The Planning Commission’s decision is final and no action by the City Council is required unless
the City Council by majority vote elects to review and reconsider the Planning Commission’s
decision by ordering the matter set for a future noticed public hearing according to Section
17.410.110.F of the Lake Elsinore Municipal Code (LEMC), or the applicant or an interested
person files a complete appeal application within 15 days of this notice appearing on the City
Council’s agenda.
Background
Planning Application No. 2021-27 (Commercial Design Review No. 2021-13 and Variance No.
2021-2) proposes to construct a freestanding freeway identification sign with a height of 70 feet
and a total sign area of 736 square feet at the In-N-Out Burger location on Railroad Canyon Road

and adjacent to Interstate 15. The sign would be internally illuminated and feature an aluminum
cabinet covered in a red and yellow flex-face material displaying the In-N-Out Burger logo. The
sign cabinet would be mounted on top of a 3’ diameter steel pipe pole with a white coarse stucco
finish.
The project is located on the north side of Railroad Canyon Road between Summerhill Drive
and the northbound on-ramp to Interstate 15, more specifically 331 Railroad Canyon Road
(APN: 363-140-090).
The Planning Commission voted 5-0 to conditionally approve the project at its regular meeting on
December 7, 2021. No one spoke in opposition to the project. The Planning Commission added
the following conditions of approval:
For the purpose of softening the base of the sign structure, architectural treatment and/or
screening of the sign base shall be provided. Required screening shall consist of
foundation plantings which are planted adjacent to the sign and shall belong to a species
in the bougainvillea genus or other species that is approved by the Community
Development Director. A plan showing the location and design of the required treatment
and/or screening shall be submitted to the Community Development Director for review
and approval prior to installing the subject sign.
The City of Lake Elsinore logo and branding elements shall be incorporated into the
subject sign. The logo may incorporate the colors and materials used in sign construction
but may not be distorted or manipulated. Logo color selection should provide maximum
contrast against sign surface. A plan showing the location and design of the required logo
and branding elements shall be submitted to the Community Development Director for
review and approval prior to installing the subject sign.
Fiscal Impact
The time and costs related to processing this application have been covered by fees paid for by
the applicant. No General Fund budgets have been allocated or used in the processing of this
application. The approval of the Project does not fiscally impact the City’s General Fund.
Mitigation Measures to protect the City fiscally have already been included in the Conditions of
Approval.

Project Location
The project is located on the north side of Railroad Canyon Road between Summerhill Drive and
the northbound on-ramp to Interstate 15, more specifically 331 Railroad Canyon Road (APN: 363-
140-090)
Background
On August 18, 2021, In-N-Out Burger applied for approval of a variance and commercial design
review to construct a new freestanding freeway identification sign with a height of 70 feet and a
total sign area of 736 square feet at 331 Railroad Canyon Road.
In-N-Out Burger has continuously operated a restaurant and drive-through on the project site
since their original establishment in 1989. The applicant has stated that Caltrans removed a
previously existing on-site freestanding sign as part of street-widening along Diamond Drive.

The goal of the project is to provide a replacement freeway identification sign so that In-N-Out
Burger can continue to advertise the on-site business to freeway traffic.
The submitted plans indicate that the proposed sign would be internally illuminated and feature
an aluminum cabinet covered in a red and yellow flex-face material displaying the In-N-Out
Burger logo. The sign cabinet would be mounted on top of a 3' diameter steel pipe pole with a
white coarse stucco finish. The cabinet would have a width of 25-6", a height of 14'-3", and a
depth of 3'-8" (front-to-back).

Analysis
General Plan and Zoning Consistencv
The General Plan designates the project site as General Commercial which "provides for retail,
services, restaurants, professional and administrative offices, hotels and motels, mixed-use
projects, public and quasi-public uses, and similar and compatible uses."
The project site is zoned C-2. The intent of the C-2 district is to "reserve appropriate locations
consistent with the General Plan to accommodate a full range of retail stores, offices, personal
and business service establishments offering commodities and services scaled to meet the
needs of the residents of the entire City."
Because the project proposes the construction of a new sign to advertise the existing and
lawfully established restaurant use, the project conforms to the intent and purpose of the
General Plan and zoning ordinance designations of the subject property.
Freeway Sign Standards Consistencv
Signs oriented to freeway traffic are permitted in commercial districts on properties adjacent to a
freeway or freeway ramp subject to specific standards under Lake Elsinore Municipal Code
(LEMC) Section 17.196.180(I)(3). Table 2 indicates the consistency of the project with these
standards.

