Effective Date: This operating agreement of MACHADO STORAGE, LLC, effective November 1, 1997, is adopted by the Members whose signatures appear in Section VIII.A. B. Formation: This Limited Liability Company (LLC) was formed by filing Articles of Organization with the State of California's LLC filing office on: November 1, 1997 C. Name: The formal name of this LLC is as stated above. However, this LLC may do business under a different name by complying with the state's fictitious or assumed business name statutes and procedures. D. Registered Office and Agent: The registered office of this LLC and the registered agent at this address are as follows: Gary W. Pebley, 41820 Calle Cedral, Temecula, CA 92592. The registered office and agent may be changed from time to time as the Members may see fit, by filing a change of registered agent or office form with the state LLC filing office. It will not be necessary to amend this provision of the operating agreement if and when such a change is made. E. Business Purposes: The specific purposes and activities contemplated by the founders of this LLC at the time of initial signing of this Agreement consist of the following: Self-Storage Facility It is understood that the foregoing statement of purposes shall not serve as a limitation on the powers or abilities of this LLC, which shall be permitted to engage in any and all lawful business activities. If this LLC intends to engage in business activities outside the state of its formation that require the qualification of the LLC in other states it shall obtain such qualification before engaging in such out-of-state activities. Page 1 of 14 F. Duration of LLC: The duration of this LLC shall be until December 31, 2050. Further, this LLC shall terminate when a proposal to dissolve the LLC is adopted by a majority of the membership of this LLC or when this LLC is otherwise terminated in accordance with law. G. Definitions of General Terms: The terms used in this Agreement with their initial letters capitalized shall, unless the context otherwise requires, have the meanings specified in this Paragraph, or, if not defined in this Paragraph, elsewhere in this Agreement. When used in this Agreement, the following terms shall have the meanings set forth below: 1. "Agreement" shall mean this Operating Agreement, as originally executed and as amended from time to time, and shall refer to this Agreement as a whole, unless the context otherwise requires. 2. "Articles" shall mean the Articles of Organization for Company originally filed with the California Secretary of State and as amended from time to time and shall refer to the Articles as a whole unless the context otherwise requires. 3. "Bankruptcy" shall mean being the subject of an order for relief under Title 11 of the United States Code, or any successor statute or other statute in any foreign jurisdiction having like import and effect. 4. "Capital Contributions" shall mean the total value of cash and fair market value of property (including promissory notes) contributed and/or services rendered or to be rendered to Company by Members, as shown in Section N.A. of this Agreement as the same may be amended from time to time, plus the total value of cash and fair market value of property (including promissory notes) contributed as additional capital contributions. 5. Company shall mean MACHADO STORAGE, LLC. 6. Interest or Membership Interest in Company shall mean the entire ownership interest of a Member in Company at any Page 2 of 14 particular time, including the right of such Member to any and all benefits to which a Member may be entitled as provided in this Agreement and under the Act, together with the obligations of such Member to comply with all terms and provisions of this Agreement. 7. Member shall mean each person (other than any person who has withdrawn, died, retired or become bankrupt) who is an initial signatory to this Agreement and any other person who may subsequently be a signatory to this Agreement with the consent of all who are then Members. 8 Net Profits and Net Losses shall mean the income, gain, loss, deductions and credits of the Company in the aggregate or separately stated, as appropriate, determined in accordance with generally accepted accounting principles employed under the method of accounting in use at the close of each fiscal year on the Company's information tax return filed for federal income tax purposes. 9. Person includes individuals, general partnerships, limited partnerships, other limited liability companies, corporations, trust, estates, real estate investment trusts and any other association. II. MEMBERSHIP PROVISIONS A. Initial Members: The names and addresses of the initial Members of the Company are set forth in Section VIII.A. of this Agreement. B. Nonliabilitx of Members: No Member shall be liable under a judgment, decree or order of a court, or in any other manner, for a debt, obligation or liability of Company, except as provided by law. No Member shall be required to loan any funds to Company. No Member shall be required to make any contribution to Company by reason of any negative balance in his capital account, nor shall any negative balance in a Member's capital account create any liability on the part of the Member to any third party. C. Liability of Members to Company: A Member is liable to Company: Page 3 of 14 1. For the difference between his or her contribution to capital as actually made and as stated in this Agreement; and 2. For any unpaid contribution to capital which he or she agreed in this Agreement or other document executed by the Member to make in the future at the time and on the conditions stated in this Agreement or other documents