RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, FINDING THAT THE SUMTUIARY VACATION OF A
PORTION OF ACACIA DRIVE CONFORMS TO THE CITY'S GENERAL PLAN
Whereas, several property owners along Acacia Drive have appeared before the City Council
(Council) to urge vacation of a portion of this street; and,
Whereas, the Planning Commission (Commission) of the City has been delegated with the
responsibility of making recommendations to the Council regarding whether a street vacation
conforms to the City's General Plan (GP) Circulation Element; and,
Whereas, Staff has determined that a portion of Acacia Drive north of Davis Street and between
Davis and Silver Streets has not and will not be used for any public purpose; and,
Whereas, the GP does not designate that portion of Acacia Drive as a roadway.
NOW, THEREFORE, THE PLANNING COiiIiIIISSION OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY RECOTUIMEND AS FOLLOWS:

Section 2: The Commission hereby finds and determines that vacation of the portion of Acacia
Drive north of Davis Street and between Davis and Silver Streets conforms to the City's GP.
Section 3: The Commission finds and determines that the proposed vacation is categorically
exempt from the California Environmental Quality Act (Cal. Pub. Res. Code $$ 21000 ef seq.:
'CEOA) and the State Guidelines for lmplementation of CEQA (14 C.C.R. SS 15000 et seq.: the
"CEQA Guidelines") pursuant to a Class 't exemption for existing facilities because it involves
the vacation of a portion of a street which involves negligible or no expansion of use. (14 C.C.R.
s 15301.)
Section 4: Based upon all of the evidence presented and the findings above, the
Commission hereby recommends that the Council find that the vacation of that portion of Acacia
Drive referenced above is consistent with the City's GP.
Section 5:

This Resolution shall take effect from and after the date of its passage and
