Page 1 City of Lake Elsinore Printed on 10/21/2021 Page 1 of 1 REPORT TO CITY COUNCIL To: Honorable Mayor and Members of the City Council From: Jason Simpson, City Manager Prepared By: Remon Habib, City Engineer Date: October 26, 2021 Subject: Vacation of a Portion of Pasadena Street Recommendation Adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, VACATING A PORTION OF PASADENA STREET. Background On Parcel Map 33056 (Recorded Instrument No. 2006-0180239), right-of-way designated as “Parcel C” is dedicated to public use for street and public utility purposes, bringing the total half -width right- of-way (from property line to the centerline of Pasadena Street) to 55 feet. The City’s General Plan designates Pasadena Street as a Secondary Highway, which is a 45 -foot half-width right-of-way. California Street and Highways Code Section 8334(a) provides that the legislative body of a local agency may summarily vacate an excess right-of-way of a street or highway not required for street or highway purposes. Staff has determined that the portion of Pasadena Street along the property frontage of APN 377-120-059 has excess right-of-way and will not be required for street or highway purposes. That portion of Pasadena Street may therefore be vacated by City Council. Analysis Before City Council action, the Planning Commission must first determine if the vacation conforms with the adopted General Plan (Government Code Section 65402). The General Plan designates Pasadena Street as a Secondary Highway with a half-width of 45 feet. On October 5, 2021, the Planning Commission adopted a resolution finding that the vacation would conform with the City’s General Plan.
