HomeMy WebLinkAboutPC Reso No 2019-39 (Duplex)RESOLUTION NO. 2019.39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKEELSINORE, CALIFORNIA, APPROVING PLANNING APPLICATION NO. 20I8.26(RESIDENTIAL DESIGN REVIEW NO. 20{8-12) FOR THE CONSTRUCTION OF A3,970 SQUARE FOOT DUPLEX WITH TWO (2) 456 SQUARE FOOT ATTACHED TWO.cAR GARAGES AND RELATED TMPROVEMENTS LOCATED AT ApN: 374-04{-o3o Whereas, Erick Simon has filed an application with the City of Lake Elsinore (City) requesting approval of Planning Application. No 20'18-26 (Residentiat Design Review tto.'2ota-tzy t6construct a residential duplex with 3,970 square feet (SF) of total living area, two (2) 456 sFattached two car garages and related improvements on an approximatelt 7,125 sr tot ierqeco.The Project is located near the intersection of Kellogg street and pottery Street and more specifically referred to as Assessor parcel Number 374-041-O3O' and, Whereas, the proposed Project is exempt from the California Environmental euality Act (Cal. Publ. Res. Code 9921000 et seq :"CEQA") and CEQA Guidetines (14. Cal. Code Regs SSl5OOOet seq.), specifically pursuant to Section 15303 (C/ass 3 - New Construction or Co-nversion of Small Structures); and, whereas, pursuant to the Lake Elsinore Municipal code (LEMC) chapter 1 7.1g4 (Design Review) the Planning Commission (Commission) has been delegated with the responsibility of reviewing and approving, conditionally approving, or denying minor design reviews for single- family and multi-family residential projects; and, whereas, on June 18,2019, at a duly noticed public Hearing, the commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: $ecfion 1: The commission has reviewed and analyzed the proposed prolect pursuant to the california Planning and zoning Laws (cal. Gov. code SS 65000 et seq.), the Lake Elsinore General Plan (GP), the LEMC and finds and determines that the proposed Project is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the GP and the LEMC. section 2: The commission finds that the proposed project is exempt from the california Environmental Quality Act (cal. Publ. Res. code gg2i000 et seq.:"cEeA") and cEeA Guidetines (14. Cal. Code Regs SS15000 et seq.), specificalty pursuant to Section 15303 (C/ass 3 - New Construction or Conversion of Small Structures). Class 3 consists of construction and location of limited numbers of new, small facilities or structures: (a) one single-family residence, or a second dwelling untt in a residential zone. The Project is proposrng to construct a 3,970 SF residential duplex on a lot that has a residential zoning designation. Section 3: That in accordance with State Planning and Zoning Law and the LEMC, the Commission makes the following findings for the approval of Planning Application No. 20,l8-26 (Resrdential Design Review No. 2018-12): PC Reso. No. 2019-39 Page 2 ol 3 1 . The Poect, as approved, will comply with the goals and objectives of the GP, and the zoning District in which the Project is located. The project compties with the goals and obiectives of the GP because lt w1'7 ass,st,n achieving the deielopment of a wetl-bilanced and functionat mix of residential, limited commercial, limited industriat, open space, recreational and institutional land uses by providing additional housing within the city. The proposed Prgect is an infill development that is proposing to constrict a residential duplex similar to the sunounding area. The proposed Proiect incorporates a Traditional architecturat styte and will complement and enhance the existing developed areas in which the Proiect is located. 2. The project complies with the design directives contained in the GP and all other applicable provisions of the LEMC. The Project is appropriate to the site and sunounding developments in that the proposed duplex iesidence has been designed in consideration of the size and shape of the propefty and meets alt the development itandards. Fufther, the Proiect as proposed will complement the quality of existing development and witt create a visually pleasing, non-detractive relationship between the proposed and existing residences. 3. Subject to the attached conditions of approval, the Project is not anticipated to result in any significant adverse environmental impacts. Notwithstanding the fact that the Project is exempt from CEQA provisions pursuant to a Class 3 exemption, the Project was reviewed and conditioned by all applicable City departments to ensure that the Project btends into existing development, creates the least amount of disturbance, and does not negativety impact the res,dents in the area. The Proiect will not have a significant effect on the environment. 4. Conditions and safeguards pursuant to Chapter 17184 ol the LEMC, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the Project to ensure development of the property in accordance with the objectives of Chapter 17.184. pursuant to Section 17.184.070 of the LEMC, the Project been considered by the Commission at a duly noticed Pubtic Heaing on June 18, 2019. The proposed Proiect, as reviewed and conditioned by att appticabte city divisions, depaftments, and agencies, will not have a significant effect on the environment. Section 4: Based upon the evidence presented, and the above findings, the Commission hereby approves ot Planning Application No. 2018-26 (Residential Design Review No. 2018-12). Section 5: This Resolution shall take effect immediately upon its adoption. Passed and Adopted this 18h day of June, 2019, by the following vote. L PC Reso.
