MAIN STREET LAKE ELSINORE,CA 92530 TUESDAY, FEBRUARY 3,2015 CALL TO ORDER Community Development Director called the Nuisance Abatement Hearing to order at 5:03 p.m. PLEDGE OF ALLEGIANCE Code Enforcement Officer Lopez led The Pledge of Allegiance. ROLL CALL PRESENT: Board Member Myles Ross Community Development Director Taylor Also present: Code Enforcement Supervisor Lopez, Code Enforcement Officer Castellanos, Code Enforcement Leytte and Community Development Tech Teyler. PUBLIC COMMENTS Citizen Tim Fleming discussed the homeless count that was conducted January 28, 2015. He stated the count was 62 documented homeless in Lake Elsinore and he stated the City and County of Riverside needed to work together to open a homeless facility. CONSENT CALENDAR 1. None. PUBLIC HEARINGS 2. VACANT LOT ON ULLA LANE,APN 379-050-024,LAKE ELSINORE,CA Code Enforcement Supervisor Lopez gave an overview of the case. He stated the vacant lot at one time was part of a larger development, Cottage Lane by Wesco Homes. He indicated the property had recently been sold to 1 1 1 PAGE 2 — NUISANCE ABATEMENT MINUTES — FEBRUARY 3, 2015 Ambient Communities. He commented he received a letter from Ambient Communities which stated they were not the owners of that particular lot, it was still owned by Cottage Lane. He said he was contacted by Ted Anderson an attorney for Wesco Homes, who stated the lot went back to the bank and Wesco Homes was no longer the responsible party but he was not able to provide documentation. Code Enforcement Supervisor Lopez recommended to the Nuisance Abatement Board to declare the property 379-050-024 a public nuisance allowing the City to clean up the junk, trash, debris and overgrown weeds. Nuisance Abatement Board and Code Enforcement Supervisor Lopez discussed the case. Citizen Dr. Jerry McKeehan stated he was the resident next door to the vacant lot on Ulla. He indicated it looked like the developer made a wash on the lot without a permit by putting rocks and cement. He discussed the homeowner's insurance problems, transients and overgrown vegetation. Citizen Dr. Jerry McKeehan discussed with the Board the property, the case and the clean-up. Nuisance Abatement Board discussed clean-up, cost concerns, legal owners and receivership. Code Enforcement Supervisor Lopez explained his intentions on partial, basic clean-up of the property. He stated it would not be a candidate for receivership due to it not being a buildable lot. Board Member Ross discussed the legality of the sale of the properties without including this lot and if we could attach it to the existing owners and hold them responsible to clean the lot. He suggested we have our legal counsel check to see if division of all parcels were done properly. MOVED BY COMMUNITY DEVELOPMENT DIRECTOR TAYLOR AND SECONDED BY BOARD MEMBER ROSS, AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE VACANT LOT LOCATED ON ULLA LANE, APN 379-050- 024, LAKE ELSINORE, CA, A PUBLIC NUISANCE, DIRECT STAFF TO CLEAN PROPERTY, DIRECT CITY PROSECUTOR TO RESERCH THE LEGALITY OF THE SALE AND PURSUE POTENTIAL RECEIVERSHIP OR OTHER LEGAL MATTERS. 3. Code Enforcement Comments: PAGE 3 - NUISANCE ABATEMENT MINUTES - FEBRUARY 3, 2015 Code Enforcement Supervisor Lopez commented on the 100% compliance received on the nuisance case brought before the Board. 4. Nuisance Abatement Board Comments: Board Member Ross thanked everyone for allowing him to serve the community. Community Development Director Taylor commented on the new Code Enforcement ordinance going before the City Council on February 10, 2015 second reading February 24, 2015. ADJOURNMENT Community Development Director Taylor adjourned the meeting at 5:30 p.m. to the next regularly scheduled meeting to be held on Tuesday, March 3, 2015 at 5:00 p.m. at Lake Elsinore Cultural Center, 183 N.
