RESOLUTION NO. 2019-XX A RESOLUTIONOFTHECITYCOUNCILOFTHECITYOFLAKEELSINORE, CALIFORNIA,SETTINGFORTHFINDINGSFORAMENDMENTSTOTHE2019 CALIFORNIABUILDINGSTANDARDSCODE WHEREAS,HealthandSafetyCodeSection17958providesthattheCityofLake Elsinore(“City”)shalladoptordinancesandregulationsimposingthesameormodifiedor changedrequirementsasarecontainedintheregulationsadoptedbytheStatepursuant to HealthandSafetyCodeSection17922; and WHEREAS,theStateofCaliforniaismandatedbyHealthandSafetyCodeSection 17922toimposethesamerequirementsasarecontainedinthemostrecenteditionofthe CaliforniaBuildingCode,theCaliforniaGreenBuildingStandardsCode,theCalifornia Residential Code,theCaliforniaPlumbing Code, the CaliforniaMechanicalCode,the CaliforniaEnergyCode,andtheCaliforniaElectricalCode(hereinafter referredtocollectively as “Codes”); and WHEREAS,HealthandSafetyCodeSection17958.5(a)permitstheCitytomake modificationsorchangestotheCodes,whicharereasonablynecessarybecauseoflocal climatic, geographic, or topographic conditions; and WHEREAS,HealthandSafetyCodeSection17958.7requiresthattheCityCouncil, beforemakinganymodificationsorchangestotheCodes,shallmakeanexpressfinding thatsuchchangesormodificationsarereasonablynecessarybecauseoflocal climatic, geographic, or topographic conditions;and WHEREAS,theBuildingandSafetyDivisionhasrecommendedthatchangesand modificationsbemadetotheCodesandhaveadvisedthatcertainsaidchangesand modificationstotheCodesarereasonablynecessaryduetolocalconditionsintheCityof LakeElsinoreandhavefurtheradvisedthattheremainderofsaidchangesandmodifications areofanadministrativeorproceduralnature,orconcernthemselveswithsubjectsnot coveredbytheCodesorarereasonablynecessarytosafeguardlifeandpropertywithinthe CityofLakeElsinore. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Theaboverecitals aretrueandcorrect. SECTION2.AmendmentsrelatedtolifeandfiresafetycontainedinSections403, 403.1, 403.1.1, 403.4.7.2, 403.4.8.1, 412.7, 3109.4.4.3,Table 1505.1, ofthe2016Editionof theCaliforniaBuildingCode,andSectionsR403.1.3,R405.1,R902.1,R902.1.3,andR902.2 ofthe2016EditionoftheCaliforniaResidentialCode,andSections202and4.304.1ofthe 2019EditionoftheCaliforniaGreenBuildingStandardsCodeareherebyfoundtobe reasonablynecessaryduetothefollowing local conditions: A.ClimaticConditions 1.Hot, drySantaAnawinds arecommontoall areas withintheCityofLakeElsinore. Thesewinds,whichcancausesmallfirestospreadquickly,areacontributing ResolutionNo. Page2 factortothehighfiredangerinthearea andcreatetheneedforanincreasedlevel offireprotection.Thisaddedprotectionwillsupplementnormalfiredepartment responseavailableandprovideimmediateprotectionforlifeandsafetyof multipleoccupants during fireoccurrences. 2.RiversideCountyandtheCityofLakeElsinoreareinasemi-aridMediterranean typeclimatewhichpredisposesallfuels,includingwoodshingles,torapidignition andspreadoffire.Therefore,thereexists aneedfor additional fireprotection measures. B.GeographicConditions 1.RiversideCountyandtheCityofLakeElsinoreareinahighlyactiveseismic area.Thereareearthquakefaultsthatrunalongboththenortheasternand southwesternboundariesofRiversideCountyincludingtheSanJacintoand ElsinorefaultswhicharebranchesoftheSanAndreasFault.Therehavebeen severalsubstantialearthquakeslocatedalongthesefaultsintheInlandEmpire areainthepastfewyears.ThemostrecentwasinJune2019,locatedin RiversideCalifornia,intheRidgecrestAreawithamagnitudeof7.1ontheRichter scale.InJulyRidgecresthada6.1andtheCityofOxnardhada6.4earthquake