MacHott, Planning Manager Date: November 10, 2020 Subject: Application Fees for Environmental Permits for Summerhill Drive Extension Project Recommendation Authorize the City Manager to pay applicable application fees for the processing of Streambed Alteration Permits for the Summerhill Drive Extension Project. Background The City Engineer has been working with consultants to design the extension of Summerhill Drive from its current terminus near Ponte Russo north to Greenwald Avenue. The extension of Summerhill Drive will provide much - needed second access for the Tuscany Hills development. The completion of Summerhill Drive will improve the ability of public safety agencies, including police and fire services, to provide service to the community. It will also create improved opportunities for residents to enter and exit the Tuscany Hills development. On January 8, 2019, the City Council authorized the City Manager to execute a Professional Services Agreement with Glenn Lukos Associates (GLA) to perform the necessary biological studies and to prepare and process the regulatory agency permits that are required before construction of the Summerhill Drive extension. The application fees for the permits are not included in the Professional Service Agreement budget. On September 10, 2020, GLA provided staff with draft copies of the applicable regulatory agency permits. Page 1 of 2 Discussion Permit Application Fees Construction of Summerhill Drive will require permits from the U. S. Corps of Engineers, the California Department of Fish and Wildlife, and the Regional Water Control Board for impact to jurisdictional waters. The City will need to obtain the following permits: • Fish and Game Code Section 1602 Streambed Alteration Permit from the CDFW. • Clean Water Act Section 401 Certification from the Santa Ana Regional Water Quality Control Board. • Clean Water Act, Section 404 Nationwide Permit from the ACOE. The expected application fees for each of the permits are: • $32,583 for the Section 1602 Permit ($5,430.50 per drainage). • $2,100 for the Section 401 Permit (with a future additional $15,249 impact fee) and an annual $1,638 fee as long as the 401 certification is active. • There is no application fee for the Section 404 Permit. Fiscal Impact The application fees for the Summerhill Drive Extension Project's required regulatory permit have been allocated under the City's FY2020 -2025 CIP. Page 2 of 2
