Subject: Amendment No. 2 to the Professional Services Agreement for Hunsaker
and Associates for the Summerhill Drive Interim Extension Design
Recommendation
Authorize the City Manager to execute the Amendment to the Agreement for Professional
Services with Hunsaker and Associates for the Summerhill Drive Interim Extension Design in
the amount of $6,000 and in such final form as approved by the City Attorney.
Background
On January 8, 2019, Council approved a professional services agreement with Glenn Lukos
Associates for the Biological and Regulatory Support for the Summerhill Extension project. On
May 14, 2019, City Council approved the professional services agreement with Hunsaker and
Associate to begin the design of a two-lane roadway for the Summerhill Drive Extension project.
The design will provide plans to go out for bid and construction to extend Summerhill Drive to
Greenwald Ave. Both consultants will work in tandem to provide all professional services
necessary to complete a constructible design package with compliance with regulatory
requirements.
Discussion
The City will require additional professional services related to the design of the project. As part
of the securing right-of-way for the new road extension, it was determined that abandonment
approval letters from Public Utility Agencies were required. Additionally, in support of the
Environmental Permitting, Glenn Lukos Associates requested the design team to prepare
exhibits cost estimates for alternative designs at various drainage crossing s.
Due to the required additional scope of services, an additional $6,000 is being requested as part
of this amendment. The scope and cost change shows as follows:
Preparation of Exhibits and Cost Estimates for Environmental Permitting support for
Alternative Design at Drainage Crossing – $3,400.
Obtain Abandonment Approval Letters from Public Utility Agencies – $2,600.

Fiscal Impact
Amendment No. 2 for the professional services agreement will result in an additional cost of
$6,000. Funding for this project will be allocated under the City’s adopted CIP budget.

AMENDMENT NO. 2
TO AGREEMENT FOR PROFESSIONAL SERVICES

Engineering Consulting Services
This Amendment No. 2 to Agreement for Professional Services is made and entered into
as of 8/10/2021, by and between the City of Lake Elsinore, a municipal corporation (“City), and
Hunsaker and Associates, a Corporation (“Consultant”).
RECITALS
A. The City and Consultant have entered into that certain Agreement for Professional
Services dated as of 5/14/2019, (the “Original Agreement”). Except as otherwise defined
herein, all capitalized terms used herein shall have the meanings set forth for such terms in the
Original Agreement.
B. The Original Agreement provided for compensation to Consultant in an amount of
Two Hundred and One Thousand Seven Hundred dollars ($201,700).
C. Amendment No. 1, approved April 14, 2020, provided for an increase in
compensation in an amount not to exceed Nineteen Thousand Seven Hundred Thirty dollars
($19,730)
D. The parties now desire to amend the scope of services, term and increase the
payment for such services as set forth in this Amendment No 2.
NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth
herein, City and Consultant agree as follows:
1. Section 1, Scope of Services, of the Original Agreement is hereby amended to add
the following:
Consultant shall also perform the services described in Consultant’s
3/17/2021 Proposal (attached to this Amendment No. 2 as Exhibit A-2).
Consultant shall provide such services at the time, place, and in the manner
specified in Exhibit A-2, subject to the direction of the City through its staff
that it may provide from time to time.
2. Section 2, Term, of the Original Agreement is hereby amended and restated in its
entirety to read as follows:
The term of this Agreement shall commence upon execution of this
Agreement and shall continue until the services and related work are
completed in accordance with the Consultant’s Proposal (Exhibit A-2)
unless earlier terminated as provided elsewhere in this Agreement.
The City may, at its sole discretion, extend the term of this Agreement by
giving written notice thereof to Consultant not less than thirty (30) days
before the end of the contract term, such notice to be exercised by the City
Manager.
3. Section 3, Compensation, of the Original Agreement is hereby amended to read in
its entirety as follows:
Notwithstanding the foregoing, for purposes of Amendment No. 2 and the
term thereof, compensation to be paid to Consultant shall be in accordance
with the Schedule of Charges set forth in Consultant’s Proposal
(referenced collectively as Exhibit A-2 Amendment No. 2). In no event
shall Consultant’s compensation related to Exhibit A-2 to Amendment No.
2 exceed Six Thousand dollars ($6,000.00) without additional written
authorization from the City Council. Total compensation shall not exceed
Two Hundred Forty-Seven Thousand Six Hundred Dollars ($247,600.00).
Notwithstanding any provision of Consultant’s Proposal to the contrary, out
of pocket expenses set forth in Exhibit A-2 respectively, shall be
reimbursed at cost without an inflator or administrative charge. Payment
by City under this Agreement shall not be deemed a waiver of defects,
even if such defects were known to the City at the time of payment.
4. Except for the changes specifically set forth herein, all other terms and conditions
of the Original Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the parties have caused this Amendment No. 2 to be executed
on the respective dates set forth below.
