HomeMy WebLinkAboutPC Reso No 2016-50 (TPM 37093)_RESOLI_Tl0N_N0 201_& -50_ - A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF TENTATIVE PARCEL MAP NO. 37093 FOR THE CONSOLIDATION OF SIX (6) EXISTING PARCELS INTO ONE (1) PARCEL LOCATED AT APN: 379 - 132 -013 WHEREAS, Glen Robison, Greenberg Farrow, has filed an application for Tentative Parcel Map No. 37093 with the City of Lake Elsinore requesting approval for the consolidation of six (6) existing parcels into one (1) parcel (the "Project ") located at the southwestern corner of Riverside Drive and Joy Street (APN: 379 - 132 -013); and, WHEREAS, pursuant to Lake Elsinore Municipal Code (LEMC) Chapter 16.24 (Tentative Map) the Planning Commission has been delegated with the responsibility of making recommendations to the City Council pertaining to the tentative map; and, WHEREAS, on July 5, 2016, at a duly noticed public hearing, the Planning Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Prior to making a recommendation to the City Council, the Planning Commission has reviewed and analyzed Tentative Parcel Map No. 37093 pursuant to the appropriate Planning and Zoning Laws, and Chapter 16 (Subdivisions) of the Lake Elsinore Municipal Code ( "LEMC "). SECTION 2. The Planning Commission hereby finds and determines that the Project is categorically exempt from California Environmental Quality Act (Cal. Publ. Res. Code § §21000 et seq. "CEQA ") and the State CEQA Guidelines (14. Cal. Code Regs § §15000 et seq.), specifically pursuant to Section 15315 (Class 15: Minor Land Divisions). Class 15 consists of the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous 2 years and the parcel does not have an average slope greater than 20 percent. The project proposes to consolidate six (6) parcels into one (1) 1.21 -acre parcel for commercial use. The project is in conformance with the current General Plan and Zoning for the project site and does not require a variance. Services and access to the proposed parcel are available. The parcel was not involved in a division of a larger parcel within the previous 2 years and does not have an average slope greater than 20 percent. SECTION 3. That in accordance with State Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission makes the following findings for approval of Tentative Parcel Map No. 37091 PLANNING COMMISSION RESOLUTION NO. 2016 -50 PAGE 2OF3 -` -17-The proposed- subdivision. together with the provisions for its- design -and- improvement, is consistent with the General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). The project site has a General Plan land use designation of General Commercial (GC). The GC Land Use designation provides for retail, services, restaurants, professional and administrative offices, hotels and motels, mixed -use projects, public and quasi - public uses, and similar and compatible uses with a Floor Area Ratio (FAR) not to exceed 0.40. The proposed tentative parcel map which will consolidate six (6) parcels into one (1) parcel will allow the development of the proposed convenience store with a FAR of 0.08. The Tentative Parcel Map is consistent with the designated land use, development and design standards, and all other appropriate requirements contained in the General Plan and the Subdivision Map Act. 2. The site of the proposed subdivision of land is physically suitable for the proposed density of development in accordance with the General Plan. The project site is vacant and is relatively flat. The proposed tentative parcel map which will consolidate six (6) parcels into one (1) parcel will allow the development of the proposed convenience store with gasoline dispensing stations. The maximum FAR for the General Commercial (GC) is 0.40. The proposed project site will be developed with FAR of 0.08. 3. The effects that this project are likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. The project site has a General Plan land use designation of General Commercial (GC) and will not have a direct impact on housing. The proposed tentative parcel map which will consolidate six (6) parcels into one (1) parcel will allow the development of the proposed convenience store to serve the surrounding residents in the area. 4. The design of the proposed division of land or type of improvements is not likely to cause serious public health problems. The project has been adequately conditioned by all applicable departments and agencies and will not therefore result in any significant environmental impacts. The proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. SECTION 4. Based upon the evidence presented, the above findings, and the attached conditions of approval, the Planning Commission hereby recommends that the City Council approve Tentative Parcel Map No. 37093. PLANNING COMMISSION RESOLUTION NO. 2016 -50 PAGE 3 OF 3 SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption.