INCONSISTENT. The subject property has

Design Review Findings
LEMC 17.415.050 provides that the Planning Commission must make the following findings
before granting design review approval:
1. The project, as approved, will comply with the goals and objectives of the General Plan
and the zoning district in which the project is located.
The project is consistent with the goals and objectives of the General Plan and the zoning
district in which the project is located based on the reasons previously discussed in this
report.

2. The project complies with the design directives contained in subsection (F) of this section
and all other applicable provisions of the municipal code.
The scale of the proposed sign structure is appropriate to the project setting because
project the site and surrounding developments, such as KFC and 7-Eleven, are generally
oriented towards the freeway.
The proposed design concept complements the quality of existing development because
the proposed sign structure and materials are designed to match the existing building. The
structural base of the new sign would be finished with white stucco to match the siding of
the existing building. The sign face would also share a color scheme with existing wall
signs on the existing building. With respect to design theme, the proposed sign is similar
to neighboring signage, including the Railroad Canyon Plaza shopping center, KFC, and
7-Eleven/76 Gas, which feature the use of neutral-colored sign structures and display of
distinct business logos.
Furthermore, the proposed sign is appropriately scaled with the overall design concept of
the project. The main function of the project is to advertise the on-site business to motorists
travelling on Interstate 15. The materials and colors of the proposed sign are reflective of
those used for the existing on-site building and signage. The proposed sign would
enhance the appearance of the existing development by allowing the business to be
conveniently identified from the freeway.
3. Conditions and safeguards pursuant to subsection (E) of this section, including guarantees
and evidence of compliance with conditions, have been incorporated into the approval of
the subject project to ensure development of the property in accordance with the
objectives of this chapter and the planning district in which the site is located.
The Planning Division has reviewed the proposed project and has conditioned the project
to ensure compliance with applicable policies, standards and permitting requirements.The
conditions require the applicant to comply with building and engineering regulations and
to obtain any necessary permits (building, grading, encroachment, etc.).
Variance Findings
LEMC 17.415.080 provides that the Planning Commission must make the following findings
before granting a variance:
1. That adequate conditions and safeguards pursuant to subsection (E) of this section
have been incorporated into the approval of the variance to ensure development of
the property in accord with the objectives of the General Plan and the purpose of the
planning district in which the site is located.
The Planning Division has reviewed the proposed project and has conditioned the
project to ensure compliance with applicable goals, policies, and requirements. The
conditions require the applicant to comply with building and engineering regulations
and to obtain any required permits (building, grading, encroachment, etc.).
2. That there are special circumstances, pursuant to the purpose of this section,
applicable to the subject property which do not apply generally to other properties in
the neighborhood, and, therefore, granting of the variance shall not constitute a grant
of special privilege inconsistent with the limitations upon other properties in the vicinity
and district in which the subject property is located.

