A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, APPROVING A TWO-YEAR EXTENSION OF TIME TO FEBRUARY
13, 2022 FOR RESIDENTIAL DESIGN REVIEW NO. 2017-01
Whereas, Miao Song, Hong Guan, LLC, submitted a request for an extension of time for
Residential Design Review (RDR) No. 2017-01 on January 6, 2020,
Whereas, the Lake Elsinore Municipal Code (LEMC) Section 17.415.050.E requires that an
applicant wishing to extend the life of a design review application file an prior to the expiration of
the initial design review approval; and,
Whereas, Section 17.415.0501.1 of the LEMC states that a design review approval shall lapse
and become void two years following the date on which the design review became effective,
unless one of the following: (a) prior to the expiration of two years, a building permit related to the
design review is issued and construction commenced and diligently pursued toward completion;
or (b) prior to the expiration of two years, the applicant has applied for and has been granted an
extension of the design review approval; and,
Whereas, on March 24, 2020, at a duly noticed Public Hearing the Council has considered the
recommendation of City staff as well as evidence presented by the Community Development
Department and other interested parties with respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY
RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1: The Council has reviewed and analyzed the proposed Project pursuant to the
California Planning and Zoning Laws, the Lake Elsinore General Plan (GP), the Lakeshore Village
Specific Plan (LVSP), and the LEMC.
Section 2: The Council finds and determines that and no new environmental documentation is
necessary because all potentially significant effects have been adequately analyzed in an earlier
Mitigated Negative Declaration (MND). All potentially significant impacts have been avoided or
mitigated pursuant to the earlier mitigated negative declaration and none of the conditions
described in Section 15162 exist. A Mitigated Negative Declaration (MND/ER No. 201704) (SCH#
2017111013) was adopted by the City Council on February 13, 2018. As part of the extension of
time request, conditions of approval were updated to reflect the most current City requirements
for development. These are standard conditions of approval and will not result in any modifications
to the previously approved Project. No substantial changes which require major revisions to the
mitigated negative declaration exist and no new information of substantial importance which
require revisions to the earlier mitigated negative declaration exist.
Section 3: That in accordance with Section 17.415.050.E of the LEMC, the Council makes the
following findings regarding extension of time for RDR No. 2017-01:
1. The Project complies with current laws, standards and policies.
The proposed project is located within the Lakeshore Village Specific Plan (LVSP) and is
designated as Attached Residential (AR) and Commercial Residential (CRF). The AR
designation is intended to accommodate attached residential products such as apartments

and/or condominiums at a maximum density of 18 Dwelling Units per Acre (D. U./Ac.). The
CRF designation is intended to provide for two alternative types of development dependent
upon market conditions: neighborhood commercial development consistent with the
Neighborhood Commercial (CN) designation or with a higher density residential
development consistent with the AR designation. The Project is proposing to develop a
condominium complex with a density of 13.9 D. U./Ac. on both the AR and CRF designations.
The proposed Project is consistent with the provisions of the LVSP. The LVSP was subject
to a consistency finding with the General Plan prior to adoption. Therefore, the Project is
found to be consistent with the General Plan.
The project also complies with the relevant development standards as identified in the
Attached Residential (AR) designation of the LVSP and applicable section of the LEMC
including but not limited to development standards, parking requirements, residential
development standards, and permitted uses. Conditions applied to the proposed use
eliminate or reduce to the extent practicable any negative impacts to the general health,
safety, comfort, or general welfare of the surrounding developments and the City of Lake
Elsinore. In addition, the project is compliant with all applicable current law and there are no
new legal provisions that project is inconsistent with that would render the approval of an
extension of time unfeasible.
Section 4: Based upon all of the evidence presented, the above findings, and the conditions of
approval imposed upon the Project, the Council hereby approves a two-year extension of time for
RDR No. 2017-01 to February 13, 2022.
Section 5: This Resolution shall take effect immediately upon its adoption.
Section B: The City Clerk shall certify to the adoption of this Resolution and enter it into the book
of original Resolutions.
Passed and Adopted at a regular meeting of the City Council of the City of Lake Elsinore,
