Nos 1983-665-687ORDINANCE N0. 665 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DECLARING THE NEED FOR AN INDUSTRIAL DEVELOPMENT AUTHORITY TO FUNCTION IN SAID CITY, AND DECLARING THE CITY COUNCIL OF SAID CITY TO ACT AS THE BOARD OF DIRECTORS OF THE AUTHORITY. WHEREAS, there exists within the City of Lake Elsinore, California (the "City"), economically distressed areas which may be benefited by efforts to prevent the loss of existing jobs and to create new jobs; and, WHEREAS, in the interest of the health, welfare and safety of the people of the City and of the State of California, it is necessary to provide an alternative method of financing certain facilities in order to prevent the loss of existing jobs and to increase employment opportunities and otherwise contribute to the economic development of such City; and, WHEREAS, the California Industrial Development Financing Act, California Government Code Sections 91500 et seq. (the "Act"), has created in the City a public corporate instrumentality of the State of California known as the "Industrial Development Authority of the City of Lake Elsinore" (hereinafter referred to as the "Authority"), for the purpose of exercising powers granted by the Act: and, WHEREAS, Section 91520 of the Act provides that said Authority shall not transact any business or exercise any powers under the Act unless, by ordinance, this City declares that there is a need for such Authority and that the Authority shall function. THE CITY COUNCIL OF THE CITY DOES ORDAIN AS FOLLOWS: SECTION 1. It is hereby found and declared that there is a need for the Industrial Development Authority of the City of Lake Elsinore created by Section 91520 of the Act, and that such Authority shall function in the City, and said Authority is hereby auth- orized to transact business and to exercise all powers permitted by law. SECTION 2. The City Council hereby further declares itself to be the Board of Directors of such Industrial Development Authority, and all the rights, powers, privileges, duties, liabilities, disabili- ties and immunities vested in such a Board under the Act shall be vested in the City Council as such Board. SECTION 3. Pursuant to Section 91520(b) of the Act, this Ordinance is subject to the provisions for referendum set forth in Sections 4051 through 4059 of the California Elections Code. SECTION 4. The City Clerk shall certify to the passage of this Ordinance, and shall cause this Ordinance to be published once within fifteen (15) days after its passage, in the Lake Elsinore Valley Sun Tribune, a newspaper of general circulation in the City of Lake Elsinore, California. SECTION 5. This Ordinance shall take effect thirty (30) days after its passage as provided by law. SECTION TWO: This ordinance shall take effect as provided by law. In the event the meter is removed, it will not be replaced nor will water service be reestablished until all delinquent charges have been paid, and the charge of $50.00 for removing and replacing the meter has been paid. B. If a meter has been removed, and a temporary jumper connection or other device has been installed without City authorization to obtain water for the premises served, the City may, at its option, conduct excavation to the City's water main and shut off the corporation cock at the point of connection of the service to the water main. The City will not resume service to such owner or premises until all delinquent amounts are paid, including the above mentioned charge for removing and replacing the meter, together with the actual cost of the City to excavate and restore the street in the event it is necessary to do so to shut off the corporation cock. SECTION TWO. This ordinance shall take effect as provided by law. II ', WHEREAS, the- Redevelopment Agency of the City of Lake Elsinore hereinafter referred to as the "Agency", has formulated. and prepared the proposed Redevelopment Plan for the Rancho Laguna Redevelopment Project No. II, hereinafter referred to as the "Redevelopment Plan"; and WHEREAS, the Planning Commission of the City of Lake Elsinore submitted its report and recommendation finding the said defined above Redevelopment Plan to be in conformity with the General Plan and recommending approval of said Redevelopment Plan; and r, WHEREAS, the Agency has adopted rules governing participation and rules for reasonable reentry preferences to property owners, and operators of businesses in the Rancho Laguna Redevelopment Project Area No. II; and WHEREAS, the Agency has adopted a Relocation Method which is to be extended to all , persons who may be caused to be displaced resulting from Agency acquisition of certain property; and WHEREAS, the Agency submitted to the City Council of the City of Lake Elsinore hereinafter referred to as the "City Council", said Redevelopment Plan; and WHEREAS, the Agency has submitted the Report to City Council accompanying the Redevelopment Plan to the City Council; and