In the neighborhood there are a total of ten C-2 properties clustered around the
intersection of Railroad Canyon Road and Summerhill Drive to the east of the I-15.
Five of the ten properties are currently occupied by freeway-oriented businesses; four
of these businesses, including In-N-Out Burger, KFC, Jiffy Lube and Alberto's Mexican
Food, are north of Railroad Canyon Road. The other property is occupied by 7-Eleven
and 76 Gas and is located south of Railroad Canyon Road.
There are special topographical, Iocational, and surrounding circumstances which
apply to the subject property which do not apply generally to other properties in the
neighborhood. First, with respect to topography, the surface of subject property is
situated significantly lower(approximately 25 feet below the freeway surface) than the
elevation of the 7-Eleven/76 Gas property, thereby placing the subject property at a
unique disadvantage in achieving sufficient height over the freeway surface for the
purpose of being visible from the freeway. Second, with respect to location, the subject
property is setback a total of approximately 220 feet or approximately 30 feet further
away from the freeway than the properties to the south, thereby placing the subject
property at a unique disadvantage in achieving sufficient sign area to be conveniently
identified from the freeway surface. Third, with respect to the site surroundings, an
existing 47'-0" tall sign (belonging to KFC) is located on the adjacent property
approximately 48'-Y northwest of the proposed sign location. Because new freeway
signs are required not to block existing signs pursuant to LEMC 17.196.180(I)(3)(f)),
the existing configuration of the KFC sign places the subject property owner at a
unique disadvantage in siting a new sign while maintaining visibility of the KFC sign,
particularly as viewed from northbound freeway traffic.
3. That in approving the variance, any reductions authorized from the strict interpretation
of the zoning ordinance represents the minimum deviation from this code necessary
to fulfill the purpose of this section and enable reasonable development of the property.
LEMC 17.196.180(1)(3) requires that no freeway identification sign shall exceed 45
feet in height or 83 square feet in area based on freeway frontage length. The applicant
requests a variance to exceed the height limit by 25 feet and the sign face area limit
by a total of 285 square feet (653 square feet if counting both sides of the sign) to
overcome topographical and Iocational circumstances which are not applicable to
other properties in the vicinity and district. It is the opinion of staff that the requested
deviation represents the minimum necessary to enable In-N-Out Burger to functionally
advertise their on-site establishment to freeway traffic based on the position of the
property's existing grade relative to the freeway surface.
4. Granting of the variance or minor exception will not constitute a grant of special
privileges inconsistent with the limitations upon other properties in the vicinity and zone
district in which such property is situated.
Granting of the variance would not confer special privileges that are inconsistent with
the limitations upon other properties in the vicinity and district in which the property is
situated because the requested relief from the zoning code is necessary to allow In-
N-Out Burger to advertise to freeway traffic in a way consistent with other neighboring
businesses that are subject to comparatively favorable topographical and Iocational
circumstances which do not apply to the subject property.

