HomeMy WebLinkAboutPC Reso No 2001-07 RESOLUTION NO. 2001-07 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT, CUP NO. 2000-10 FOR OUTDOOR STORAGE FOR THREE LOTS, LOT 3, 29365 HUNCO WAY, LOT 4, 29375 HUNCO WAY, AND LOT 5, 29385 HUNCO WAY WITHIN COLLIER AVENUE BUSINESS PARK-APN 377-120-016 WHEREAS, an application has been filed with the City of Lake Elsinore by Davcon Development, Inc. to request a Conditional Use Permit, CUP No. 2000-10, for a storage yard for an industrial project to be located on a 10 acre site within the Collier Avenue Business Park on Hunco Way - APN 377-120-016; WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of approving Conditional Use Permit requests for outdoor storage; and NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES HEREBY RESOLVE as follows: SECTION 1. The Planning Commission has considered the proposed request for the outdoor storage for the three (3) lots, Lot 3, Lot 4 and Lot 5, within the Collier Avenue Business Park and has found it acceptable. The Planning Commission finds and determines this project is consistent with the Lake Elsinore Municipal Code and that this action is exempt from the requirements ofthe California Environmental Quality Act (CEQA) per the findings of Mitigated Negative Declaration No. 99-4 for Industrial Project No. 99-4; SECTION 2. That in accordance with Chapter 17.74 (Conditional Use Permit) of the Lake Elsinore Municipal Code the following findings for the approval of have been made as follows: 1. The proposed use, on its own merits and within the context of its setting, is in accord with the objectives of the General Plan and the purpose of the planning district in which the site is located. 2. That the proposed use will not be detrimental to the general health, safety, comfort, or general welfare of persons residing or working within the neighborhood of the proposed use or the City, or injurious to property or improvements in the neighborhood of the City. 3. That the site for the intended use is adequate in size and shape to accommodate the use, and for all the yards, setbacks, walls or fences, landscaping, buffers and other features required by the this Title. 4. That the site for the proposed use relates to streets and highways with proper design both as to width and type of pavement to carry the type and quantity of traffic generated by the subj ect use. 5. That in approving the subject use at the specific location there will be no adverse effect on abutting property or the permitted and normal use thereof. 6. Conditions and safeguards pursuant to Section 17.74.50 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the Conditional Use Permit to insure that the use continues in a manner envisioned by these findings for the term of the use.