WHEREAS, that Report describes conditions of blight existing within the Project Area; and WHEREAS, after due notice, a Joint Public Hearing has been held by the Agency and the City Council; and WHEREAS, all actions required by law have been taken by all appropriate public agencies; and WHEREAS, after said joint public hearing, the Agency approved said Redevelopment Plan and recommended adoption of said Redevelopment Plan to the City Council. NOW THEREFORE, THE PEOPLE OF THE CITY OF LAKE ELSINORE, ORDAIN AS FOLLOWS: SECTION I. The purposes and .intent of the City Council with respect to the Rancho Laguna RedevelopmentProject Area, No. R hereinafter referred to as the 'Project Area" are: a. To eliminate and prevent the spread of physical and economical blight and deterioration by promoting and encouraging the revitalization or redevelopment of currently deteriorating or underutilized areas within the Project Area. b. To encourage new residential, industrial, and commercial development within the Project Area to provide additional housing, employment, and service opportunities. c. To provide needed public improvements in the Project Area. d. To provide for construction which in turn will provide short-term and long-term .employment opportunities for local residents. SECTION 2. The Redevelopment Plan for the Rancho Laguna Redevelopment Project No. II is hereby approved and adopted and designated as the official Redevelopment Plan for the Rancho Laguna Redevelopment Project Area No. II, and is incorporated herein by reference. SECTION 3. The City Council hereby finds and determines that: a. The Projeet Area is a blighted area for the reasons described in the Assessment of Conditions Report, evidence and testimony presented at the public hearing, and the Report to the City Council accompanying the Redevelopment Plan, the redevelopment of which is necessary to effectuate the public purposes declared in the California Health and Safety Code, Section 33000 et seq.; b. The Redevelopment Plan will redevelop the Project Area in conformity with the California Health and Safety Code, Section 33000 et seq. in the interests of the public peace, health, safety, and welfare; c. The adoption and carrying out of the Redevelopment Plan is economically sound and feasible; d. The Redevelopment Plan conforms to the General Plan of the City of Lake Elsinore; _._ _ _ . - 2 - e. The carrying out of the Redevelopment Plan will promote the public peace, health, safety, and welfare of the City of Lake Elsinore and will effectuate the purposes and policies of the California Health and Safety Code, Section 33000 et seq.; f. The condemnation of real property, as provided for and limited in the Redevelopment Plan, is necessary to the execution of the Redevelopment Plan .and adequate provisions have been made for payment for property to be acquired as required by law; g. The Agency has a feasible method for the relocation of families and persons who are temporarily or permanently displaced from facilities in the Project Area; h. There are or are being provided in the Project Area or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons displaced from the Project Area, decent, safe, and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to their places of employment. i. All noncontiguous areas in the Project Area are either blighted or necessary for effective redevelopment and are not included for the purpose of obtaining the allocation of taxes from such area pursuant to Section 33670 without other substantial justification for their inclusion. j. Inclusion of any land, buildings, or improvements which are not detrimental to the public health, safety, or welfare is necessary for the effective redevelopment of the area of which they are a part; that any such area included is necessary for effective redevelopment and is not included for the purposes of obtaining the allocation of tax increment revenues from such area pursuant to Health and Safety Code, Section 33670, without other substantial justification for its inclusion. k. The elimination of blight and the redevelopment of the Project Area cannot be reasonably expected to be accomplished by private enterprise acting alone without the aid and assistance of the Agency. SECTION 4. The City Council is satisfied permanent housing facilities will be available within three years from the time occupants of the Project Area are displaced and that pending the development of such facilities, there will •be available to such displaced occupants adequate temporary housing facilities at rents comparable to those in the City of Lake Elsinore at the time of their displacement. No persons or families of low and moderate income shall be displaced from residences unless and until there is a suitable housing unit available and ready for occupancy by such displaced person or family at rents comparable to those at the time of their displacement. Such housing units shall be suitable