Environmental Determination
Staff determined that the project is categorically exempt from environmental review under the
California Environmental Quality (CEQA) in accordance with CEQA Guidelines Section 15311(a)
(Accessory Structures) because the project proposes the construction of an on-premise sign.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, APPROVING VARIANCE NO. 2021-02 FOR THE
CONSTRUCTION OF A FREESTANDING FREEWAY IDENTIFICATION SIGN
WITH A HEIGHT OF 70 FEET AND A TOTAL SIGN AREA OF 736 SQUARE
FEET AT 331 RAILROAD CANYON ROAD (APN: 363-140-090)
Whereas, Jonathan Ewell, Williams Sign Co., has filed an application with the City of Lake
Elsinore (City) requesting approval of Planning Application No. 2021-027 (Commercial Design
Review No. 2021-013 and Variance No. 2021-02) proposing to construct a freestanding freeway
identification sign with a height of 70 feet and a total sign area of 736 square feet at 331 Railroad
Canyon Road (APN: 363-140-090); and,
Whereas, Variance No. 2021-02 is a request to exceed the maximum height of 45 feet
and maximum total sign area of 653 square feet for freeway identification signs as established in
Lake Elsinore Municipal Code (LEMC) Section 17.196.180(I)(3); and,
Whereas, pursuant to LEMC Section 17.415.080 (Variances), the Planning Commission
(Commission)has been delegated with the responsibility of reviewing and approving, conditionally
approving, or denying variance applications; and,
Whereas, the proposed project is exempt from the California Environmental Quality Act
(Cal. Publ. Res. Code §§21000 et seq.:"CEQA") and CEQA Guidelines (14. Cal. Code Regs
§§15000 et seq.), specifically pursuant to Section 15311(a) (Accessory Structures); and,
Whereas, on December 7, 2021 at a duly noticed public hearing the Commission has
considered evidence presented by the Community Development Department and other interested
parties with respect to this item.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1: The Commission has reviewed and analyzed the proposed project pursuant to
the California Planning and Zoning Laws (Cal. Gov. Code §§ 59000 et seq.), the Lake Elsinore
General Plan (GP), and the LEMC and finds and determines that the proposed project is
consistent with the requirements of California Planning and Zoning Law and with the goals and
policies of the GP and the LEMC.
Section 2: The Commission finds and determines that the Project is categorically exempt
from environmental review under the California Environmental Quality(CEQA) in accordance with
CEQA Guidelines Section 15311(a) (Accessory Structures).
Section 3: That in accordance with Section 17.415.080.F of the LEMC, the Commission
makes the following findings regarding Planning Application No. 2021-027 (Variance No. 2021-
02):
1. That adequate conditions and safeguards pursuant to subsection (E) of this
section have been incorporated into the approval of the variance to ensure
development of the property in accord with the objectives of the General Plan
and the purpose of the planning district in which the site is located.
The project is located within the C-2 district and has a GP designation of General
Commercial. The project proposes the construction of a new sign to advertise the
existing, lawfully established conforming restaurant use. Therefore, the project
conforms to the intent and purpose of the GP and LEMC designations for the
subject property. The Planning Division has reviewed the proposed project and
has conditioned the project to ensure compliance with applicable goals, policies,
and requirements. The conditions require the applicant to comply with building and
engineering regulations and to obtain any required permits (building, grading,
encroachment, etc.).
2. That there are special circumstances, pursuant to the purpose of this section,
applicable to the subject property which do not apply generally to other properties
in the neighborhood, and, therefore, granting of the variance shall not constitute
a grant of special privilege inconsistent with the limitations upon other properties
in the vicinity and district in which the subject property is located.
In the neighborhood there are a total of ten C-2 properties clustered around the
intersection of Railroad Canyon Road and Summerhill Drive to the east of the 1-
15. Five of the ten properties are currently occupied by freeway-oriented
businesses; four of these businesses, including In-N-Out Burger, KFC, Jiffy Lube

approximately 220 feet or approximately 30 feet further away from the freeway
than the properties to the south, thereby placing the subject property at a unique
disadvantage in achieving sufficient sign area to be conveniently identified from
the freeway surface. Third, with respect to the site surroundings, an existing 47'-
0"tall sign (belonging to KFC) is located on the adjacent property approximately
48'-3"northwest of the proposed sign location. Because new freeway signs are
required not to block existing signs pursuant to LEMC 17.196.180(1)(3)(0), the
existing configuration of the KFC sign places the subject property owner at a
unique disadvantage in siting a new sign while maintaining visibility of the KFC
sign, particularly as viewed from northbound freeway traffic.
3. That in approving the variance, any reductions authorized from the strict

code necessary to fulfill the purpose of this section and enable reasonable

applicant requests a variance to exceed the height limit by 25 feet and the sign
face area limit by a total of 2-1-8 285 square feet (5&6 653 square feet if counting
both sides of the sign) to overcome topographical and locational circumstances
which are not applicable to other properties in the vicinity and district. It is the
opinion of staff that the requested deviation represents the minimum necessary
to enable In-N-Out Burger to effectively advertise their on-site establishment to
freeway traffic based on the position of the property's existing grade relative to

4. Granting of the variance or minor exception will not constitute a grant of special
privileges inconsistent with the limitations upon other properties in the vicinity and
zone district in which such property is situated.
Granting of the variance would not confer special privileges that are inconsistent
with the limitations upon other properties in the vicinity and district in which the
property is situated because the requested relief from the zoning code is
necessary to allow In-N-Out Burger to advertise to freeway traffic in a way
consistent with other neighboring businesses that are subject to comparatively
favorable topographical and locational circumstances which do not apply to the
subject property.
Section 4: Based upon the evidence presented and the above findings, the Commission
hereby approves Planning Application No. 2021-027 (Variance No. 2021-02).