andwithover500responses,thedepartmentwastaxedtoitsfullcapabilities. TheRidgecrestearthquakemainssupplyingwatertothedistrictburstduringthe earthquake.Ifmorefireshadbeenignitedbytheearthquake,itwouldhavebeen difficultforthefiredepartmenttocontainthem.Expertspredictamajor earthquakeinourareawithinthenext50years.Thissituationcreatestheneed forbothadditionalfireprotectionmeasuresandautomaticon-sitefireprotection forbuildingoccupantssinceamultitudeoffiresmayresultfrombreakageof gasandelectriclinesbecauseofanearthquake.Asnotedby“Planning Scenario ona MajorEarthquakeontheNewport-InglewoodFaultZone,1988,State DepartmentofConservation,”page59,“unfortunately,barelymeetingthe minimumearthquakestandardsofbuildingcodesplaces abuilding onthevergeof being legallyunsafe”; 2.TrafficandcirculationcongestionpresentlyexistingintheCityofLakeElsinore oftenplacesfiredepartmentresponsetimetofireoccurrencesatrisk.This conditionwillbeexacerbatedbyanymajordisaster,includinganyearthquake whereindamagetothehighwaysystemwilloccur.Thisconditionmakesthe needforadditional on-siteprotectionfor propertyoccupants necessary. 3.Placementofmultipleoccupancybuildings,locationofarterialroads,andfire departmentstaffingconstraintsduetorecentrevenue-limitingstatelegislation havemadeitdifficultforthefiredepartmenttolocateadditionalfirestationsand providemanpowersufficienttoconcentratefirecompaniesandpersonnelto control fires in high density apartment or condominium buildings.Fire Departmentequipmentdoesnotalloweasyaccesstoareasofbuildings greaterthan55feetabovethelevelofFireDepartmentvehicleaccess.These conditionscreatetheneedforbuilt-inon-sitefireprotectionsystemstoprotect occupantsandpropertyuntilfirefightingapparatusandpersonnelarriveonthe scene.TheCityofLakeElsinoreisinanareasubjecttoaclimaticconditionofhigh windsandlowhumidity.Thiscombinationofeventscreatesanenvironment, whichisconducivetorapidlyspreadingfires.Controlofsuchfiresrequiresrapid ResolutionNo. Page3 response.Obstaclesgeneratedbyastrongwind,suchasfallentrees,streetlights andutilitypoles,andtherequirementtoclimb75feetverticallyupflightsof stairswillgreatlyimpacttheresponsetimetoreachanincidentscene. Additionally,Section6,Figure6-2ofASCE7identifiesasignificantincreaseinthe amountofwindforceat60feetabovetheground.Useofaerialtypefirefighting apparatusabovethisheightwouldplacerescuepersonnelatincreasedriskof injury.TheCityofLakeElsinoreisinthemiddleoftheseismicallyactivearea.The viabilityofthepublicwatersystemwouldbequestionableatbestafteramajor seismicevent.Thiswouldleavetallbuildingsvulnerabletouncontrolledfiresdueto alackofavailablewaterandaninabilitytopumpenoughquantitiesofanyavailable watertofloorsabovethe55-footlevel.Asevereseismiceventhasthepotentialto negativelyimpactanyrescueorfiresuppressionactivitiesbecauseitislikelyto createobstacleslikethoseindicatedunderthehighwindsectionabove.Withthe probabilityofstrongaftershocksthereexistsa needtoprovideincreasedprotectionfor anyoneonupperfloors. 4.Untreatedwoodroofscauseorcontributetoseriousfirehazardandtothe rapidspreadoffireswhensuchfiresareaccompaniedbyhighwinds.Piecesof burningwoodenroofsbecomeflyingbrandsandarecarriedbythewindtoother locationsandtherebyspreadfirequickly.RecentGrandJuryReportfindings supportthisconcern. 5.Adopting3109.4.4.3allowsthecitytokeepthecurrentstandardsforpoolsafety barriers.CurrentI.C.C.poolbarriersarelessrestrictive. SECTION5.TheCityClerkshallcertifytothepassageandadoptionofthisresolution andthesameshall thereupontakeeffect andbeinforceas January1, 2020.
