Webb Associates Recommendation Approve Amendment No. 5 to the Agreement for Professional Services with Albert A. Webb Associates for on-call traffic engineering services and authorize the City Manager to execute the Agreement in the amount of $291,558, in substantially the form attached and in such final form as approved by the City Attorney. Background The City utilizes contract traffic engineering services in support of traffic operations, development review, and CIP project engineering support. Approximately 70% of these engineering services have been paid through developer deposits and funded CIP project budgets. The remaining 30% of the cost of services have been funded by Gas Tax and the General Fund. Discussion Amendment No. 5 extends consultant traffic engineering services through June 30, 2021. Over the last year, Webb has provided much-needed traffic engineering project management, traffic development review, and guidance and coordination on traffic-related operations and maintenance issues. The Engineering Department is very satisfied with Webb’s services and recommends the City Council approve the extension. Fiscal Impact A combination of adopted FY 2020-2021 CIP project budgets, developer deposits, and Gas Tax funds will support the traffic engineering services as proposed in this Amendment No. 5. Exhibits A – Amendment No. 5 @BCL@900E6A69 Page 1 AMENDMENT NO. 5 TO AGREEMENT FOR PROFESSIONAL SERVICES Albert A. Webb Associates This Amendment No. 5 to Agreement for Professional Services (“Amendment No. 5”) is made and entered into as of September 8, 2020, by and between the City of Lake Elsinore, a municipal corporation (“City), and Albert A. Webb Associates, a California corporation (“Consultant”). RECITALS A. The City and Consultant have entered into that certain Agreement for Professional Services dated as of August 26, 2014 (the “Original Agreement”). Except as otherwise defined herein, all capitalized terms used herein shall have the meanings set forth for such terms in the Original Agreement. B. The Original Agreement provided for compensation to Consultant in an amount of $180,000 for a term of one year. C. Amendment No. 1, approved September 15, 2015, extended the term and increased the Consultant compensation in an amount not to exceed $163,680 through June 30, 2016. D. Amendment No. 2, approved March 22, 2016, provided for a one-year renewal and an increase in compensation in an amount not to exceed $157,800. E. Amendment No. 3, approved August 22, 2017, provided for a one-year renewal and an increase in compensation in an amount not to exceed $283,520. F. Amendment No. 4 approved June 26, 2018, provided for a one-year renewal and increased the compensation in the amount not to exceed $193,440. G. Reference to the “Agreement” below shall mean the Original Agreement and all amendments thereto. H. The parties now desire to modify the scope of services through additional work requests and provide for compensation for such services as set forth in this Amendment No. 5. NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth herein, City and Consultant agree as follows: 1. Section 1, Scope of Services, of the Agreement is hereby amended to add the following: Consultant shall also perform the services described in Consultant’s August 26, 2020 Proposal (attached to Amendment No. 5 as Exhibit A-5). Consultant shall provide such services at the time, place, and in the manner specified in Exhibit A-5, subject to the direction of the City through its staff that it may provide from time to time. Page 2 2. Section 3, Compensation, of the Agreement is hereby amended to add the following: Notwithstanding the foregoing, for purposes of Amendment No. 5 and the term thereof, compensation to be paid to Consultant shall be in accordance with the Schedule of Charges set forth in Consultant’s August 26, 2020 Proposal (Exhibit A-5 to Amendment No. 5). In no event shall Consultant’s compensation related to Exhibit A-5 to Amendment No. 5 exceed Two Hundred Ninety-One Thousand Five Hundred Fifty-Eight Dollars ($291,558) without additional written authorization from the City. Notwithstanding any provision of Consultant’s August 26, 2020 Proposal to the contrary, out of pocket expenses set forth in Exhibit A-5 respectively, shall be reimbursed at cost without an inflator or administrative charge. Payment by City under this Agreement shall not be deemed a waiver of defects, even if such defects were known to the City at the time of payment. 4. Except for the changes specifically set forth herein, all other terms and conditions of the Original Agreement and amendments thereto shall remain in full force and effect. Task B – On-call Traffic Engineering Services WEBB will provide on-call consultant traffic engineering scope of services as follows: 12. Oversee traffic operation (signal operation and maintenance, signing & striping and markings). 13. Coordinate with County of Riverside signal maintenance staff and on-call signal operations staff to address any signal or timing issues. 14. Review traffic impact studies and assist in preparation of conditions of approval for development projects. 2. Prepare and/or review fair share obligation for the development projects. 3. Attend Planning Commissions and City Council Meetings for Development Projects as needed. 4. Review traffic control plans for work within the City right of way and provide assistance with the Encroachment Permit process. 5. Review traffic signal and signing & striping plans to ensure conformance with city, state, federal, and other applicable standards and requirements. 6. Work with Riverside County and on-call signal maintenance technicians for traffic signal and traffic signal system timing plans. 