WHEREAS, Jonathan Ewell, Williams Sign Co., has filed an application with the City of
Lake Elsinore (City) requesting approval of Planning Application No. 2021-027 (Commercial
Design Review No. 2021-013 and Variance No. 2021-02) proposing to construct a freestanding
freeway identification sign with a height of 70 feet and a total sign area of 736 square feet at 331
Railroad Canyon Road (APN: 363-140-090); and,
WHEREAS, pursuant to Section 17.415.050 (Major Design Review) of the Lake Elsinore
Municipal Code (LEMC) the Planning Commission (Commission) has been delegated with the
responsibility of reviewing and approving, conditionally approving, or denying design review
applications; and,
WHEREAS, the proposed project is exempt from the California Environmental Quality Act
(Cal. Publ. Res. Code §§21000 et seq.:"CEQA") and CEQA Guidelines (14. Cal. Code Regs
§§15000 et seq.), specifically pursuant to Section 15311(a) (Accessory Structures); and,
WHEREAS, on December 7, 2021 at a duly noticed public hearing the Commission has
considered evidence presented by the Community Development Department and other interested
parties with respect to this item.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1: The Commission has reviewed and analyzed the proposed project pursuant to
the California Planning and Zoning Laws (Cal. Gov. Code §§ 59000 et seq.), the Lake Elsinore
General Plan (GP), and the LEMC and finds and determines that the proposed project is
consistent with the requirements of California Planning and Zoning Law and with the goals and
policies of the GP and the LEMC.
Section 2: The Commission finds and determines that the Project is categorically exempt
from environmental review under the California Environmental Quality(CEQA) in accordance with
CEQA Guidelines Section 15311(a) (Accessory Structures).
Section 3: That in accordance with Section 17.415.050.E of the LEMC, the Commission
makes the following findings regarding Planning Application No. 2021-027 (Commercial Design
Review No. 2021-013):
1. The project, as approved, will comply with the goals and objectives of the General
Plan and the zoning district in which the project is located.
The project is located within the C-2 district and has a GP designation of General
Commercial. Because the project proposes the construction of a new sign to
advertise the existing and lawfully established restaurant use, the project conforms
to the intent and purpose of the General Plan and zoning ordinance designations
of the subject property.
2. The project complies with the design directives contained in subsection (F) of this
section and all other applicable provisions of the municipal code.
The project complies with the design directives of 17.415.050 and all other
applicable provisions of the municipal code as described in the staff report.
3. Conditions and safeguards pursuant to subsection (E) of this section, including
guarantees and evidence of compliance with conditions, have been incorporated
into the approval of the subject project to ensure development of the property in
accordance with the objectives of this chapter and the planning district in which
the site is located.
The Planning Division has reviewed the proposed project and has conditioned
the Project to ensure compliance with applicable policies, standards and
permitting requirements. The conditions require the applicant to comply with
building and engineering regulations and to obtain any necessary permits
(building, grading, encroachment, etc.).
Section 4: Based upon the evidence presented and the above findings, the Commission
hereby approves Planning Application No. 2021-027 (Commercial Design Review No. 2021-
013).

Review No. 2021-00013) is a proposal to construct a freestanding freeway identification sign
with a height of 70 feet and a total sign area of 736 square feet at 331 Railroad Canyon
Road (APN: 363-140-090).
2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, Agents, and its Consultants
(Indemnitees) from any claim, action, or proceeding against the Indemnitees to attack, set
aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or
legislative body concerning approval, implementation, and construction of Planning
Application No. 2021-27 (Variance No. 2020-00002 and Commercial Design Review No.
2021-00013) or any of the proceedings, acts or determinations taken, done, or made prior
to the decision, or to determine the reasonableness, legality or validity of any condition
attached thereto. The Applicant's indemnification is intended to include, but not be limited
to, damages, fees and/or costs awarded against or incurred by Indemnitees and costs of
suit, claim or litigation, including without limitation attorneys'fees, penalties and other costs,
liabilities and expenses incurred by Indemnitees in connection with such proceeding. The
City will promptly notify the applicant of any such claim, action, or proceeding against the
City. If the project is challenged in court, the City and the applicant shall enter into formal
defense and indemnity agreement, consistent with this condition.
3. Within 30 days of project approval, the applicant shall sign and complete an
"Acknowledgment of Conditions" and shall return the executed original to the Community
Development Department for inclusion in the case records.

