arising from blood or marriage relationships or close business or political associations. Specific conflicts of interests are enumerated below for the guidance of officials and employees: (a) Incompatible Employment. No councilman or other official or employee shall engage in or accept private employment or render services for private interests when such employment or service is incompatible with the proper discharge of his official duties or would tend to impair his independence of judgment or action in the performance of his official duties. (b) Disclosure of Confidential Information. No councilman or other official or employee shall, without proper legal authorization, disclose confidential information concerning the property, government, or affairs of the City. Nor shall he use such information to advance the financial or other private interests of himself or others. -2- (c) Gifts and Favors.. No councilman or other official or employee shall accept any valuable gift, whether in the form of service, loan, thing, or promise, from any person, firm, or corporation which to his knowledge is interested directly or indirectly in any manner whatsoever in business dealings with the City; nor shall any such official or employee (1) accept any gift, favor, or thing of value that may tend to influence him in the discharge of his duties, or (2) grant in the discharge of this duties any improper favor, service, or thing of value. (d) Representing Private Interests Before City Agencies or Courts. No councilman or other official or employee whose salary is paid in whole or in part by the City shall appear in behalf of private interests before any agency of the City. He shall not represent private interests in any action or proceeding against the interests of the City in any litigation to which the City is a party. A councilman may appear before City agencies on behalf of constituents in the course of his duties as a representative of the electorate or in the performance of the public or civic obligations. However, no councilman or other official or employee shall accept a retainer or compensa- tion that is .contingent upon a specific action by a City agency. (e) Contracts with the City. Any council man. or other official or employee who has a substantial or controlling financial interest in any business entity, transaction, or contract with the City, or in the sale of real estate, materials, supplies, or services to the City, shall make known to the proper authority such interest in any matter on which he may be called to act in his official capacity. He shall refrain from voting upon or otherwise participating in the transaction or the making of such contract or sale. A councilman or other official or employee shall not be deemed interested in any contract or purchase or sale of land or other thing of value unless such contract or sale is approved, awarded, entered into, or authorized by him in his official capacity. (f) Disclosure of Interest in Legislation. A councilman who has a financial or other private interest in any legislation shall disclose on the records of the council or other appropriate authority the nature and extent of such interest. This provision shall not apply if the councilman disqualifies himself from voting. Any other official or employee who has a financial or other private interest, and who participates in discussion with or gives an official opinion -3- to the council or other appropriate authority the nature and extent of such interest. Section 2.09.06. Discussions at Closed Sessions-Disclosure. No member of the City Council, officer or employee of the City, or any other person present during a closed session of the Council shall disclose to any person the content or substance of any discussion which took place at said closed session unless the City Council shall vote to authorize the disclosure of such information by majority vote. Section 2.09.07. Sanctions. Violation of any provisions of this Code should raise conscientious questions for the councilman or other official or employee concerned as to whether voluntary resignation or other action is indicated to promote the best interests of the City. Violation may constitute a cause for suspension, removal from office or employment, or other disciplinary action. Violation of any provision of this Code shall constitute a misdemeanor and shall be punishable by a fine of up to $500 and/or imprisonment for up to one year. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION ONE: PURPOSE AND INTENT; It is the purpose and intent of this ordinance to prevent the spread of infectious disease and to attain a uniform standard by requiring all food handlers in the City of Lake Elsinore to demonstrate through process of examination that they pos- sess an adequate knowledge of the sanitary principles and practices with- in the food industry. SECTION TWO: DEFINITIONS; As used in this ordinance, the following words and phrases shall have the following meanings: (a). "Food Worker's Certificate" shall mean a statement issued by the Health Officer certifying that a person is free from active communicable tuberculosis in a manner acceptable to said Health Officer, and has satisfactorily demonstrated his or her compentency in food santitation principals and practices. (b). "Food Worker's Manual" shall mean the manual prepared and distributed to food handlers by the Health Officer that describes acceptable procedures and sanitary practices as it pertains to the retail food service industry., (c). "Health Officer" sha)1 mean the Health Officer/Inspector of the County of Riverside or the Code Enforcement Officer of the City of Lake Elsinore or any designated representative. SECTION THREE: FOOD WORKER'S CERTIFICATE REQUIRED; No person shall engage or serve in any work, occupation or employment which requires or occasions the handling of any food, liquid or material intended for food or drink for human consumption or the handling of any dishes or other articles used in the preparation or service of food or drink for human consumption, who does not hold or produce a Food Worker's Certificate as required by this ordinance within fourteen (14) days after engaging or serving in such work, occupation or employment or who knows or -1- reasonably believes that he or she ds infected with active communicable tuberculosis, and no owner, manager, or person in charge of any establish- ment or business shall retain in the employ thereof for the performance such services, any person who does not hold and produce a Food Worker's Certificate as required by this ordinance within fourteen (14) days after such person engages or serves in such employment or any person known or reasonably believed to be infected with active communicable tuberculosis. SECTION FOUR: EXEMPTION; Any person who engages or serves or seeks employ- ment relating to domestic or household work or to temporary, occasional or intermittent functions of bona fide religious, charitable or public service organizations, including fraternal organizations, parent-teacher associations, veterans organizations, established