evidencing such agreement. D. Reimbursement for Organizational Costs: Members shall be reimbursed by the LLC for organizational expenses paid by the Members. The LLC shall be authorized to elect to deduct organizational expenses and start-up expenditures ratable over a period of time as permitted by the Internal Revenue Code and as may be advised by the LLC's tax advisor. E. Management: This LLC shall be managed exclusively by all of its Members. F. Members' Percentage Interests: A Member's percentage interest in this LLC shall be computed as a fraction, the numerator of which is the total of a Member's capital account and the denominator of which is the total of all capital accounts of all Members. This fraction shall be expressed in this Agreement as a percentage, which shall be called each Member's "percentage interest" in this LLC. G. Membership Voting: Except as otherwise may be required by the Articles of Organization, other provisions of this Agreement, or under the laws of this state, each Member shall vote on any matter submitted to the Membership for approval in proportion to the Member's percentage interest in this LLC. Further, unless defined otherwise for a particular provision of this Agreement, the phrase "majority of Members" means a majority of Members whose combined percentage interests in this LLC represent more than fifty percent (50%) of the percentage interests of all Members of this LLC. All decisions of the LLC requiring a vote shall be decided by majority vote unless otherwise provided in this Agreement. If a vote is taken with the two (2) founding members, and said founding members are unable to reach a unanimous decision, then the final decision shall be made by the member who has the greater degree of responsibility and/or expertise in the area at issue. H. Compensation: Members shall not be paid as Members of the LLC for performing any duties associated with such membership, including Page 4 of 14 management of the LLC. Members may be paid, however, for any services rendered in any other capacity for the LLC, whether as officers, employees, independent contractors or otherwise. I. Members' Meetings: The LLC shall not provide for regular Members' meetings. However, any Member may call a meeting by communicating his or her wish to schedule a meeting to all other Members. Such notification may be in person or in writing, or by telephone, facsimile or other form of electronic communication reasonably expected to be received by a Member, and the other Members shall then agree, either personally, in writing, or by telephone, facsimile or other form of electronic communication to the Member calling the meeting, to meet at a mutually acceptable time and place. Notice of the business to be transacted at the meeting need not be given to Members by the Member calling the meeting, and any business may be discussed and conducted at the meeting. If all Members cannot attend a meeting, it shall be postponed to a date and time when all Members can attend, unless all Members who do not attend have agreed in writing to the holding of the meeting without them. If a meeting is postponed, and the postponed meeting cannot be held either because all Members do not attend the postponed meeting or the non-attending Members have not signed a written consent to allow the postponed meeting to be held without them, a second postponed meeting may be held at a date and time announced at the first postponed meeting. The date and time of the second postponed meeting shall also be communicated to any Members not attending the first postponed meeting. The second postponed meeting may be held without the attendance of all Members as long as a majority of the percentage interests of the membership of this LLC is in attendance at the second postponed meeting. Written notice of the decisions or approvals made at this second postponed meeting shall be mailed or delivered to each non-attending member promptly after the holding of the second postponed meeting. Written minutes of the discussions and proposals presented at the Members' meeting, and the votes taken and matters approved at such meeting, shall be taken by one of the Members or a person designated at the meeting. A copy of the minutes of the meeting shall be placed in the LLC's records book after the meeting. J. Other Business by Members: Each Member shall agree not to own an interest in, manage or work for another business, enterprise or endeavor, if such ownership or activities would compete with this LLC's business goals, mission, profitability or productivity, or would diminish or impair the Member's Page 5 of 14 ability to provide maximum effort and performance in managing the business of this LLC. III. TAX AND FINANCIAL PROVISIONS A. Tax Treatment: It is anticipated that this LLC will not be treated as a corporation under state and federal tax law, but instead it will be treated in the same manner as a partnership for tax purposes. It is further understood that the Members do not consider each other partners or joint ventures with any other Member or manager of this LLC for any purpose other than federal and state tax purposes. B. Tax Year and Accounting Method: The tax year of this LLC shall be: calendar year (January 1 through December 31). The LLC shall use the accrual method of accounting. Both the tax year and the accounting period of the LLC may be changed with the consent of all Members if the LLC qualifies for such change, and may be effected by the filing of appropriate forms with the IRS and state tax authorities. C. Tax Matters Partner: If this LLC is required under Internal Revenue Code provisions or regulations, it shall designate from among its Members a 'tax matters partner' in