to the needs of such displaced persons or families and must be decent, safe, sanitary, and otherwise standard -3- dwellings. The Agency shall not displace such person or family until such housing units are available and ready for occupancy. SECTION 5. The Redevelopment Plan for the Rancho Laguna Redevelopment Project Area No. II provides for the expenditure of money by the City of Lake Elsinore in carrying out the Redevlopment Plan, and authorizes the City to financially assist the Agency by way of loans, grants, or other financial assistance. The City Council hereby provides that such financial assistance to the Agency shall be made from time to time as the City Council shall determine to be necessary, and that all such financial assistance shall be deemed to be loans to the Agency based on terms to be established by an agreement between the City and Agency, unless the City Council shall provide in specific cases that such assistance shall be treated other than as a loan. SECTION 6. In .order to implement and facilitate the effectuation of the Redevelopment Plan hereby approved and adopted, it is found and determined that certain official actions must be taken by the City Council with reference, among other things, to changes in zoning, the location and relocation of sewer and water mains and other public facilities and other public action, ._ and accordingly, the City Council hereby: a. Declares its intention to undertake and complete any proceedings necessary to __ be carried out by the City of Lake Elsinore under the provisions of the Redevelopment P lan; and b. Requests the various officials, departments, boards, and agencies of the City of Lake Elsinore having administrative responsibilities for the City likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with the Redevelopment Plan. SECTION 7. The City Council is convinced that the effect of tax increment financing will not cause a severe financial burden or detriment on any taxing agency deriving revenues from the Project Area. SECTION 8. All written and oral objections to the Redevelopment Plan hereby are overruled. SECTION 9. The City Clerk hereby is directed to send a certified copy of this ordinance to the Agency, and the Agency is hereby vested with the responsibility for carrying out the Redevelopment Plan. _4_ I _.- SECTION 10. The City Clerk hereby is directed to record with the County Recorder of Riverside County a description of the land within the Project Area and a statement that the proceedings for the redevelopment of the Project Area have been instituted under the California Health and Safety Code, Section 33000 et seq. The Agency hereby is directed to effectuate recordation in compliance with the provisions of Section 27295 of the Government Code to the extent applicable. SECTION 11. The Community Development Department through the Building and Safety Division is hereby directed fora period of two years after the effective date of this ordinance to advise all applicants for building permits within the Project Area that the site for which a building permit is sought for the construction of buildings or for other improvements is within a Redevelopment Project Area. SECTION 12. Zone 1 - Businesses licensed under the "general" classifica- tion by the City will pay two times their 1983 annual busi- ness license fee. This includes retail sales, general service, peddlers, auctions, clubs and telegraph companies. All other businesses in Zone 1 will pay one time their 1983 annual business license fee. Zone 2 - Businesses licensed under the "general" classifica- tion by the City will pay one time their 1983 annual business license fee. All other businesses in Zone 2 will pay one half their 1983 annual business fee. SECTION 6. The City Council of the City of Lake Elsinore further declares that a Parking and Business Improvement Area is hereby estab- lished. SECTION 7. On December 14, 1982, the City Council passed and approved Resolution No. 82-83, adopting a comprehensive General Plan. 2. Due to a change in personnel, fiscal constraints, and the press of other City business, Staff has not yet proposed a comprehensive City-wide rezoning ordinance to bring current zoning c, in compliance with the new General Plan. 3. There are now pending projects and contemplated projects which are permitted. uses under the current zoning ordinances, which projects are not consistent with the General Plan designations for the subject areas. 