Recommendation

Executive Summary
This item is a status report on the City of Lake Elsinore ARPA Recovery Plan allocations and
expenditure plan. The ARPA provides that CLFR funds can be used for COVID-19 related
expenses incurred through December 31, 2024, as well as to recover prior revenue losses.
Accordingly, the City of Lake Elsinore ARPA Recovery plan includes $14.97 million in
recommended COVID-19 related expenditures across City departments and in support of our
community should the Treasury question the recovery of prior revenue losses. The City of Lake
Elsinore ARPA Recovery plan is summarized in Attachment B.
Summary Conclusions and Recommendations
With the City Council’s approval of the City of Lake Elsinore ARPA Recovery plan, the City will be
positioned to help the community recovery and sustain essential City programs and operations.
Following are highlights of programs that will allow the City to continue to support our community
through COVID-19 response and mitigation:
Provide for crisis intervention and homelessness issues
Support compliance with California’s SB95 and Families First Coronavirus Response Act
for expanded emergency paid sick leave

Maintain programs intended to be covered by FEMA but that FEMA may determine are
not eligible for cost recovery
Investment in public infrastructures, such as water, sewer, and broadband
Investment in public infrastructures, such as storm drainage (comply with Clean Water

Provide for City Council directed COVID response
Provide for Community partners outreach efforts
Support continued Parks programs and operations
Support public safety costs such as homeless outreach
Staff will closely evaluate the ARPA and CLFR guidance ultimately issued by the US Treasury
and provide recommended modifications during the monthly updates to the City Council.
Background
As the COVID-19 public health and economic crisis continue throughout the nation, the federal
government enacted the American Rescue Plan Act of 2021 on March 11, 2021. This plan is
intended to combat the COVID-19 pandemic, including the public health and economic impacts.
Included in the $1.9 trillion economic relief package, was $130.2 billion for CLFR funding split
equally between counties and cities, with $65.1 billion allocated directly to cities. The ARPA also
allocates hundreds of billions of dollars for public health and vaccines, assistance for vulnerable
populations, education and housing stabilization, transit and transportation funding, economic
recovery assistance, and direct assistance for families and individuals.
On May 10, 2021, the U.S. Treasury Department released final allocation amounts and interim
guidance on the use of ARPA funding. The final allocated amount to the City of Lake Elsinore,
California is $14,967,198. The first allocation of $7,483,599 was received on July 15, 2021, with
the final allocation expected on July 15, 2022. The ARPA stipulates that CLFR funds must be
obligated/spent by December 31, 2024. Additionally, the ARPA requires the City to provide
‘periodic reports on the use of the funding, though the City is currently awaiting guidance from the
US Treasury as to the specific duration and required information needed for the compliance and
reporting requirements.
Use of Funds
The Coronavirus State and Local Fiscal Recovery Funds provide eligible state, local, territorial,
and Tribal governments with a substantial infusion of resources to meet pandemic response
needs and rebuild a stronger, and more equitable economy as the country recovers. Recipients
may use these funds to:
Support public health expenditures, by, for example, funding COVID-19 mitigation
efforts, medical expenses, behavioral healthcare, and certain public health and safety staff
Address negative economic impacts caused by the public health emergency,
including economic harms to workers, households, small businesses, impacted industries,
and the public sector
Replace lost public sector revenue, using this funding to provide government services
to the extent of the reduction in revenue experienced due to the pandemic

Provide premium pay for essential workers, offering additional support to those who
have and will bear the greatest health risks because of their service in critical infrastructure
sectors
Invest in water, sewer, and broadband infrastructure, making necessary investments
to improve access to clean drinking water, support vital wastewater and stormwater
infrastructure, and expand access to broadband internet
Within these overall categories, recipients have broad flexibility to decide how best to use this
funding to meet the needs of their communities.
Analysis
Unlike the 2020 Coronavirus Relief Funds the County received through the State of California as
part of the Coronavirus Aid, Relief and Economic Security (CARES) Act of 2020, the C ity will
receive CLFR funds directly from the federal government, and they are more flexible in both uses
and duration. This welcome news allows the City to address multiple fiscal strains brought on by
the COVID-19 pandemic. However, as will be noted in more detail below, the allocation of ARPA
funds is one cornerstone of a larger budgetary strategy to maximize community benefits while
minimizing budgetary risks.
Update on Revenue Loss Recovery Final U.S. Treasury Rules
The interim final rules, particularly on the calculation of City revenue losses and uses of revenue
loss recovery, are a significant departure from the anticipated calculations and uses of revenue
loss recovery in the City’s ARPA Recovery Plan. The replenishments of reserves and fund
balances will need to be revised since the U.S. Treasury interim final rules now forbid the use of
ARPA funds to be directly used to replenish reserves or recover specific revenue sources.
The U.S. Treasury interim final rules also outline a set of robust reporting requirements on the
use of ARPA funds. To simplify the reporting requirements, staff has proposed an ARPA Recovery
Plan to maximize the allowed level of revenue losses (which do not require related performance
measures reporting to the U.S. Treasury) calculated to be at over $19.99 million in FY 2019-20,
the first year of eligibility, and projected to be over $22.2 million in FY 2020-21. Combined revenue
losses in these two fiscal years exceed the City’s ARPA allocation, therefore staff intends, with
the Council’s approval, to claim the entire ARPA allotment under revenue loss recovery. This
means that costs related to the Covid19 pandemic will now be considered ‘uses of recovered
funds’ to be consistent with U.S. Treasury guidance. By simplifying the reporting and reducing the
bureaucratic federal government requirements, staff can focus on executing the adopted recovery
plan in accordance with the City’s priorities and continued emergency response. More detailed
information on the reorganization of the City’s ARPA Recovery Plan can be reviewed in
Attachment A.
Staff in coordination with professional associations, fellow cities, and consultant groups submitted
detailed comments on the U.S. Treasury rules on July 16, 2021. It is unclear when the final rules
will be released following the public comment period, and it is a real possibility that the rules may
further deviate from the City’s understanding and require additional adjustments to the City’s
ARPA Recovery Plan. Additional Guidance and reporting requirements were released t he first
week of August, and staff is preparing for the first interim report. That first interim ARPA report
from the City to the U.S. Treasury is due on August 31, 2021, with the first actual report due

