HomeMy WebLinkAboutPC Reso No 2016-75 (LE Diamond Sports Center)RESOLUTTON NO. 20.t6-75 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF COMMERCIAL DESIGN REVIEW NO. 2016-02 PROVIDING BUILDING DESIGNS FOR TWO BUILDINGS TOTALING 52O,OOO SQUARE FOOT INDOOR COMMERCIAL SPORTS, WITH ASSOCIATED ON.SITE AND OFF.SITE IMPROVEMENTS. whereas, stephen Harrison, on behalf of the LE Diamond sports center, has filed an application for Commercial Design Review (CDR) 2016-02 with the City of Lake Elsinore requesting approval of architectural plans for a 520,000 square foot indoor commercial sports facility on 23.12 acres of disturbed vacant land. The Project site is located adjacent to and north of the Lake Elsinore Storm baseball stadium, east of the Lake Elsinore/San Jacinto River lnlet, west of Diamond Drive and south of Lakeshore Drive. The Assessor Parcel Numbers of the site are 373-210-037-8, 373- 210-038-9,373-210-039-0,373-210-043-3,363-150-006-2,363_16.1_029_7,363_161_O3o_7,363_ 161-031-8,363-161-032-9,363-161-033-0,363-161-034-1 and 363-161-035-2; and, Whereas, pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code SS 21OOO el seq.. "CEQA") and the State Guidelines for lmplementation of CEQA (.l4 C.C.R. SS 15000 et seq.. "CEQA Guidelines"), public agencies are expressly encouraged to reduce delay and paperwork associated with the implementation of CEQA by using previously prepared environmental documents when those prevrously prepared documents adequately address the potential impacts of the proposed Project (CEQA Guidelines Section 15006); and, Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 17.184 (Design Review) the Planning Commission (Commission) has been delegated with the responsibility of making recommendations to the City Council (Council) pertaining to the Residential Design Review (RDR); and, Whereas, on October 18, 2016, at a duly noticed Public Hearing the Commission has considered evidence presented by the Community Development Department and other interested parties with respect to th is item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The Commission has considered the proposed design for CDR No. 2016-03 for two ancillary buildings (equipment shed and restroom facility) totaling 2,072 and has found it acceptable. The Commission has reviewed and analyzed the proposed Project pursuant to the California Planning and Zoning Laws (Cal. Gov. Code SS 65000 et seq.), the Lake Elsinore General Plan the LEMC and finds and determines that the proposed CDR No. 201 1-03 is consrstent with the requirements of Californra Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the LEMC. Section 2. On October 18, 2016, after consideration and evaluation of all written reports and comments and oral testimony presented by the Community Development Department and other City departments, property owners, residents and other interested parties and such other matters as are reflected in the record of the noticed Public Hearing on the Project, the Commission adopted Resolution No. 2016-75 finding and determining that that Addendum #1 to the Diamond Reso No. 2016-75 Page 2 of 3 Specific Plan EIR (SCH 2009031084) is adequate and prepared in accordance with the requirements of CEQA. Section 3. That in accordance with State Planning and Zoning Law and the LEMC, the Commission makes the following findings regarding CDR No. 2016-02: 1. The Project, as approved, will comply with the goals and objectives of the General Plan and the zoning district in which the Project is located. The proposed facility is located in the Specific Plan General Plan Land Use Designation and is located within the Ballpark District planning district. The Ballpark planning district calls for an emphasis on mixed use enteftainment, commercial, and residential uses. Goal 1 implementation program asserfs the City shall suppoft land use applications consisten, with the Specific Plan. The proposed use is permitted subject to the approval of a CUP Fufther, the proposed Protect is consistent with all development standards identified in the Diamond Specific Plan Amendment #1 . ln addition, the proposed facility proposes an entertainment oriented development which emphasizes the contemporary theme of the adjacent Lake Elsinore Storm baseball stadium. 2. fhe Project complies with the design directives and all other applicable provisions of the LEMC or Specific Plan The proposed Project is located Diamond Specific Plan Amendment #1 and is located in the Mixed Use district. The Diamond Specific Plan Amendment #7 seeks to create continuous development theme in the specific Plan area. Fufthermore, the design theme is encouraged to create effective site planning to ensure adequate setbacks, fagade articulations, and other treatments to create a high quality design. The proposed Project employs a conslsfenl thematic design with the Lake Elsinore Storm stadium, however interjects adequate diversity so asto not create a monotonous streetscape. The proposed design also includes various architectural treatments to create an authentic design which reinforces the design themes identified in the Diamond Specific Plan Amendment #1 . 3. Condations and safeguards pursuant to Chapter 17.184.070 of the LEMC, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the Project to ensure development of the property in accordance with the objectives of Chapter 17.184. Pursuant to Section 17.184.070 of the LEMC, the Prqect been considered by the Commission at a duly noticed Public Hearing on October 18,2016. The proposed Project, as reviewed and conditioned by all applicable City divisions, depaftments and agencies, will not have a significant effect on the environment. Furlhermore, appropriate Conditions of Approval have been included that would mitigate any potenfla/ lssues associated with the future development and establishment of use. Section 4. Based upon all of the evidence presented, the above findings, and the Conditions of Approval imposed upon the Project, the Commission hereby recommends that the Council approve CDR No. 2016-03.