7. Oversee City’s long range Transportation Model. Maintain or coordinate with consultant to maintain and update the Transportation Model as needed. 8. Prepare traffic signal design, signal timing sheets, coordination of signal timing, and traffic signal operation troubleshooting. 9. Provide construction support services on City Projects as needed. 10. Coordinate with Caltrans and County of Riverside for Railroad Canyon interchange coordination and improvements. 11. Coordinate with Caltrans and County of Riverside for Central Avenue interchange coordination and improvements. 12. Review TIF program and prioritize the improvements and corridors to focus on. 13. Develop Master Signal Communication Plan. 14. Inventory and develop Master Bike Trails, Lanes and Walking Paths Plan with City Parks and Recreation department. 15. Research neighborhood traffic calming measures and Implement Neighborhood Traffic Management Program citywide, and on website. 16. Prioritize DIF infrastructure based on immediate traffic needs. 17. Research grant opportunities available to the City. Apply for HSIP and other grants when available. 2. Research possible grants for other systemic improvements for pedestrian heads, APS push buttons, signal improvements, and other safety improvements. 3. Assist in preparing Caltrans forms and other necessary documentation for grant receipt requirements. Task E – On-call Engineering Services for Speed Survey Update WEBB will provide on-call consultant engineering scope of services as follows: 1. Review and update City’s speed survey report to comply with California Vehicle Code. 2. Determine roadway segments that have changed or have expiring speed limits. Assuming 30 segments. 3. Coordinate with Counts Unlimited to collect daily roadway counts and radar speed surveys for identified roadway segments. 4. Prepare speed survey report for City Council approval. Task F – On-call Engineering Services for Palomar Street Improvements WEBB’s scope of services to prepare the Palomar Improvement Plans: 1. Utility Research: a) Utility research for the project will be performed at “Utility Quality Level C”, as defined by American Society of Engineers (ASCE) Standard Guidelines for the Collection and Depiction of Existing Subsurface Utility Data. Utility Quality Level C is defined as surveying and plotting visible above- ground utility features, and by using professional judgment in correlating this information to information derived from existing records or oral recollections (quality level D information). b) WEBB will obtain as-built plans from utility companies. c) WEBB will prepare a utility base map. d) WEBB will submit proposed improvement plans to utility companies. 2. Field Survey: a) WEBB will establish field control and alignment by producing a survey centerline and benchmark monuments. \\Elsinore\wo2\Proposals\FORMAL PROPOSALS\City of Lake Elsinore\014355 Lake Elsinore on-call 2020\014355_Engineering Services Proposal_2020-08- 20.docx b) WEBB will perform field topographic half-street sections every 100 feet along Palomar Street, including tie-in locations at Skylark Drive and Corydon Road. c) WEBB will obtain strategically selected locations for curb and flowline topographic survey data to ensure adequate drainage conveyance. d) WEBB will process the survey data and prepare an existing planimetric base file with surface elevations. e) WEBB will identify all existing easements within the project limits. 3. Signing & Striping Plans: a) WEBB will prepare signing & striping plans along Palomar Street. b) Signing & striping plans will show existing and proposed street striping, pavement markers, street legends, street markings, arrows, crosswalks, and signage that may exist or be required to complete the project. c) Signing & striping improvement plans to be at 1”=40’ scale using current CA-MUTCD, Caltrans Standard Plans, the City of Lake Elsinore’s standards and requirements, and input from City Staff. d) Submit signing & striping improvement plans to the City for review and comment (65%, 90%, 100%). Revise improvement plans per comments and submit final mylar plans for approval. (Maximum 3 plan checks). 4. Cost Estimate and Specifications: Construction Cost Estimate a) WEBB will provide a construction quantity and cost estimate with each submittal of plans. The unit costs shall be based upon the most current cost information for recent similar projects in the area compiled by WEBB and approved by the City. The estimated items of work with quantities shall include, but not be limited to itemizing all removals, clearing and grubbing, relocations, sidewalk, curb & gutter, driveway approaches, Asphalt Concrete (AC), water meters, painting of pavement legends & striping, signs, traffic control, raised pavement markers, and project identification and completion signs. b) The estimated items of work with quantities shall be arranged in chronological order of construction and shall contain all the information needed to prepare the Engineer’s Estimate of Costs. The Engineer’s Estimate shall be prepared and submitted on the WEBB’s estimate form. WEBB will be required to periodically submit updated preliminary cost estimates as the design progresses. c) WEBB’s final construction cost estimate shall be based upon, and in agreement with, the final items of work with estimated quantities. Computations showing estimated quantities and costs for each location of work, as well as the sum totals for each segment of the project and total project, shall be submitted to the City for review along with a set of plans showing items of work with quantities on each sheet. Specifications a) The City will provide WEBB with its boilerplate Technical Provisions in Microsoft Word format.
