ORDINANCE NO. 616 AN ORDINANCE OF THE CITY OF LAKE ELSINORE, CALIFORNIA ADDING CHAPTER 10.18 (Handicapped Parking) TO THE LAKE ELSINORE MUNICIPAL CODE PROHIBITING VEHICULAR PARKING IN SPACES DESIGNATED EXCLUSIVELY FOR PHYSICALLY HANDI- CAPPED PERSONS; PROVIDING FOR ENFORCEMENT OF CERTAIN SECTIONS OF THE CALIFORNIA VEHICLE CODE ON PRIVATE PROPERTY; PROVIDING FOR THE REMOVAL OF ILLEGALLY PARKED VEHICLES; AND PROVIDING FOR PUNISHMENT OF VIOLATORS AS AN INFRACTION The City Council of the City of Lake Elsinore, California does ordain as follows: SECTION 1. There is hereby added to the Lake Elsinore Municipal Code, Chapter 10.18 (Handicapped Parking) which is to read as follows: Section 10.18.010. The City of Lake Elsinore recognizes the numerous hardships of physically handicapped persons, and finds that vehicle parking spaces and stalls, both on public and private facilities, exclusively for the use of such persons are proper and necessary, and in the best interests of the citizens of the .City of Lake Elsinore. Section 10.18.020. The City Manager is authorized, subject to City Council direction, to designate certain vehicular parking spaces on public streets for the exclusive use of handicapped persons by designating such parking spaces by blue paint on the curb ox edge of the paved portion of the street adjacent to the space, and in addition to blue paint, the space may also be indicated to be -1- exclusively for the use of handicapped persons by signs or other suitable means. Section 10.18.030. The City Manager is authorized, subject to City Council direction, to designate certain vehicular parking spaces or stalls on off-street parking facilities owned or operated by the City, for the exclusive use of handicapped persons by designating such off-street parking spaces or stalls with a sign consisting of a profile view of a wheelchair with occupant in white on a blue background. Section 10.18.040. The City Council of the City of Lake Elsinore finds and declares that there are privately owned and maintained off-street ' parking facilities within the City of Lake Elsinore, which shall be described and designated by Resolution, which facilities are generally held open for the use of the public fox purposes of vehicular parking. As to such facilities, in addition to prohibition against parking of leaving standing any vehicle in a space or stall designated fox physically handicapped persons unless such vehicle has either one of the distinguishing license plates or placards issued pursuant to Section 22511.5 of the California Vehicle Code or Section 9105 of the California Vehicle Code, Sections 22350, 23103, 23109 and the provisions of Division 16.5 (commencing with Section 38000) of the California Vehicle Code shall apply to each such facility, except as provided by law. Section 10.18.050. No person shall park or leave standing any vehicle in a stall or space designated for physically handicapped persons - 2- unless the vehicle displays either one of the distinguishing license plates or placards issued pursuant to Section 22511.5 of the California Vehicle Code or Section 9105 of the California Vehicle Code. Section 10.18.060. Violation of Lake Elsinore Municipal Code Section 10.18.050 shall constitute an infraction, and shall be punished as provided by Sections 42001 and 42001.5 (b) of the California Vehicle Code. Section 10.18.070. In accordance with and pursuant to Section 22511.8 of the California Vehicle Code, the City, as to any publicly owned and operated parking facility, and the owner or person in lawful possession of any privately owned off-street parking facility, may cause the removal, from a stall or space designated for physically handicapped persons to the nearest public garage, of any vehicle not displaying either one of the distinguishing license plates or placards issued pursuant to Section 22511.5 of the California Vehicle Code or Section 9105 of the California Vehicle Code. Section 1 of Ordinance 117 and Section 9.88.010 of the Lake Elsinore Municipal Code are amended to read as follows: It is unlawful for any person or persons to fire any shotgun, pistol, revolver or rifle within the incorporated limits of the city, as shown on the official map of the city on file in the office of the city clerk, with the exception of any officer or special officer of the city, county or state in the line of duty or on a pistol range, rifle range, skeet or trap range having a proper special permit and current business license as provided by law. Published Notice. