Subject: Amendment No. 3 to the Professional Services Agreement with Scott
Fazekas & Associates, Inc. for Building Plan Check Services
Recommendation
Authorize the City Manager to execute Amendment No. 3 to the Professional Services
Agreement with Scott Fazekas & Associates, Inc. for building plan check services to extend the
term for one (1) year (Fiscal Year 2020/21) in an amount not to exceed $250,000, in such final
form as approved by the City Attorney.
Background
On September 22, 2015, the City entered into an agreement with Scott Fazekas & Associates,
INC. (SFA) to provide on -call building plan check services. The agreement for building plan
check services was not to exceed $80,000 and was for three (3) years. This agreement was
initially amended to extend the term of the Original Agreement to June 30, 2019 with up to two
one -year extensions and to increase the annual not to exceed the amount for plan check
services to $250,000. A Second Amendment was subsequently approved extending the term
for an additional year through June 30, 2020 (FY19/20). SFA performs building plan check
services for the City for various commercial, industrial, residential permit applications and advise
the Building Official on code compliance issues as they arise.
Discussion
Staff is recommending extending the term of the Professional Services Agreement an additional
twelve (12) months through June 30, 2021 (FY 20/21). Because the agreement does not
provide for any additional extensions, City staff will solicit Requests for Proposals prior to July 1,
2021 for professional plan check services commencing FY 2021 -2022.
Fiscal Impact
The cost for building plan check services will not exceed $250,000 total for fiscal year 2020-
2021. Expenditures for these services will be paid from building permit plan check fees collected
at the time of permit application, and no General Funds shall be used to pay for said services.

AMENDMENT NO.3
TO PROFESSIONAL SERVICES AGREEMENT
(BUILDING PLAN CHECK SERVICES)
This Amendment No. 3 to Professional Services Agreement ( "Amendment No. 3 ") is
made and entered into as of July 1, 2020, by and between the City of Lake Elsinore ( "City) a
municipal corporation, and Scott Fazekas & Associates, Inc., a California corporation
( "Consultant ").
RECITALS
A. On September 22, 2015, the City and Consultant entered into that certain
agreement entitled "Agreement for Professional Services" for needed staffing and support
services for plan check ( "Original Agreement "). Except as otherwise defined herein, all
capitalized terms used herein shall have the meanings set forth for such terms in the Original
Agreement.
B. On July 1, 2018, the City and Consultant entered into that certain First
Amendment to Professional Services Agreement extended the initial term to July 1, 2019 and
increase the annual not to exceed amount for needed staffing and support services for plan
check to $250,000 ( "First Amendment ").
C. On July 1, 2019, the City and Consultant entered into that certain Second
Amendment to Professional Services Agreement for needed staffing and support services for
plan check to extend the term for twelve (19) months to June 30, 2020 ( "Second Amendment ").
D. The parties now desire to extend the term to June 30, 2021 for those items of
work included in "Exhibit A" (attached to the Original Agreement, First Amendment and Second
Amendment).
NOW, THEREFORE, in consideration of the mutual covenants and conditions set forth
herein, City and Consultant agree as follows:

earlier terminated as provided elsewhere in this Agreement, shall
continue in full force and effect until June 30, 2021.
2. Except for the changes specifically set forth herein, all other terms and conditions
of the Original Agreement as amended by the First Amendment and the Second Amendment
shall remain in full force and effect.
IN WITNESS WHEREOF, the Parties have executed this Agreement as of the day and year first
set forth above, which date shall be considered by the Parties to be the effective date of this
Amendment No. 3.