October 31, 2021, then additional quarterly reports due after that. Staff is recommending that the
City Council authorize the City staff to file the necessary documents to comply with these reporting
requirements.
Delta Variant and Omicron Concerns
With the recent surge in local COVID-19 cases primarily driven by the Delta Variant and the
emergence of a variant Omicron, the City staff now anticipates that the local health emergency to
last at least through March 2022. Over the next several weeks, staff will be evaluating the financial
needs of these programs and assess the potential to use the Other Unanticipated COVID Costs
program category to fund any shortfalls that could occur should there be a needs to extend certain
programs into late fall or early winter.
Fiscal Impact
The final allocated amount to the City of Lake Elsinore, California is $14,967,198. The first
allocation of $7,483,599 was received on July 15, 2021, with the final allocation expected on July

1. Executive Summary
The American Rescue Plan Act of 2021, also called the COVID-19 Stimulus Package or the American Rescue
Plan (ARP), is a $1.9 trillion economic stimulus bill passed by the 117th United States Congress and signed
into law by President Biden on March 11, 2021, to accelerate the United States' recovery from the
economic and health impacts of the COVID-19 pandemic. The American Rescue Plan includes $350 billion
for the eligible state, local, territorial, and Tribal governments. These funds, known as the Coronavirus
State and Local Fiscal Recovery Funds, provide a substantial infusion of resources to help turn the
pandemic tide, address its economic fallout and lay the foundation for a solid and equitable recovery.
Through the ARP Fiscal Recovery Funds, Congress provided State, local, and Tribal governments with
significant resources to respond to the COVID-19 public health emergency and its economic impacts
through four categories of eligible uses:To respond to the public health emergency or its negative
economic impacts, including assistance to households, small businesses, and nonprofits, or aid to
impacted industries such as tourism, travel, and hospitality;
a) To respond to workers performing essential work during the COVID-19 public health emergency
by providing premium pay to eligible workers;
b) For the provision of government services to the extent of the reduction in revenue due to the
COVID–19 public health emergency relative to revenues collected in the most recent full fiscal
year before the emergency; and
c) To make necessary investments in water, sewer, or broadband infrastructure.
The City of Lake Elsinore (“City”) is dedicated to allocating and expending funds from the American Recovery
Plan Act (ARPA) equitably and properly, all in compliance with the U.S. Treasury Guidelines. Therefore, the
City developed a preliminary ARPA funds allocation plan per the Interim Guidelines and will modify and
adopt a final allocation plan based on the final ARPA Guidelines. A final allocation plan is intended to be
presented to the City Council for consideration and public review and input within 30 days of issuing the
final Treasury ARPA guidelines.
The funds allocated are intended to provide recovery support to those sectors of our economy that are
struggling most to recover from the pandemic, provide a constituent and community-based focus, and be a
vehicle for transformational investment in our City's recovery, leading to improving citywide public health
equity outcomes and economic sustainability, to build future resilience to better withstand impacts from
COVID-19 or other future large-scale system threats. The City’s preliminary proposed funding allocation
categories include Infrastructure, Housing & Homelessness, Economic Recovery, Revenue Backfill, and Non-
Profit Assistance. The preliminary proposed allocations for the Economic Recovery, Housing and
Homelessness, Infrastructure, and Non-Profit Assistance are generally allocated within Qualified Census
Tracts (QCT - HUD) or across programs and projects that benefit and provide a broad geographic and
community reach.