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION ONE. There is hereby added to the Lake Elsinore Municipal Code Chapter 17.39 low density residential district and the following sections: Section 17.39.010 Purpose. To implement the open space action program required by the General Plan, a low density residential district is hereby established, to allow certain areas of the City to retain their natural beauty, rural character, and to provide for the proper development of such lands. Section 17.39.020 Permitted Uses. Uses permitted in the low density residential district shall be as follows: A. One family dwellings. of a permanent character and which shall not be less than eight hundred fifty square feet in area, each placed in a permanent location; B. Agricultural and horticultural uses including disposition of only crops produced upon the premises provided no signs, displays, or stands are used in conjunction with such disposition. Commercial animal husbandry shall not be permitted nor considered a part of agricultural or horti- cultural uses. Commercial animal husbandry includes raising or keeping of more than a total of twelve rabbits and chickens and other small animals or fowls, but no roosters, and shall conform to Ordinance No. 590 and Lake Elsinore Municipal Code Section 17.68.190 regarding the keeping of large animals; C. Usual accessories in connection with oermi 1 of at least one, but not more than four automobiles for each dwelling 2 established on the same lot; 3 D. Only the following signs shall be permitted: 4 1. Only one nameplate, lighted, if desired, and not exceeding 5 one and one-half square feet in area, which shall be located on the building 6 or against the building or against the building, or not less than ten feet 7 (10') from any property line. $ 2. One or more signs, none of which shall be lighted or have 9 an area of more than four (4) square feet, and said signs shall pertain 10 only to the prospective lease or sale of only the property on which they 11 are located, or bear only a legal notice involving said property. 12 Section 17.39.030 Building Height. 13 No building shall exceed thirty-five (35) feet nor more than two 14 (2) stories. 15 Section 17.39.040 Lot Area - Minimum. 16 The minimum area of a parcel of land shall be two (2) acres. 17 Section 17.39.060 Lot Width. 18 Each lot shall be not less than fifty (50) feet in width whether 19 it shall front upon a street cul-de-sac. curved or straight street. The 20 fifty (50) feet width shall also be utilized as a minimum overall lot width. 21 Section 17.39.070 Area Between Buildings - Accessory Buildings. 22 Accessory buildings may be established in the rear yard provided 23 they are at least twenty-five (25) feet from the main building and ten (10) 24 feet from each other, but shall not cover more than 10 per cent (10%) of the 25 lot area. 26 Section 17.39.090 Yard Requirements. 27 The following yards shall be provided and maintained: 28 A. Basch, Deputy City Clerk (SEAL) ORDINANCE NO. 621 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA IDENTI- FYING DEVELOPMENT STANDARDS FOR SINGLE- FAMILY UNITS CONSTRUCTED WITHIN THE CITY. 1 2 The City Council of the City of Lake Elsinore, 3 California does ordain as follows: 4 SECTION ONE: 5 Section three of Ordinance No. 612 which states "A. Single- g family residential units on lots zoned for single family ry residences which shall comply with the current resolution g establishing the requirements for such exception", is g hereby repealed. 10 SECTION TWO: 11 17,14.010 Purpose. In order to allow for the expansion 12 of decent, safe, and affordable housing, the City of Lake 13 Elsinore in compliance with California State law, hereby 14 establishes the following provisions affecting all single- 15 family dwellings built or placed in the City of Lake 16 Elsinore. 17 17.14.020 Establishing Mobilehomes. This ordinance 1$ shall allow mobilehomes and/or manufactured homes to be 19 built within any zoning district which allows single- 20 family dwellings for the purpose of habitation. In all 21 zoning districts which allow single-family dwellings, 22 mobilehomes and/or manufactured homes must meet the 23 requirements established for single-family dwellings as 24 required by various ordinances presently utilized by the 25 City of Lake Elsinore. 26 17,14.030 Criteria. The following criteria shall 27 apply to all single-family dwellings built in any zoning 28 district. 29 A. Single-family dwellings must be attached to a ], B. All single-family dwellings shall be required t4 have a roof overhang of at least 16 inches 2 on the long sides of the structure. 3 C. All single-family dwellings shall establish a roof pitch of at least 4 inches in 12 inches. 