4. In view of the foregoing, the City Council of the City of Lake Elsinore hereby finds and determines that there is a current and immediate threat to the public health, safety, or welfare, and that the approval of additional subdivisions, rezonings, land use permits, variances, building permits, or any other applicable entitlement for use which is required in order to comply with current zoning ordinances would result in a threat to the public health, safety, or welfare. SECTION TWO. Pursuant to Government Code Section 65858, all uses which ~'- may be in conflict with the contemplated City-wide rezoning proposal to bring current City zoning into compliance with General Plan designation are prohibited. SECTION THREE. The determination as to whether or not a proposed use may J ~ _ '. .. be in conflict shall be initially made by the Staff member, Board or Commission processing such proposal. SECTION FOUR. Any person aggrieved by the Staff determination shall have the right of administrative appeal to the City Manager, upon filing ,a written request therefor within thirty days of such determination. Any person aggrieved`by the determination of the City Manager or a Board or Commission shall have the right of administrative appeal to the City Council, upon filing a written request therefor within thirty days of the determination. SECTION FIVE. It is recognized that instances may arise. where there are minor inconsistencies between the proposed use and the General Plan designation. In such circumstances, the Staff member, Board or Commission is directed to consider the relative importance of the proposed use and the General Plan designation,-and in situations where the inconsistency is minor and the overall benefit to the City is demonstrated, the proposed use may be approved as the General Plan has been designed to have sufficient flexibility to permit the City to emphasize those goals which provide the greatest public benefit in any given situation. SECTION SIX. Because of the temporary nature of this ordinance, and any extensions of this ordinance, it need not be included in the Lake Elsinore Muhicipal Code. SECTION SEVEN. This ordinance shall take effect immediately upon passage by a four-fifths vote. of the City Council and shall be of no further force and effect forty-five days from its date of adoption, unless previously repealed or extended. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodic investigation and v - uation required by said Retirement Lax. 1 11. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within thirty days after the end of the period to which said contributions refer or as may be prescribed by Board regulation. There is hereby added to the Lake Elsinore Municipal Code Chapter 8.48, Mosquitoes, which is to read as follows: 8.48.010 Public Nuisance. The .City Council hereby finds, determines and declares that any breeding place for mosquitoes which exists by reason of any use made of the land on which it is found or of any artificial change in its natural condition is a public nuisance. 8.48.020 Abatement Remedies. The nuisance may be abated in any manner provided in this chapter, in any action or proceeding at law, or by any other remedy provided by law for the abatement of a nuisance. 8.48.030 General Powers. In addition to all other powers, authority and rights retained, held or otherwise possessed by the City of Lake Elsinore, the City through its officers and employees, ar3d without limitation by ennumeration, may: A. Take all necessary or proper steps for the extermination of mosquitoes in the City limits; B. Abate as nuisances stagnant pools of water and other breeding places for mosquitoes in the City limits; C. Enter upon any private or public lands, within the City limits, for the purpose of.inspection to ascertain whether breeding places of mosquitoes exist upon such lands after a reasonable attempt has been made to notify the owner or person in charge or in possession of said property of the intent to enter and inspect; or to abate or reduce public nuisances in accordance with this chapter; or to ascertain if notices to abate the breeding of mosquitoes upon such lands have been complied with; or to treat with oil or other larvicidal material any breeding places of mosquitoes upon .such lands; D. Do any and all things necessary or incident to the powers granted by this chapter or otherwise existing in the City, and do any and all things necessary or incident to carry out the objects specified in this chapter; provided, however, all. entries upon said property, all postings of notices, all inspections, and. all work performed by the City, its officers or employees, shall be done during the daylight hours. 8.48.040 Notice to Abate Nuisance. Whenever a nuisance specified in this chapter exists upon any property within the City, the notice to abate the nuisance shall be issued for the purpose of notifying the record owner, or person in charge of or in possession of the property, of the existence of the nuisance. The notice shall direct that the owner shall, within a period of ten days, abate the huisance by destroying the larvae or pupae that are present or by draining or removing the water, which abatement shall include any work that may be necessary to prevent the recurrence of breeding in the places specified in the notices. Notices served by means other than posting as provided by this chapter shall contain a description of the property in general terms reasonably sufficient to identify the location of the nuisance. The notice shall also contain the provisions of Section 8.48.060. 