4. Variance No. 2021-00002 shall lapse and become void two years following the date on
which the variance became effective, unless one of the following: (1) prior to the expiration
of two years, a building permit related to the variance is issued and construction commenced
and diligently pursued toward completion; or (2) prior to the expiration of two years, the
applicant has applied for and has been granted an extension of the variance approval
pursuant to subsections (1) and (2) of Lake Elsinore Municipal Code (LEMC) Section
17.415.080(H)(1)(b). Notwithstanding conditions to the contrary, a variance granted
pursuant to LEMC Section 17.415.080 shall run with the land for this two-year period,
subject to any approved extensions, and shall continue to be valid upon a change of
ownership of the site, which was the subject of the variance application.

Conditions of Approval shall be met prior to the issuance of a Certificate of Occupancy and
release of utilities.
8. Any proposed minor revisions to approved plans shall be reviewed and may be approved
by the Community Development Director. Any proposed substantial revisions to the
approved plans shall be reviewed according to the provisions of the Municipal Code in a
similar manner as a new application.
9. The Applicant shall comply with the City's Noise Ordinance. Construction activity shall be
limited to the hours of 7:00 AM to 5:00 PM, Monday through Friday, and no construction
activity shall occur on Saturdays, Sundays, or legal holidays.
10. Prior to submittal for building permit plan check, the applicant shall obtain approvals from all
other divisions and departments.
11. All plans shall show compliance with all applicable requirements of the latest City adopted
Building Code requirement.
12. Pay all applicable fees at the time of permit issuance.
13. If any of the conditions of approval set forth herein fail to occur, or if they are, by their terms,
to be implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to revoke
or modify all approvals herein granted, deny or further condition issuance of all future
building permits, deny revoke, or further condition all certificates of occupancy issued under
the authority of approvals herein granted; record a notice of violation on the property title;
institute and prosecute litigation to compel their compliance with said conditions or seek
damages for their violation.

VARIANCE REQUEST
To whom it may concern:
IN-N-OUT Burger would like to request a variance for a new pole sign located at 331 Railroad Canyon
Road Lake Elsinore, California. The new IN-N-OUT Burger Logo Pole Sign we're proposing is a total of
70'-0" tall with a cabinet size of 17'-Y in height and 25-6" in width. The cabinet is doubled faced and
both faces are 3'-8" apart. LEMC 17.196.020 states if both faces are more than 3'-0" apart, both sides
of the sign must be included in the sign area square footage. Since our faces are 8" over the 3'-0", our
square footage of the sign area is 736.
Due to Caltrans expanding Railroad Canyon Road, IN-N-OUT Burger was forced to remove their
existing pole sign. After carefully reviewing different areas within their property lines and going over
safety regulations due to the surrounding overhead powerlines, IN-N-OUT Burger feels the best and
safest location for the new proposed pole sign would be in the planter next to their drive thru.
IN-N-OUT Burger is located next to the 15 Freeway and sits approximately 25-0" below the freeway
elevation. The 25-0" is based off the Railroad Canyon Road Freeway Overpass. This IN-N-OUT Burger
location is surrounded by hills making it very hard to see when driving Northbound and Southbound on
the 15 Freeway. The original pole sign was in the ideal location right next to the freeway making it a lot
easier to see, but due to Caltrans expanding the road and the overhead powerlines, the new proposed
pole sign must be a lot further away from the freeway. If we kept the sign the same size as the original
or made the sign according to the sign program provided by the city, it would look a lot smaller in the
new location making it almost impossible to see. I have included multiple pages in the sign plans
showing different views from different locations on the 15 Freeway. This should help give you a visual
and a better understanding as to why IN-N-OUT Burger would like to have their pole sign at 70'-0" and
sign face at 17'-Y x 25-6". This is a standard size pole sign for IN-N-OUT Burger and is at many
locations here in Southern California, one example being the Corona location off the 91 Freeway and
Auto Center Drive.