4 D. All single-family dwellings are hereby required $ to use roofing and siding materials customarily used in conventional housing excluding non- g textured metallic, or shiny aluminum. 7 E. Specifications of materials and plans proposed for use shall be presented to the Design Review 8 Board for. approval at the time plans are pre- sented. 9 F. All single-family residences shall conform to 10 any current resolution establishing require- ments for. such development. 11 G. The National Manufactured Housing Construction 12 and Safety Standards Act of 1974 shall be used to govern the construction, design and per- 13 formance of manufactured homes or mobilehomes built in the United States since June 15, 1976. 14 H. Appeal. If the Design Review Board does not 15 approve the application, or requires conditions which: the applicant believes are Not necessary 16 to achieve compatibility with the Neighborhood, he may appeal to the Council within 15 days 17 following the mailing of the final decision by the Design. Review Berard by filing a letter with 18 the City Clerk stating the reasons why he believes the action to be improper. The City 19 Clerk shall cause 'the appeal to be set for hearing at a regular meeting of the Council, 20 held not less than 13 nor more than 30 days after receiving the appeal and shall mail or 21 deliver written notice of the hearing to the Design Review Board and to the applicant or 22 permittee at least 1Q days before the hearing. F23 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA AMENDING AND ADDING PROVISIONS TO ORDINANCE 582 AND LAKE ELSINORE MUNICIPAL CODE CHAPTER 8.16 CONCERNING GARBAGE AND WASTE COLLECTION THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES ORDAIN AS FOLLOWS: SECTION ONE. Section One of Ordinance 582 and Lake Elsinore Municipal Code Section 8.16.090 are amended to include a new paragraph to read as follows: Bills for garbage and waste matter collection and disposal shall be due and payable as of the date of mailing and shall be delinquent thirty (30) days thereafter. Payment shall be in the form provided for water bills, Lake Elsinore Municipal Code Section 13.10.020. The failure to pay a delinquent bill within ten (10) days after such delinquency occurs shall result in the City discontinuing any and all service for which the bill is rendered, including, but not limited to, water service provided under Title 14, Lake Elsinore Municipal Code. SECTION TWO. There is hereby added to Lake Elsinore Municipal Code Section 8.16.120 to read as follows: The City may collect delinquent bills for garbage and waste matter collection and disposal by civil action in court, and/or pursuant to Section 54354 of the Government Code, the City may cause or unpaid charges to be recorded as provided by law and thereafter to constitute a lien upon the real property served until following: A. Aspects of solid waste handling which are of local concern including, but not limited to, frequency of collection, means of collection and transportation, level of service, charges and fees, nature, location, and extend of providing solid waste handling services; B. Whether such services are to be provided by means of nonexclusive franchise, contract, license, permit, or otherwise, either or without competitive bidding, or, if in the opinion of the City Council, the public health, safety and well being so require, by partially exclusive or wholly exclusive franchise, contract, license, permit, or otherwise, either with or without competitive bidding. SECTION FOUR. There is hereby added to Lake Elsinore Municipal Code Section 8.16.140 to read as follows: No business license shall be issued to permit garbage and waste matter collection and disposal to be conducted within the City of Lake Elsinore until a permit is first issued therefor by the City Council. SECTION FIVE. This ordinance shall take effect as provided by law. PORTER, City Attorney ORDINANCE N0. 624 AN ORDINANCE OF THE CITY OF LAKE ELSINORE, CALIFORNIA APPROVING AND ADOPTING THE REDEVELOPMENT PLAN FOR THE RANCHO LAGUNA REDEVELOPMENT PROJECT, AN AMENDMENT TO REDEVELOPMENT PROJECT I. 1 WHEREAS, the Redevelopment Agency of the City of Lake Elsinore, 2 hereinafter referred to as the "Agency," has formulated and prepared the 3 proposed Redevelopment Plan for the Rancho Laguna Redevelopment Project, an 4 amendment to Redevelopment Project I, hereinafter referred to as the 5 "Redevelopment Plan;" and 6 WHEREAS, the Planning Commission of the City of Lake Elsinore 7 submitted its report and recommendation finding the said proposed Redevelop- g ment Plan to be in conformity with the General Plan and recommending