April 30, 2015 PROJECT: MINOR RESIDENTIAL DESIGN REVIEW NO, 2015-02; A PROPOSAL TO LEGALIZE AN EXISTING DETACHED RESIDENTIAL ACCESSORY STRUCTURE AND AN ADDITION TO SUCH STRUCTURE APPLICANT: Preston Shields Shields Contracting 35676 Keane Court Wildomar, CA 92595 OWNER: Richard Paramore and Natalie Cornwell 15031 LeGaye Street Lake Elsinore, CA 92530 Project Request The applicant is requesting approval to legalize an existing 430 square foot detached residential accessory structure and legalize an addition to the same structure that is currently under construction that would total 430 square feet for a final structure totaling 860 square feet in area. Project Location The property is located at 15031 LeGaye Street, Assessor Parcel Number 379-140-079, Lake Elsinore, CA 92530. The parcel totals approximately 2.05 acre in area and is within the RE (Residential Estate) zone district. Page_1_of-3— Minor RDR 2015-02 15031 LeGaye Street April 30, 2015 Background City staff responded to a complaint of an unauthorized commercial dog kennel and upon inspection and research determined there was an existing detached accessory structure without permits and an addition to the existing structure had begun construction without permits, In addition, staff found a website advertising a commercial dog kennel that is not permitted in residential zone districts. The property owner and representatives have indicated they would like to legalize the existing structure, complete construction of the addition, and establish the commercial dog kennel in a location outside the City of Lake Elsinore. Analysis The existing accessory structure and addition under construction are consistent with the RE (Residential Estate) zone district and can satisfy all development standards set forth in the Lake Elsinore Municipal Code (LEMC). LEMC Section 17.184.110, Minor design review, authorizes the proposed improvements subject to approval of a minor design review by the Community Development Director. The LEMC further requires findings to support the decision and that the Director may conditionally approve such project. Staff: has reviewed and determined that all requirements of the Lake Elsinore Municipal Code, California Building Code, and Uniform Fire Code will be satisfied through submittal of plans, issuance of permits, inspections, and final building permit approval. The final completed accessory building may be used for authorized residential accessory uses to include but not be limited to sheds, cabanas, playhouses, and workshops. The building shall not be used for commercial dog kennels or any other use not specifically permitted by LEMC Section 17.68 R-E Estate Single--Family Residential District or consistent with LEMC Chapter 17.48 Home Occupation Regulations. In addition, the LEMC allows a maximum of six (6) weaned dogs as pets only and not for commercial purposes. Environmental Determination Staff determined that the Project is categorically exempt from the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.) pursuant to Section 15303, Class 3; consists of construction and location of limited numbers of new, small facilities or structures, installation of small new equipment and facilities in small structures; because the Project involves legalizing an existing building and an addition to the same building. (14 G.C.R. § 15303(3)). Therefore, no additional environmental clearance is necessary. Page—2—of—3— Minor RDR 2015-02 15031 LeGaye Street April 30, 2015 Findings 1. The project, as approved, will comply with the goals and objectives of the General Plan and the zoning district in which the project is located. The Minor Design Review to legalize an existing building and addition complies with the goals and objectives of the General Plan Low Density Residential, and will comply with all development standards set forth in the RE (Residential Estate) zone district. 2. The project complies with the design directives contained in LEMC 17,84.060 and all other applicable provisions of the Municipal Code. The Minor Design Review for legalizing an existing building and addition is consistent with the Municipal Code in that the project will satisfy the scope of design review set forth in the LEMC. 3. Conditions and safeguards pursuant to Chapter 17.184.070, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of this chapter and the planning district in which the site is located. The Minor Design Review to legalize an existing building and addition has been evaluated pursuant to LEMC Section 17.184.110 (Minor Design Review) and all other applicable Sections of the LEMC. The project was found to be in compliance with all regulations and objectives of the LEMC and RE (Residential Estate) zone district. Applicable conditions of approval have been attached to remedy current code violations and ensure full future code compliance.