8.48.050 Service of Notice. The notice required by Section 8.48.040 shall be served as follows: A. By personal service on the owner or person in charge or in possession of the property; or B. By certified mail, addressed to the owner or person in charge or in possession of the property, to his address as given on the most recent equalized assessment roll of the County of Riverside, or, in the absence of an address on said roll, to his last known address, and by posting a copy of said notice in a conspicuous place upon the property for a period of ten days. 8.48.060 Appeal and Conclusion Establishment of Nuisance. Within ten days from the date of completion of posting and mailing, or within ten days from the date of personal service, of the notice required by Section 8.48.040, the owner or person in charge of or -2- in possession of the property affected by such notice may appeal to the City Council for a hearing to determine whether or not the nuisance described in this chapter exists. Such appeal shall be in writing and shall be filed with the City Clerk. At the next regular meeting, or adjourned regular meeting, the City Council shall proceed to hear and pass upon such appeal, and the decision of the City Council thereupon shall be final and conclusive. In the event the owner or person in charge of or in possession of the property affected by such notice fails to so appeal, the existence of the nuisance described in the notice shall be conclusively established. 8.48.070 Time Limit for Compliance. Within ten days from the date of completion of posting and mailing, or within ten days from the date of personal service, of the notice required by Section 8.48.040, or, in the case of an appeal to the City Council, within ten days from the determination by the City Council that the nuisance described in this chapter exists, the owner or person in charge of or in possession of the property affected by such notice shall abate the nuisance. 8.48.080 Abatement by City. In the event the owner or person in charge of or in possession of the property affected by such notice fails to abate the nuisance within the time specified in Section 8.48.070, the City shall cause abatement of the nuisance by destroying the larvae or pupae or, by other acceptable treatment, reduce or eliminate the nuisance and may further take appropriate action to prevent recurrence of further breeding. 8.48.090 Payment of Cost by Owner-Lien on Property. In the event the cost of abatement or reduction of a nuisance exceeds $25.00, said cost shall be repaid by the owner or person in charge of or in possession of the property. All repayments not received by the City within forty-five days after billing by the City shall be deemed unpaid and delinquent. All unpaid sums expended by the City in abating or reducing a nuisance or preventing its recurrence shall become a lien upon the real property on which the nuisance is abated or reduced, or its recurrence prevented, as hereinafter provided in this chapter. -3- 8.48.100 Report-Account of Unpaid Costs-Hearing-Notice. A report of the proceedings and an accurate account of the unpaid costs of abatement, reduction or prevention of recurrence, of the nuisance on each separate property shall be filed with the City Clerk. The City Clerk shall thereupon set the report and account for hearing by the City Council at the next regular or adjourned regular meeting which shall be held at least seven calendar days after the date of filing, and shall post a copy of such report and account and notice of the time and place of hearing in a conspicuous place at or near the entrance of City Hall, and additionally give notice of the date and time of the hearing to the owner or person in charge of or in possession of the property in the manner provided by Section 8.48.050. 8.48.110 Hearing Procedure-Liens. The City Council shall consider the report and account at the time set for the hearing, together with any objections or protests by any interested parties. Any owner of land or person interested therein may present a written or oral protest or objection to the report and account. At the conclusion of the hearing, the City Council shall either approve the report and account as submitted or as modified or corrected by the City Council. The amounts so approved shall become liens upon the respective real property, and the City Council shall adopt a resolution assessing such amounts as liens upon the respective real property and declaring that such abatement costs were proper for abatement of an existing public nuisance arising out of mosquito breeding conditions. 8.48.120 Recording Resolution Assessing Costs. The City Clerk shall prepare and record with the County of Riverside a certified copy of the resolution of the City Council assessing the costs of abatement as a lien upon the real property affected. 