approval 9 of said proposed Redevelopment Plan; and 10 WHEREAS, the Agency has adopted rules governing participation 11 and rules for reasonable reentry preferences to property owners, operators 12 of businesses and tenants in the Project Area; and 13 WHEREAS, the Agency has adopted a method for relocation which 14 is to be extended to all persons who may be caused to be displaced resulting 15 from Agency acquisition of certain property; and 16 WHEREAS, the Agency submitted to the City Council of the City of 1~ Lake Elsinore, hereinafter referred to as the "City Council," said proposed lg Redevelopment Plan; and 19 WHEREAS, the Agency has submitted the Report of City Council 20 accompanying the Redevelopment Plan to the City Council; and 21 WHEREAS, specific conditions of blight existing within the 22 Project Area have been identified; and 23 WHEREAS, after due notice, a joint public hearing has been held 24 by the Agency and the City Council; and 25 WHEREAS, the Agency has exempted by resolution all residentially 26 zoned properties in the Rancho Laguna Redevelopment Project from condem- 27 nation; and no InINFRFAC_ all artinnc ranuira~ by law have been taken by all 1 NOW, _ ___ _ THEREFORE, THE PEOPLE OF THE CITY OF LAKE ELSINORE ORDAIN 2 AS FOLLOWS: 3 SECTION 1. The purposes and intent of the City Council with 4 respect to the Project Area are: 5 (a) To provide the framework within which restoration of the economic health of the Project Area and its environment will 6 be accomplished by both public and private actions. ~ (b) The elimination and/or prevention of the spread of blight and deterioration, and the conservation, rehabilitation, 8 renewal and redevelopment of the Project Area to the extent permitted by law and specified in the Redevelopment Plan. 9 (c) The removal of unsightly, substandard and nonconforming 10 structures which may be deterring the return of the Project Area to an economically viable use. it (d) The elimination of certain environmental deficiencies, 12 including among others, incompatible and non-conforming land uses, substandard streets, lack of and deteriorated 13 public improvements. 14 (e) To promote a productive use of land within the guidelines established by the City's General Plan. 15 (f) The provision of land for public uses and facilities. 16 (g) To obtain maximum benefit and utilization of the City's 17 limited financial resources by the timely provision of necessary public improvements and facilities. 18 (h) To create an aesthetically pleasing and functionally 19 efficient living and working environment through encourage- ment, guidance and appropriate standards and controls. 20 (i) The preservation of areas and buildings determined to be of 21 historical or archeological value. 22 (j) To preserve and expand the City's property tax base. 23 (k) To expand the employment opportunities for the unemployed and underemployed. 24 (1) To provide additional housing opportunities, where feasible, 25 for all segments of the community. 26 SECTION 2. The Redevelopment Plan is hereby approved and adopted 27 and designated as the official Redevelopment Plan for the Rancho Laguna 04 n_~_.._,__..__._i n.__a__~. n.___ __ _..__._~__._i i_ n_~_.._, _.___~~. n.__a.. _.~ n._..., t 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 necessary to effectuate the public purposes declared in the California Health and Safety Code, Section 33000 et seq.; (b) The Redevelopment Plan will redevelop the Project Area in conformity with the California Health and Safety Code, Section 33000 et seq. in the interests of the public peace, health, safety and welfare; (c) The adoption and carrying out of the Redevelopment Plan is economically sound and feasible; (d) The Redevelopment Plan conforms to the General Plan of the City of Lake Elsinore; (e) The carrying out of the Redevelopment Plan will promote the public peace, health, safety and welfare of the City of Lake Elsinore and will effectuate the purposes and policies of the California Health and Safety Code, Section 33000 et seq.; (f) The condemnation of real property, except all residentially zoned properties in the Project Area, as provided for in the Redevelopment Plan, is necessary to the execution of the Redevelopment Plan and adequate provisions have been made for payment for property to be acquired as required by law; (g) The Agency has a feasible method and plan for the relocation of families and persons to be temporarily or permanently displaced from facilities in the Project Area; (h) There are or are being provided in the Project Area or in other areas not generally less desirable in regard to public