accordance with Internal Revenue Code Section 6231(a)(7) and corresponding regulations, who will fulfill this role by being the spokesperson for the LLC in dealings with the IRS as required under the Internal Revenue Code and Regulations, and who will report to the Members on the progress and outcome of these dealings. D. Annual Income Tax Returns and Reports: Within ninety(90) days after the end of each tax year of the LLC, a copy of the LLC's state and federal income tax returns for the preceding tax year shall be mailed or otherwise provided to each member of the LLC, together with any additional information and forms necessary for each Member to complete his or her individual state and federal income tax returns. This additional information shall include a federal (and, if applicable, state) Form K-1 (Form 1065—Partner's Share of Income, Credits, Deductions) or equivalent income tax reporting form, as well as a financial report, which shall include a balance sheet and profit and loss statement for the prior tax year of the LLC. E. Bank Accounts: The LLC shall designate one or more banks or other institutions for the deposit of the funds of the LLC, and shall establish savings, checking, investment and other such accounts as are reasonable and Page 6 of 14 necessary for its business and investments. One or more Members of the LLC shall be designated with the consent of all Members to deposit and withdraw funds of the LLC, and to direct the investment of funds from, into and among such accounts. The funds of the LLC, however and wherever deposited or invested, shall not be commingled with the personal funds of any members of the LLC. F. Title to Assets: All personal and real property of this LLC shall be held in the name of the LLC, not in the names of individual Members. IV. CAPITAL PROVISIONS. A. Capital Contributions by Members: Members shall make the following contributions of cash, property or services as shown next to each Member's name below. Unless otherwise noted, cash and property described below shall be paid or delivered to the LLC on or by December 31, 1997. The fair market values of items of property or services as agreed between the LLC and the contributing Member are also shown below. The percentage interest in the LLC that each Member shall receive in return for his or her capital contribution is also indicated for each Member. It is the intention of the members to base the ownership interest percentages and profit sharing percentages on the amount of assets contributed by each member. Additional Contributions by Members: The Members may agree, from time to time by unanimous vote, to require the payment of additional capital contributions by the Members, on or by a mutually agreeable date. C. Failure to Make Contributions: If a Member fails to make a required capital contribution within the time agreed for a Member's contribution, the remaining Members may, by unanimous vote, agree to reschedule the time for payment of the capital contribution by the late-paying Member, setting any additional repayment terms, such as a late payment penalty, rate of interest to be applied to the unpaid balance, or other monetary amount to be paid by the delinquent Member, as the remaining Members decide. Alternatively, the remaining Members may, by unanimous vote, agree to cancel the membership of the delinquent Member, provided any partial payments of capital made by the delinquent Member are refunded promptly by the LLC to the Member after the decision is made to terminate the membership of the delinquent Member. A Founding Member's inability to make a required capital contribution within the time allowed pursuant to the immediately preceding paragraph shall not be considered grounds for termination of membership in the LLC. D. No Interest on Capital Contributions: No interest shall be paid on funds or property contributed as capital to this LLC, or on funds reflected in the capital accounts of the Members. E. Capital Account Bookkeeping: A capital account shall be set up and maintained on the books of the LLC for each Member. It shall reflect each Member's capital contribution to the LLC, increased by each Member's share of profits in the LLC, decreased by each Member's share of losses and expenses of the LLC, and adjusted as required in accordance with applicable provisions of the Internal Revenue Code and corresponding income tax regulations. F. Consent to Capital Contribution Withdrawals and Distributions: Members shall not be allowed to withdraw any part of their capital contributions or to receive distributions, whether in property or cash, except as otherwise allowed by this Agreement and, in any case, only if such withdrawal is made with the written consent of all Members. G. Allocations of Profits and Losses: No Member shall be given priority or preference with respect to other Members in obtaining a return of capital contributions, distributions or allocations of the income, gains, losses, deductions, credits or other items of the LLC. The Net Profits and Net Losses of the LLC, and all items of its income, gain, loss, deduction and credit shall be Page 8 of 14 allocated to Members according to each Member's percentage interest in this LLC. H. Allocation and Distribution of Cash to Members: Cash from LLC business operations, as well as cash from a sale or other disposition of LLC capital assets, may be distributed from time to time to Members in accordance with each Member's percentage interest in the LLC, as may be decided by all of the Members. I. Allocation of Noncash Distributions: If proceeds consist of property other than cash, the Members shall decide the value of the property and allocate such value among the