8.48.130 Collection of Costs Prior to Hearing. The City may accept payment of any amount due at any time prior to the City Council hearing provided for in Section 8.48.100. 8.48.140 Assessment Entered-Collection-Delinquency. The County of Riverside shall enter each assessment on the County tax roll for each affected parcel of real property. The amount of the assessment shall be collected at the time and in the manner of -4- ordinary municipal taxes. If delinquent, the amount is subject to the same penalties and procedure of foreclosure and sale provided for ordinary municipal taxes. Laws relating to levy, collection, and enforcement of County taxes shall also apply to assessments under this chapter. 8.48.150 Exemption. The lien provisions of this chapter do not apply to property of any county, city, district or other public agency. 8.48.160 Prohibited Acts. Any person who obstructs, hinders, or interferes with the entry upon land mentioned in this chapter of any officer or employee of the City in the performance of his duty and any person who obstructs, interferes with, molests, or damages any work performed by the City under this chapter, is guilty of a misdemeanor. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION ONE. 1. On December 14, 1982, the City Council passed and approved Resolution No. 82-83, adopting a comprehensive General Plan. 2. Due to a change in personnel, fiscal constraints, and the press of other City business, staff has not yet proposed a comprehensive City-wide rezoning ordinance to bring current zoning in compliance with the new General Plan. 3. There are now pending projects and contemplated projects which are permitted uses under the current zoning ordinances, which projects are not consistent with the General Plan designations for the subject areas. 4. On September 27, 1983, the City Council adopted an urgency interim zoning ordinance pursuant to Government Code Section 65858(a), which ordinance will expire November 11, 1983 by its own terms, and according to Government Code Section 65858(a). 5. On October 25, 1983, the City Council issued its written report describing the measures taken to alleviate the condition which led to the adoption of the urgency interim zoning ordinance, and although some progress has been made to completing the proposed comprehensive City-wide zoning ordinance, much work remains to be done. 6. A properly noticed public hearing was held on November 8, 1983, as required by Government Code Section 65858(a). 7. In view of the foregoing, the City Council of the City of Lake Elsinore hereby finds and determines that there is a current and immediate threat to the public health, safety, or welfare, and that the approval of additional subdivisions, rezonings, land use permits, or any other applicable entitlement for use which is required in order to comply with current zoning ordinances would result in a threat to the public health, safety, or welfare. SECTION TWO. Pursuant to Government Code Section 65858, all uses which may be in conflict with the contemplated City-wide rezoning proposal to bring current City zoning into compliance with General Plan designation are prohibited. SECTION THREE. The determination as to whether or not a proposed use may be in conflict shall be initially made by the Staff member, Board or Commission processing such proposal. SECTION FOUR. Any person aggrieved by the Staff determination shall have the right of administrative appeal to the City Manager, upon filing a written request therefor within thirty days of such determination. Any person aggrieved by the determination of the City Manager or a Board or Commission shall have the right of administrative appeal to the City Council, upon filing a written request therefor within thirty days of the determination. SECTION FIVE. It is recognized that instances may arise where there are minor inconsistencies between the proposed use and the General Plan designation. In such circumstances, the Staff member, Board or Commission is directed to consider the relative importance of the proposed use and the General Plan designation, and in situations where the inconsistency is minor and the overall benefit to the City is demonstrated, the proposed use may be approved as the General Plan has been designed to have sufficient flexibility to permit the City to emphasize those goals which provide the greatest public benefit in any given situation. SECTION SIX. Because of the temporary nature of this ordinance, and any extensions of this ordinance, it need not be included in the Lake Elsinore Municipal Code. SECTION SEVEN. Ordinance No. 681 is hereby repealed. SECTION EIGHT. This ordinance shall take effect immediately upon passage by a four-fifths vote of the City Council and shall be of no further force and effect ten months and fifteen days from its date of adoption, unless previously repealed or extended.