utilities, public and commercial facilities and at rents or prices within the financial means of the families and persons displaced from the Project Area, decent, safe and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to their places of employment. (i) The noncontiguous areas of the Project Area are either blighted or necessary for effective redevelopment and are not included for the purpose of obtaining"the allocation of taxes from such areas pursuant to Section 33670 without other substantial justification for their inclusion. (j) Inclusion within the Project Area of any land, buildings, or improvements which are not detrimental to the public health, safety or welfare is necessary for the effective redevelopment of the Project Area; any such area included is necessary for effective redevelopment and is not included for the purposes of obtaining the allocation of tax incremenl revenues from such area pursuant to Health and Safety Code, Section 33670, without other substantial justification for its inclusion. 1 the Project Area are displaced and that pending the development of such 2 facilities, there will be available to such displaced occupants adequate 3 temporary housing facilities at rents comparable to those in the City of 4 Lake Elsinore at the time of their displacement. No persons or families of ~ 5 low and moderate income shall be displaced from residences unless and 6 until there is a suitable housing unit available and ready for occupancy 7 by such displaced person or family at rents comparable to those at the 8 time of their displacement. Such housing units shall be to the needs of 9 such displaced persons or families and must be decent, safe, sanitary, I 10 and otherwise standard dwellings. The Agency shall not displace such 11 person or family until such housing units are available and ready for 12 occupancy. 13 SECTION 5. The City Council is convinced that the effect of 14 tax increment financing will not create a severe financial burden or 15 detriment on any taxing agency deriving revenues from the Project Area. 16 SECTION 6. The Redevelopment Plan provides for the expenditure 17 of money by the City of Lake Elsinore in carrying out the Redevelopment Plan, 18 and authorizes the City to financially assist the Agency by way of loans, 19 grants, or other financial assistance. The City Council hereby provides 20 that such financial assistance to the Agency shall be made from time to time 21 as the City Council shall determine to be necessary, and that all such 22 financial assistance shall be deemed to be loans to the Agency, based on 23 terms to be established by an agreement between the City and Agency, unless 24 the City Council shall provide in specific cases that such assistance shall 25 be treated other than as a loan. 26 SECTION 7. In order to implement and facilitate the effectuation 27 of the Redevelopment Plan hereby approved and adopted, it is found and nn a,.+,,,,,,,,; ,,,,a +N~+ ....~+~;., .. ~FO; ..;el oc+;.,nc o,~~c+ ho +o4on by tho fi+v fniinril 1 proceedings necessary to be carried out by the City of Lake Elsinore under the provisions of the Redevelopment Plan; and 2 (b) Requests the various officials, departments, boards, and 3 agencies of the City of Lake Elsinore having administrative responsibilities for the City likewise to cooperate to 4 such end and to exercise their respective functions and powers in a manner consistent with the Redevelopment Plan. 5 SECTION 8. A71 written and oral objections to the Redevelopment 6 Plan hereby are overruled. 7 SECTION 9. The City Clerk hereby is directed to send a certified 8 copy of this ordinance to the Agency, and the Agency is hereby vested with 9 the responsiblility for carrying out the Redevelopment Plan. 10 SECTION 10: The City Clerk hereby is directed to record with 11 the County Recorder of Riverside County a description of the land within 12 the Project Area and a statement that the proceedings for the redevelopment I3 of the Project Area have been instituted under the California Health and 14 ' Safety Code, Section 33000 et seq.. The Agency hereby is directed to 15 effectuate recordation in compliance sith the provisions of Section 27295 16 of the Government Code to the extent applicable. 17 SECTION 11. The Building Department of Lake Elsinore is hereby 18 directed fora period of two years after the effective date of this 19 ordinance to advise all applicants for building permits within the Project 20 Area that the site for which a building permit is sought for the construc- 21 tion of buildings or for other improvements is within a Redevelopment 22 Project Area. 23 SECTION 12.