youth organizations, or students in public or private schools under the age of sixteen (16) years old engaged in schools food operations, and civic or community organizatiohs or groups, the primary purpose of which is the betterment of the cultural, social or economic welfare and environment or the community, shall be exempt from the provisions of Section 3 of this ordinance. SECTION FIVE: APPLICATION FOR FOOD WORKER'S CERTIFICATE; (a) Any person who is engaged or intends to engage in an occupation or employment for which a Food Worker's Certificate is required by Section 3 of this ordinance shall file with the Health. Officer an application for such certificate or a renewal thereof in such form as the Health Officer may require, which application shall be accompanied by a nonrefundable fee of $5.00; provided, however, students sixteen (16) years of age or younger engaged in school food operations are exempted from such fee. (b) Such application must be accompanied by a signed state- ment of a physician duly authorized to practice medicine in the State of California, or a report from an organization acceptable to the Health Officer, showing that the applicant is free of active communicable tuberculosis. Said statement or report shall show that within six months of the date of application the applicant has received either; (1) a normal chest X-ray which shows the applicant to be free of active communicable tuberculosis, or (2) an intradermal Mantoux test no less than 5 tuberculin units, which is the equivalent of .0001 milligrams intermediate PPD, or -2- one to two thousand solution of old tuberculin freshly prepared, have been used. Induration of six or more millimeters will be construed as a posi- tive-skin test. A71 positive skin test reactors to the Mantoux test will be required to obtain a chest X-ray. Said statement or report shall bear a date not more than six months before the date of application. (c) A valid certificate of health, indicating that the applicant is free from active communicable tuberculosis, issued by any regular constituted public health agency and bearing a date of issuance, may be accepted 6y the Health Officer, in lieu of the statement or report as required in Subsection (b) of this Section (5), during its period of validity, not to .exceed one (1) year from the date of issuance. SECTION STX: __ ._. __ QUACIFICATIONS'FOR FOOD WORKER'S CERTIFICATE; To qualify for the issuance or renewal of a Food Worker`s Certificate required by Section 3 of this ordinance, the applicant shall 6e certified to be free from active communicable tuberculosis and shall have demonstrated his or her knowledge of acceptable practices in the sanitary preparation, service, storage, distribution and sale of food and beverages and the proper sani- tation of equipment and facilities. .Such demonstration of knowledge shall be by satisfactorily passing an examination conducted by the Health Officer on such subjects, based on the practices and procedures setforth in the Food Worker's Manual. A copy of the latest edition of said manual shall be made available by the Health Officer to those persons applying for a Food Worker's Certificate or renewal thereof. SECTION SEVEN: ISSUANCE OF FOOD WORKER'S CERTIFICATE; When qualified pursuant to Section 6 of this ordinance, the applicant shall be issued a Food Worker's Certificate containing the following information; cer- tificate number, name, home address, expiration date and attesting sig- nature. Such certificate shall expire one (1) year after the date it was issued. Any person whose health, in the opinion of the Health Officer requires further investigation .may be issued a temporary Food Handler's Certificate at the discretion of the Health Officer fora period not to exceed three (3) months, during which time such investigation shall be carried out to determine whether or not active communicable tuberculosis is present. -3- SECTION EIGHT: DUPLICATE FOOD WORKER'S CERTIFICATE; A duplicate Food Worker's Certificate, for good cause, may be issued by the Health Officer for a fee of one (1) dollar. SECTION NINE: REVOCATION OF FOOD WORKER'S CERTIFICATE; The Food Worker's Certificate may be revoked 6y Health Officer upon evidence indicating repeated or continuing violations of accepted practices and procedures in the preparation, service, storage, distribution, or sale of food or beverages, or upon evidence indicating falsification of information re- qured for issuance of such certificate, or infectious_condition~creating a hazard to the public or co-workers. SECTION TEN: APPEAL; Any person who has an application fora Food Worker's Certificate denied by the Health Officer or who has had such a certificate revoked by the Health. Officer, may appeal such denial or revocation by filing with the Clerk of the Board of Supervisors, within ten (10) days after the date of such denial or revocation, a written notice of appeal briefly setting forth. the reasons why such denial or revocation is not proper. The Clerk shall give notice of the time and place of the hearing to the appellant. Such appeal shall 6e heard by the Board of Supervisors which. may affirm, amend or reverse the. decision or take such other action as it deems appropriate. In conducting the hearing, the Board of Supervisors shall not be limited 6y the technical rules of evidence. SECTION ELEVEN: DISPLAY OF FOOD WORKER'S CERTIFICATE; Any person required to have a Food Worker's Certificate shall immediately submit such cer- tificate to his or her employer. It shall be the duty of every such employer to keep on continuous display at the place of employment the Food Worker's Certificates of all .such persons employed or engaged there- in, and to display therewith a current list of all such persons. therein engaged or employed for comparison with all certificates. Such list of employees and Food Worker's Certificates must be made available to all Health Officers upon request. Upon termination of employment, each un- expired certificate shall be returned to the holder. -4- SECTION TWELVE: VIOLATION AND ENFORCEMENT; It shall be the duty of all Health Officers as defined within Section 2; Definitions, to assure com- pliance with all provisions herein and have the right to enter free of charge, at any time, into any applicable place of business, to determine compliance and/or to enforce and perform all the regulatory provisions of this ordinance. It is the responsibility of all employers to main- tain and display a continuous record of all Food Worker's Certificates and a list of all applicable employees currently engaged therein as re- quired within Section 11; Display of Food Worker's Certificate, there- fore, any employer violating any of the provisions of this ordinance shall be guilty of an infraction and upon conviction shall be punished by (1) a fine not exceeding fifty (50) dollars for the first offense, (2) a fine not exceeding one hundred (100) dollars for the second of- fense within one (1) year, (3) a fine not exceeding two hundred. and fifty (250) dollars for each additional offense within one (1) year.