Members in accordance with each Member's percentage interest in the LLC.. If such noncash proceeds are later reduced to cash, such cash may be distributed among the Members as otherwise provided in this Agreement. J. Allocation and Distribution of Liquidation Proceeds: Regardless of any other provision in this Agreement, if there is a distribution in liquidation of this LLC, or when any Member's interest is liquidated, all items of income and loss shall be allocated to the Members' capital accounts before any final distribution is made. A final distribution shall be made to Members only to the extent of, and in proportion to, any positive balance in each Member's capital account. V. MEMBERSHIP WITHDRAWAL AND TRANSFER PROVISIONS A. Withdrawal of Members: A Member may withdraw from this LLC by giving written notice to all other Members at least ninety (90) days before the date the withdrawal is to be effective. B. Restriction on the Transfer of Membership: A Member shall not transfer his or her membership in the LLC unless all non-transferring Members in the LLC first agree to approve the admission of the transferee into this LLC. Further, no Member may encumber a part or all of his or her membership in the LLC by mortgage, pledge, granting of a security interest, lien or otherwise, unless the encumbrance has first been approved in writing by all other Members of the LLC. Notwithstanding the above provision, any Member shall be allowed to assign an economic interest in his or her membership to another person without the approval of the other Members. Such an assignment shall not include a Page 9 of 14 transfer of the Member's voting or management rights in this LLC, and the assignee shall not become a Member of the LLC. VI. DISSOLUTION PROVISIONS A. Events that Trigger Dissolution: The following events shall trigger a dissolution of the LLC, except as provided: 1. The death, insanity, bankruptcy, retirement, resignation or exclusion of a Member, except that within ninety (90) days of the happening of any of these events, all remaining Members of the LLC may vote to continue the legal existence of the LLC, in which case the LLC shall not dissolve; 2. The expiration of the term of existence of the LLC if such term is specified in the Articles of Organization, Certificate of Formation or a similar organizational document, or this Agreement; 3. The written agreement of all Members to dissolve the LLC; and 4. Entry of a decree of dissolution of the LLC under state law. VII. GENERAL PROVISIONS A. Officers: The LLC may designate one or more officers, such as President, Vice President, Secretary and Treasurer. Persons who fill these positions need not be Members of the LLC. Such positions may be compensated or non-compensated according to the nature and extent of the services rendered for the LLC as a part of the duties of each office. Ministerial services only as a part of any officer position will normally not be compensated, such as the performance of officer duties specified in this Agreement, but any officer may be reimbursed by the LLC for out-of-pocket expenses paid by the officer in carrying out the duties of his or he office. B. Records: The LLC shall keep at its principal business address a copy of all proceedings of membership meetings, as well as books of account of the LLC's financial transactions. A list of the names and addresses of the current Page 10 of 14 membership of the LLC also shall be maintained at this address, with notations on any transfers of Members' interests to nonmembers or persons being admitted into membership in the LLC. Copies of the LLC's Articles of Organization, a signed copy of this operating Agreement, and the LLC's tax returns for the preceding three (3) tax years shall be kept at the principal business address of the LLC. A statement also shall be kept at this address containing any of the following information that is applicable to this LLC; I. the amount of cash or a description and value of property contributed or agreed to be contributed as capital to the LLC by each Member; II. a schedule showing when any additional capital contributions are to be made by Members to this LLC; III. a statement or schedule, if appropriate, showing the rights of Members to receive distributions representing a return of part or all of Members' capital contributions; and IV. a description of, or date when, the legal existence of the LLC will terminate under provisions in the LLC's Articles of Organization, or this operating Agreement. If one or more of the above items is included or listed in this Agreement, it Will be sufficient to keep a copy of this Agreement at the principal business address of the LLC without having to prepare and keep a separate record of such item or items at this address. Any Member may inspect any and all records maintained by the LLC upon reasonable notice to the LLC. Copying of the LLC's records by Members is allowed, but copying costs shall be paid for by the requesting Member. C. All Necessary Acts: The Founding Members of this LLC are authorized to perform all acts necessary to perfect the organization of this LLC and to carry out its business operations expeditiously and efficiently. The Founding Members of the LLC may certify to other businesses, financial institutions and individuals as to the authority of one or more Members or officers of this LLC to transact specific items of business on behalf of the LLC. Page 11 of 14 D. Voting: Unless otherwise provided in this Agreement, all decisions requiring a vote of the Members shall require a majority of Members' votes to be approved. E. Mediation and Arbitration of Disputes Among Members: In any dispute over the provisions of this Agreement and