HomeMy WebLinkAboutPC Reso No 2017-95 (ELSP AMEND. 11 2016-02)RESOLUTTON NO.2017-9s A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, GALIFORNIA, RECOMMENDING APPROVAL OF EAST LAKE SPECIFIC PLAN AMENDMENT NO. 11 (SPA 2016-02) Whereas, the City of Lake Elsinore (City) initiated East Lake Specific Plan Amendment (ELSPA) No. 11 to encourage and promote the Dream Extreme" character of the area, and accommodate opportunities for a wide variety of recreational sporting venues; and, Whereas, the East Lake Specific Plan (ELSP) is located in the southwest portion of the City, and is accessible from lnterstate 15, Highway 74 (Ortega Highway), and major roadways including Diamond Drive, Mission Trail, Bundy Canyon, Lakeshore Drive and Grand Avenue. lts boundaries include Lakeshore Drive and Malaga Road to the north, Mission Trail to the east, and Corydon Road to the south. The western boundary is approximately a quarter mile east of Grand Avenue; and, Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 17.204 (SPD Specific Plan District) the Planning Commission (Commission) has been delegated with the responsibility of making recommendations to the City Council (Council) for approval of specific plans and any amendments thereto; and, Whereas, on November 7, 2017 , ala duly noticed Public Hearing the Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE GITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND RECOMMEND TO THE CITY COUNCIL AS FOLLOWS: Section 1: The Commission has reviewed and analyzed proposed ELSPA No. 1 1 , pursuant to the California Planning and Zoning Laws (Cal. Gov. Code Sec 65000 et. seq.), the Lake Elsinore General Plan (GP) and the Lake Elsinore Municipal Code (LEMC) and finds that the proposed East Lake Specific Plan Amendment No. 11 is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the GP and the LEMC. Section 2: That in accordance with the California Government Code, Title 7, Division 1, Article 8, Sections 65450 through 65457, California Planning and Zoning Law, and the LEMC, the Commission makes the following findings for the approval of ELSPA No. 11: 1. The location and design of the proposed development are consistent with the goals and policies of the City's GP and with any other applicable plan or policies adopted by the City. ELSPA No. 1 1 meets the City's Specific Plan criteria for content and required implementation of the GP established by Section 65450 et seq. of the California Government Code and Section 17.204 of the City of LEMC. Appendix A of the ELSPA 11 document descnbes the development3 conslstency with each applicable GP goal and policy. Therefore, the proposed ELSPA 11 complies with the objectives of the GP and the puryose of the planning district in which the site is located. 2. The proposed location allows the development to be well integrated with or adequately buffered from its surroundings, whichever may be the case. PC Reso No.2017-95 Page 2 of 3 a. The ELSP was originally adopted on June 8, 1993 and the location remains unchanged by the proposed ELSPA 11. b. The ELSPA No. 11 retains the existing Serenity and Summerly single-family residential neighborhoods. Additionaily, it encourages mixed-use land uses, which combine commercial with more dense residential development, where Planning Areas border urban arterial roadways, like Lakeshore Drive and Mission Trail. c. lncreased setbacks have been incorporated into the ELSPA No. 11 in order to minimize the impacts of noise, lighting, odor, visibility of activity, truck deliveries and other business activities on adjacent or neafuy residential uses d. The ELSPA No. 11 capitalizes on its adjacency to Diamond Stadium and spotts facility, as well as the existing Links at Summerly Golf Course, Skydive Elsinore, and the Lake Elsinore Motorsports Park within its boundaries. e. The locations of a variety of land uses proposed by the ELSPA No. 11 maintains flood storage capacity in East Lake, and protects and preserves natural habitat. 3. All vehicular traffic generated by the development, either in phased increments or at full build-out, is to be accommodated safely and without causing undue congeslion upon adjoining streets. A Traffic lmpact Analysis dated March 22, 2017, was prepared by Linscott Law & Greenspan for the ELSPA No. 11 . The Traffic lmpact Analysis provided mitigation measures through all phases of development of the specific plan. 4. The Specific Plan Amendment's land uses will be adequately served by existing or proposed public facilities and services. ELSPA No. 11 identifies methodologles fo ass ure that land uses will be adequately served by existing or proposed public facilities and services. Suitable areas arc reserved for parks, pedestrian ways, and public open spaces. lt also identifies necessary streets and circulation to suppott the proposed land use allocations, as well as all necessary wet and dry utilities for proper and adequate infrastructure servlces. ln addition, the amendment will result in an improved design that encourages and promotes the "Dream Extreme" character of the area, and accommodate opportunities for a wide variety of recreational sporting venues. 5. The overall design of the specific plan will produce an attractive, efficient and stable development. Design standards and guidelines are incorporated into the specific plan to ensure an attractive, efticient and vibrant project. Visual graphics and photos accompany the design guidelines that capture the atmosphere and cohesiveness thaf fhe specific plan seeks fo emulate. 6. ln accordance with the requirements of the California Environmental Quality Act (CEQA), impacts have been reduced to a less than significant level, or in the case where impacts remain, a statement of overriding considerations must be adopted to justify the merits of project implementation. The effects of the proposed ELSPA No. 11 has been analyzed in Environmental lmpact Report (SCH 201611029) prepared for the ELSPA No. 11 and its related cases, and PC Reso No.2017-95 Page 3 of 3 adequate mitigation measures have been prepared where necessary, and a Statement of Oveniding Considerations has been recommended where required. 7. The proposed ELSPA No. 11 will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. a. The proposed ELSPA No. 11 has been analyzed relative to its potentiat to have detrimental effects, and land uses desrgnatlo ns and regulations have been imposed to ensure that the health, safety and welfare of affected residents will be protected. b. The focus of proposed /and uses within the specific plan offers development opportunities heretofore unidentified and absent, that respond to the marketplace and are feasible within the constraints in the area. Section 3: Based upon the evidence presented, both written and testimonial, and the above findings, the Commission hereby recommends approval of ELSPA No. 11.
