HomeMy WebLinkAboutPC Reso No 2016-69 (ONSITE AND OFFSITE IMPROVEMENTS)RESOLUTION NO.2016.69 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF COMMERCIAL DESIGN REVIEW NO. 2011.03 PROVIDING BUILDING DESIGNS FOR FIVE BUILDINGS TOTALING 65,335 SQUARE FEET, WITH ASSOCIATED ON.SITE AND OFF- SITE IMPROVEMENTS, INCLUDING HARDSCAPE AND LANDSCAPING LOCATED AT APN 381.030-OO5 Whereas, Larry Markham, MDMG, has filed an application for Commercial Design Review 2011- 03 with the City of Lake Elsinore (City) requesting approval of architectural plans for a 53,128 SF holel,4,322 coffee shop with a drive through, and 6,904 SF restaurant, and, Whereas, pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code SS 21000 et seq.: 'CEQA") and the State Guidelines for lmpiementation of CEQA (14 C.C.R. $$ 15000 et seq.: "CEQA Guidelines"), public agencies are expressly encouraged to reduce delay and paperwork associated with the implementation of CEQA by using previously prepared environmental documents when those previously prepared documents adequately address the potential impacts of the proposed project (CEQA Guidelines Section 15006); and, Whereas, pursuant to Lake Elsinore lvlunicipal Code (LEMC) Chapter 17.184 (Design Review) the Planning Commission has been delegated with the responsibility of making recommendations to the City Council (Council) pertaining to the Residential Design Review, and, Whereas, on August 16,2016, at a duly noticed Public Hearing the Planning Commission has considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The Planning Commissron has considered the proposed design for Commercial Design Review No. 2011-03 for a 53,128 SF hotel, 4,322 cofiee shop with a drive through, and 6,904 SF restaurant and has found it acceptable. The Planning Commission has reviewed and analyzed the proposed pro.iect pursuant to the California Planning and Zoning Laws (Cal. Gov. Code gg 65000 et seq.), the Lake Elsinore General Plan the LEMC and finds and determines that the proposed Commercial Design Review No. 201 1-03 is consistent with the requirements of Californra Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the LEMC. SECTION 2. On August 16, 2016, after consideration and evaluation of all written reports and commenls and oral testimony presented by the Community Development Department and other City departments, property owners, residents and other interested parties and such other matters as are reflected in the record of the noticed Public Hearing on the Project, the Planning Commission adopted Resolution No. 2016-66 finding and determining that that the Mitigated Negative Declaration (MND) (SCH# 2012121034) is adequate and prepared in accordance with the requirements of the California Environmental Quality Act (CEOA); that a 30-day public review period ran from February 16, 2016 to March 16, 2016. Based upon those findings and determinations, the Planning Commission by Resolution No. 2016-66 recommended that the City Councrl approve the MND. Reso No. 2016-69 Page 2 of 3 Section 3. That in accordance with State Planning and Zoning Law and the LEMC, the Planning Commission makes the following findings regarding Commercial Design Review No. 2011-03: 1. The Project, as approved, will comply with the goals and objectives of the General Plan and the zoning district in which the project is located. The proposed hotel and ancillary improvements are compatible with the General Plan and the proposed use furthers the goals and objectives of the General Plan, and the proposed project is found to be consistent with the General Plan. The subTeci uses are either permitted or are a conditionally permitted use in the CMU district, a CUP has previously been approved on August 16 2016, and the proposed development complies with all applicable development standards. The proposed project is therefore found to be cons/sfenl with the Municipal Code. 2. The Project complies with the design directives and all other applicable provisions of the Municipal Code. The proposed Project provides a continuity of themed hotel design lhat ls consislent with the national chains they are associated with and provides high quality materials to be used. Fufthermore. the onsite amenities create an attractive destination resoft on Lake Elsinore. The proposed Project has effectively designed to break up massing and provides an attractive building design. Landscaping has been fully developed to mitigate visual impacts. The proposed Project has been designed in such a manner as to mitigate all potential visual impacts associated with mechanical equipment. 3. Conditions and safeguards pursuant to Chapter 17.184.O7O of the Municipal Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the Project to ensure development of the property in accordance with the objectives of Chapter 17.184. Pursuant to Section 17.1 84.070 of the LEMC, the Project been considered by the Planning Commission at a duly noticed Public Hearing on August 16, 2016. The proposed Project, as reviewed and conditioned by all applicable City divisions, depaftments and agencies, will not have a significant effect on the environment. Fufthermore, appropriate Conditions of Approval have been included that would mitigate any potential lssues assoclated with the future development and establishment of use. Section 4. Based upon all of the evidence presented, the above findings, and the Conditions of Approval imposed upon the Project, the Planning Commission hereby recommends that the City Council approve Commercial Design Review No. 2015-09. Section 5. This Resolution shall take effect immediately upon its adoption.