in other disputes among the Members, if the Members cannot resolve the dispute to their mutual satisfaction, the matter shall be submitted to mediation. The terms and procedure for mediation shall be arranged by the parties to the dispute. If good-faith mediation of a dispute proves impossible or if an agreed-upon mediation outcome cannot be obtained by the Members who are parties to the dispute, the dispute may be submitted to arbitration in accordance with the rules of the American Arbitration Association. Any party may commence arbitration of the dispute by sending a written request for arbitration to all other parties to the dispute. The request shall state the nature of the dispute to be resolved by arbitration, and, if all parties to the dispute agree to arbitration, arbitration shall be commenced a soon as practical after such parties receive a copy of the written request. All parties shall initially share the cost of arbitration, but the prevailing party or parties may be awarded attorney fees, costs and other expenses of arbitration. All arbitration decisions shall be final, binding and conclusive on all the parties to arbitration, and legal judgment may be entered based upon such decision in accordance with applicable law in any court having jurisdiction to do so. F. Indemnification of Members: The Company shall indemnify, defend, and hold the Members, their respective partners, agents, directors, officers and shareholders and any Company employee or agent (each an "Indemnified Party") harmless from and against any loss, damage, fine, penalty, expense (including attorney's fees), judgment, or amount paid in settlement incurred by such Indemnified Party by reason of his, her or its performance or nonperformance of any act concerning the activities of the Company or in furtherance of the Company's interests or purposes; provided, however, that there shall be no indemnification in relation to matters as to which such Indemnified Party is adjudged of have been guilty of fraud, willful misconduct, or gross negligence. G. Entire Agreement: This Agreement represents the entire Agreement among the Members of this LLC, and it shall not be amended, modified or replaced except by a written instrument executed by all the parties to Page 12 of 14 this Agreement who are current Members of this LLC as well as any and all additional parties who became Members of this LLC after the adoption of this Agreement. This Agreement replaces and supersedes all prior written and oral Agreements among any and all Members of this LLC. H. Severabildy: If any provision of this Agreement is determined by a court or arbitrator to be invalid, unenforceable or otherwise ineffective, that provision shall be severed from the rest of this Agreement, and the remaining provisions shall remain in effect and enforceable. I. Notices: Any notice to be given or to be served upon any Member or any party hereto in connection with this Agreement must be in writing and will be deemed to have been given and received when deposited in the United States Mail by first class mail. Such notices will be given to a Member at the address specified in Section VIII.A. of this Agreement. Any Member or Company may, at any time by giving five (5) days prior written notice to the other Members and Company, designate any other address in substitution of the foregoing address to which such notice will be given. We have owned and operated this business for over 13 years. We are currently processing our plans through the City to expand our storage facility onto an adjoining one acre parcel we acquired for this purpose. We have expanded our facility twice over the past 13 years and each time met with the City planning department to discuss our plans before proceeding with the expansions. Since we were purchasing an additional parcel for this expansion we felt it was especially important to make sure the City would support our plan. So Gary mot with Armando and Linda at the City before we committed to purchase the property. We were told that this was a reasonable and acceptable use for this parcel and we could proceed with our plans for this expansion. During that meeting with the planning department we pointed out, and they agreed, that since the parcel of land is only 84 feet wide and 523 feet deep and is surrounded on three sides by existing development it would be virtually impossible to be used for anything other than the expansion of one of the adjoining projects. By the time the property line and street set backs were met there would be only a narrow strip down the center of this very long and narrow property that could be built out. This shape would certainly not lend itself to a commercial use. As a neighbor to this vacant parcel over the past 13 years, we have observed two brush fires and several incidents of vandalism and graffiti. Having this property developed would clearly be a benefit to the City as well as to the surrounding neighborhood. Our plan is to construct this expansion with the same style, design and materials used in our previous two expansions. Although many of the items mentioned in the last letter have been addressed, there are still other items that need to be shown. One of the main items that still needs to be fully addressed is the existing facility. The existing facility is a non-conforming use. Per Section 17.72.040 of the Lake Elsinore Municipal Code, a non-conforming use may not be expanded by more than 10%. You must show the entire existing facility including the floor area of the buildings as well as the area of the existing parcels. The other large issue is the right of way dedication. You will need to contact Ray O'Donnell, City Engineer, regarding the required dedication. The draft conditions of approval required a 30' dedication. You are only showing a 20' dedication. This inconsistency must be clarified before the project is scheduled for Planning Commission. In addition to the two main issues listed above, there are other items that still need to be shown and/or submitted. These items are listed below. Site Plan 1) Show the com lete existing storage facility on the site plan. Label the existing buildings, driveways, circulation pattern, office, and parking area. 2) Indicate the floor area of the existing facility as well as the area of the parcels. 