A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, APPROVING INDUSTRIAL DESIGN REVIEW NO.
20't6-01 (MINOR DESTGN REVTEW) FOR THE ADDtflON OF A 2,100 SQUARE
FOOT CANOPY SHADE STRUCTURE TO AN EXISTING INDUSTRIAL
BUILDING LOCATED AT 553 BIRCH STREET (APN: 377-430-048)
Whereas, Joe Schallert, Schallert Enterprises requests approval for the addition ol a 2,100
Square Foot (SF) canopy shade structure to an existing industrial building (Project). The proposed
Project is specifically located at 553 Birch Street and is generally located northerly of Birch Street
and westerly of Minthorn Street. (APN. 377-430-048), and,
Whereas, pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code SS 21000
et seq.. "CEQA") and the State Guidelines for lmplementation of CEQA (14 C.C.R. SS 15000 et
seg.: "CEQA Guidelines"), public agencies are expressly encouraged to reduce delay and
paperwork associated with the implementation of CEQA by using previously prepared
environmental documents when those previously prepared documents adequately address the
potential impacts of the proposed pro.iect (CEQA Guidelines Section '15006), and,
Whereas, the proposed Project is exempt from the California Environmental Quality Act (Cal.
Publ Res Code $$21000 et seq.: "CEQA") and the State CEQA Guidelines (14 Cal. Code Regs
SS15000 et seq.), specifically pursuant to Section 15303 (Class 3 - New Construction or
Conversion of Small Structures); and,
Whereas, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 17.184 (Design Review)
the Planning Commission of the City of Lake Elsinore (City) has been delegated with the
responsibility of reviewing and approving, conditionally approving, or denying Minor Desrgn
Reviews for lndustrial Projects; and,
Whereas, on August 16, 2016, at a duly noticed Public Hearing the Planning Commission has
considered evidence presented by the Community Development Department and other interested
parties with respect to this item.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE,
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. The Planning Commission has considered the proposed design for lndustrial Design
Review (lDR) No. 2016-01 Minor Design Review (MDR) for the addition of a canopy shade
structure to an existing industrial building and has found it acceptable. The Planning Commission
has reviewed and analyzed the proposed Prolect pursuant to the California Planning and Zoning
Laws (Cal. Gov. Code SS 65000 et seq.), the Lake Elsinore General Plan, the LEMC and finds
and determines that the proposed IDR No. 2016-01 MDR is consistent with the requirements of
California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General
Plan and the LEMC.
Section 2. The Planning Commission finds proposed Project is exempt from the California
Environmental Quality Act (Cal. Publ. Res. Code SS21000 et seq.: "CEQA") and the State CEQA
Guidelines (14. Cal. Code Regs SS15000 et seq.), specifically pursuant to Section 15303 (Class
3 - New Construction or Conversion of Small Structures). Class 3 consists of construction and
location of limited numbers of new, small facilities or structures. (e) Accessory (appurtenant)

structures including garages, carports, patios, swimming pools, and fences. The Project is
proposing to install a 2,100 sq. ft. canopy shade structure to an existing industrial building.
Section 3. That in accordance with State Planning and Zoning Law and the LEMC, the Planning
Commission makes the following findings regarding IDR No. 2016-01 MDR:
1. The Project, as approved, will comply with the goals and objectives of the General
Plan and the zoning district in which the Project is located.
The canopy addition is compatible with the General Plan and the proposed use
fufthers the goals and objectives of the General Plan, and the proposed proiect is
found to be consistent with the General Plan. The subject use is a permitted use in
the Limited Manuf acturing (M-1) zoning district and the proposed development
complies with all applicable development standards. The proposed Project is
therefore found to be conslslent with the LEMC.
2. fhe Project complies with the design directives and all other applicable provisions
of the LEMC.
The proposed Project is proposing to add a canopy shade structure to an existing
industrial building and meets all the development standards. FurTher, the canopy will
provide shade and rain protection to the yard.
3. Conditions and safeguards pursuant to Chapter 17 .184.070 of the LEMC, including
guarantees and evidence of complrance with conditions, have been incorporated into
the approval of the Project to ensure development of the property in accordance with
the objectives of Chapter 1 7.184.
Pursuant to Section 17.184.070 of the LEMC, the Project been considered by the
Planning Commission at a duly noticed Public Hearing on August 16, 2016. The
proposed Project, as reviewed and conditioned by all applicable City divisions,
depaftments and agencies, will not have a significant effect on the environment.
Fufihermore, appropriate Conditions of Approval have been included that would
mitigate any potenllal lssues assoclaled with the proposed addition.
Section 4. Based upon all of the evidence presented, the above findings, and the Conditions of
Approval imposed upon the Project, the Planning Commission hereby approved IDR No. 2016-
01 MDR,
SECTION 5. This Resolution shall take effect immediately upon its adoption.