2. Uses of Funds
The City has preliminarily designated the following categories for ARPA funding, pending issuance of the
final ARPA Guidelines:
Infrastructure
The infrastructure funding category focuses on identifying investments in water, sewer, and broadband
infrastructure. The City is currently compiling a list of and evaluating a wide array of water, sewer, and
broadband projects. The evaluation process will identify projects that ensure compliance with applicable
public health and environmental safety requirements, address the most severe risks to human health and
safety, and assists those communities most in need.
The City is currently coordinating with local utility districts to evaluate potential partnership opportunities
for water, sewer, and broadband infrastructure projects. Water and sewer infrastructure projects will
align with the Environmental Protection Agency’s Clean Water State Revolving Fund (CWSRF)
requirements or the Drinking Water State Revolving Fund (DWSRF).
All projects will be required to conform to the California Public Contract Code requirements for delivering
public works projects, which is the City’s standard practice.
Housing and Homelessness
The Housing and Homelessness funding category will target investments to increase local sheltering
capacity, permanent supportive housing units, and expand the supply of affordable housing. Per the
2020 Point-in-Time Count, the City had 50 homeless residents on a given day, of which the majority, 34
are unsheltered. At present, the City has less than 6 year-round emergency shelter beds available to
serve homeless residents. This deficit poses a significant barrier to housing addressing homelessness. In
addition to limited shelter capacity, the City also has a significant shortage of affordable housing units.
An investment of ARPA funds in this category, coupled with investments in the Infrastructure category,
would boost sheltering capacity and support affordable housing projects.
The City of Lake Elsinore has identified Housing and Homelessness projects, including funding for
supportive services offered at the Homeless Crisis Intervention Facility, The Anchor.
Economic Recovery
This category will develop programs to assist businesses and industries struggling to rebound from the
pandemic and focus on strategic investment projects for the City’s future economic growth and resiliency.
The COVID-19 pandemic has affected many aspects of The City’s businesses. Accordingly, the City has
preliminarily identified categories to allocate funds to assist in the revitalization of The City’s economy.
In addition, consideration is being given to increasing the diversification of our economy through targeted
investments to enhance our overall economic resiliency and sustainability and improve the quality of life
of our residents.

Revenue Backfill
This category covers dramatically reduced revenues or loss of revenue for specific categories that were
particularly impacted by COVID-19 due to state-mandated closures. The final Treasury guidelines will help
us make appropriate determinations on revenue backfill eligibility.
Non-Profit Assistance
This category supports local non-profit organizations as they provide a critical role in responding to the
public health emergency and its negative economic impacts by supporting the public health efforts,
delivering essential social services, and supporting individuals and families in stabilizing economically. As
part of its response to the COVID-19 pandemic, the City plans to utilize ARPA funding to establish a Non-
Profit Initiative to expand financial support and capacity within the City’s non-profit sector and to work
collaboratively with local non-profits in service provision and to improve the quality-of-life of residents in
qualified census tracks and other communities disproportionately impacted by the pandemic.
The City will assist our non-profit community with technical assistance to achieve more significant and
more sustainable resiliency. In general, we look to grow our partnerships with the non-profit sector in
delivering public services.
3. Promoting Equitable Outcomes
The City of Lake Elsinore desires to promote strong, equitable growth in managing its allocation of ARPA
funding. The goal is to provide equity and reach citywide through the above-described allocations for
Economic Recovery, Housing and Homelessness, Infrastructure, and Non-profit assistance.
The City’s preliminary plan includes programs grounded in community engagement and collaboration,
providing for investments at critical intervention points that can best assist those in need at the earliest
intervention, and investing in sustainable responses that promote the City’s recovery and resilience. The
desired outcome would be to address the disproportionate negative economic impacts of COVID-19 on
underserved and disadvantaged communities and populations. Plans would focus on increasing
opportunities for increasing public health equity and economic recovery, which would most appropriately
be done in conjunction with an overall community strategy that layers services such as affordable housing
and physical infrastructure improvements. This plan would be accomplished in partnership with non-
profits and include assistance with food, housing, employment programs, and youth sports and activities.
This response will assist in improving the quality of life of residents in qualified census tracks and
communities disproportionately impacted by the pandemic.
4. Community Engagement
The City proposes to provide ARPA funds that focus on the recovery of the City from the effects of the
pandemic and builds our resiliency into the future. In addition, community engagement will be reviewed
with the Council Finance Subcommittee and utilizing past community surveys taking public input.

5. Labor Practices
As it relates to infrastructure projects, the City shall comply with all applicable California Labor Laws,
Prevailing Wage requirements per State Labor Code Section 1771, and California Public Works
Requirements in the California Government Code. In addition, the City will work with any utility partners
that issue contracts for infrastructure funds or other partners such as Cities that contract out for building
supportive housing so that contracts issued meet all applicable State and Federal regulatory requirements
for labor practices.
Furthermore, the City intends to outreach bidding opportunities to Disadvantaged Business Enterprises
(DBE), including Minority Business Enterprises (MBE) and Women Business Enterprises (WBE).
6. Use of Evidence
The City will adhere to the final reporting guidelines issued by the Treasury to use ARPA funds. Based on
the reporting requirements included in the interim guidelines, it is expected that the City will be reporting
expenditures where applicable within the following categories, per future approval by the City Council of
a final allocation plan and specific program expenditures.