3) Correct the existing zoning to show C-1 (Neighborhood Commercial). 4) Clarify the required right-of-way dedication with the Engineering Division. Pay all fees and meet requirements of an encroachment permit issued by the Engineering Division for construction of off-site public works improvements (LEMC12.08, Res.83-78). All fees and requirements for an encroachment permit shall be fulfilled before Certificate of Occupancy. 10. All compaction reports, grade certifications, monument certifications (with tie notes delineated on 8 1/2" x 11" mylar) shall be submitted to the Engineering Division before final inspection of off-site improvements will be scheduled and approved. 11. The applicant shall obtain all necessary off-site easements for off-site grading from the adjacent property owners prior to grading permit issuance. 12. Apply and obtain a grading permit with appropriate security prior to building permit issuance. A grading plan signed and stamped by a Calif. Registered Civil Engineer shall be required if the grading exceeds 50 cubic yards or the existing flow pattern is substantially modified as determined by the City Engineer. Subsequently,in 1998, the applicant requested an expansion. The existing facility is located on APN 379-250-010, -044, 045. It consists of nine storage buildings totaling 30,680 square feet of storage area. There is also a 1,800 square foot rental office and a 350 square foot mobile home for the caretaker. PROJECT DESCRIPTION Design Review The applicant intends to construct four new buildings totaling 21,150 square feet on an approximately 1-acre vacant property located directly adjacent to the existing facility. Buildings "B", "C", and"D" are attached. The sizes of the buildings are as follows: Building"A"is 6,650 s.f.,Building"B"is 5,000 s.f., Building"C" is 5,000 s.f., and Building"D" is 4,000 s.£ There will be 104 units ranging in size from 5' x 10' to 10'x30'. Conditional Use Permit Pursuant to Section 17.44.030 (N) of the Lake Elsinore Municipal Code, the Planning Commission can make the determination that a use is similar to uses allowed with a Conditional Use Permit in the Neighborhood Commercial Zoning District. DISCUSSION Fencing The applicant will be constructing a six-foot high block wall along the rear and side property line. A six-foot high block wall with pilasters will be constructed along the front property line. The plans show the block wall in line with the block wall along the front property of the existing facility. A condition (Condition No. 15) has been added to require that the block wall be placed on the property line after the right-of-way dedication required by the Engineering Division. This will set the block wall approximately 10' back from the existing block wall. This strip of land will be required to be landscaped and maintained by the property owner. ALMA ITEM NO.. The materials and colors will be consistent with the materials and colors of the existing facility. The proposed expansion will not be directly visible from the street. A decorative block wall will be constructed to provide security and conceal buildings form view. Conditional Use Permit The existing facility has been in operation for over 10 years. The expansion property is directly adjacent to the facility and is a rectangular shaped narrow & deep lot with approximate dimensions of 80' x 522'. This property has been vacant for a long time because it has been rendered as a difficult lot to construct on- specially a commercial use. The property is bounded by existing multi- family development on all sides. As can been seen, the narrowness and deepness of the site make it difficult for any other commercial use to be developed on the property. Although self storage facilities are not specifically listed as allowed uses in the C-1, Neighborhood Commercial District, it appears that a much preferred alternative to commercial development would be to consider a storage facility expansion because these uses are considered to generate low traffic counts and lower parking demands. In addition, the site has a very narrow street frontage hence offering restricted opportunities for street visibility if it were a commercial development. ANALYSIS Staff has found that the proposed project is in substantial compliance with all aspects of the development standards of the Lake Elsinore Municipal Code. This request is an expansion of an existing use. There will be a block wall and extensive landscaping provided along Lakeshore Drive to help screen the buildings from Lakeshore Drive. Based on the surrounding uses and the dimensions of the subject property, the expansion of the self-storage facility is a much better preferred alternative for development of the property. Therefore, staff is asking that the Planning Commission adopt a Resolution finding that this use is an acceptable use on this property. ENVIRONMENTAL DETERMINATION Pursuant to the California Environmental Quality Act, (CEQA), this project has been deemed exempt pursuant to Section 15332.b, Class 32, In-fill Development Developments that are less than five (5) acres in size.
