HomeMy WebLinkAboutPC Reso No 2017-08 (VAR 2016-04)RESOLUTTON NO. 2017-08 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING VARIANCE NO. 20,I6.04 TO VARY FROM THE MINIMUM LOT SIZE REQUIREMENT OF THE ZONE FROM 6,000 SQUARE FOOT TO 5,OOO SQUARE FOOT whereas, Raul cobian, H&R Rentals, LLc has filed an application with the city of Lake Elsinore (city) requesting approval of Planning Application No.2016-85 (Residential Design Review No. 2016-16 and variance No. 2016-04) to construct two (2) single family residential units ('1 ,664 square foot (sF) each) on two separate lots that are 5,000 sF each and to vary from the minimum lot size requirement of the zone from 6,000 sF to 5,000 SF (project). The project is located on southeasterly side of Kansas Street and southerly of Lakeshore Drive and more specifically referred to as Assessor Parcel Numbers 379-204-001 and 379-214-009; and, whereas, Variance No. 2016-04 is requesting to vary from the minimum lot size requirement of the zone from 6,000 sF to 5,000 sF as set forth in Lake Elsinore Municipal code (LEMC), section 17.76 060 (a), and, Whereas, pursuant to LEMC Chapter 17.172 (V ariances) the planning Commission (Commission) of the City of Lake Elsinore (City) has been delegated with the responsibility of reviewing and approving, conditionally approving, or denying variances; and, whereas, on January 17,2017, at duly noticed Public Hearing the commission has considered evidence presented by the Community Development Department and other interested parties with respect to th is item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The Commission has considered Variance No. 20,16-04 requesting to vary from the minimum lot size requirement of the zone from 6,000 sF to 5,000 sF and has found it acceptable. Section 2. The Commission finds and declares that the Pro.lect is exempt from the California Environmental Quality Act (Cal. Publ. Res. Code SS21000 et seq.."CEeA") and the State CEeA Guidelines (14. cal. code Regs SS15000 et seq.), specifically pursuant to Section 15303 (c/ass 3 - New Construction or Conversion of Small Structures). Class 3 consists of construction and location of limited numbers of new, small facilities or structures: (a) One single-family residence, or a second dwelling unit in a residential zone. The Project is proposing to construct two (2) single family residential units (1,664 square foot (sF) each) on two 5,ooo sF each lots that are zoned residential (R-2). Section 3. That in accordance with the LEMC, the Commission makes the following findings for the approval of Planning Application No. 2016-85 (Variance No. 2016-04). 1 . Adequate conditions and safeguards pursuant to LEMC, Section 1 7.172.050 have been incorporated into the approval of the variance to ensure development of the property in accord with the objectives of the General Plan and the purpose of the planning district in which the site is located. The subject lot has a General Plan Designation of Medium Density Residential and is I Reso No. 2017 -08 Page 2 of 3 zoned R-2, the proposed variance would not diminish the residential nature of thepropefty. The proposed variance would not alter the existing land use. Adequate conditions of Approval have been added to ensure the development of the propefty is in accord with the obiectives of the General Plan and the purpose of the planning dislrict in which the site is located. 2. There are special circumstances, pursuant to the purpose of Chapter 17.172 of theLEMC, applicable to the subject property which do not apply generally to other properties in the neighborhood, and, therefore, granting of the variance shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vici;ity and district in which the sub.iect property is located. The two lots in question are previously subdivided legat lots. Other propefties surrounding the proiect have been subdivided with the same size and shape as the two lots in question and have been developed with single family residences. Ihe strict application of the zoning ordinance will prevent the subject propefty from enjoying the same rights as the surrounding properties. The granting of the variance will not constitute granting of a special privilege to these two lots. The variance will allow the two lots to be developed in a similar fashion as the surrounding properties. 3. ln approving the variance, any reductions authorized from the strict interpretation of the zoning ordinance represents the minimum devtation from this code necessary to fulfill the purpose of this chapter and enable reasonable development of the property. The proposed variance would allow the two lots to be developed with two single family resrdences consistent with the other existing lots located adjacent to the Project area. The proposed variance represents the minimum deviation necessary to enabte reasonable development of the propefty in a manner consistent with the existing single family resldences in the area Section 4. Based upon the evidence presented, the above findings, and the attached Conditions of Approval, the commission hereby approves Planning Application No. 2016-g5 (variance No. 2016-04) Section 5. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the project attached hereto. 3. Within 30 days of project approval, the applicant shall sign and complete an "Acknowledgment of Conditions" and shall return the executed original to the Community Development Department for inclusion in the case records. PLANNING DIVISION 4. Design Review approval for the Minor Design Review will lapse and be void unless a building permit is issued within two (2) years of the approval date and construction commenced and diligently pursued to completion. The Community Development Director may grant an extension of time for up to one ('l) year prior to the expiration of the initial Design Review. An application for a time extension and required fee shall be submitted a minimum of one (1) month prior to the expiration date. 5. Prior to the issuance of a building permit, the applicant shall obtain and submit a "Will Serve" letter from Elsinore Valley Municipal Water District to the Director of Community Development. The 'will serve" letter shall specifically indicate the specific water flow volumes for both domestic and fire protection water supply. lt shall be within the Director of Community Development's sole discretion to determine whether the "will serve" letter is sufficient. 6. The signed set of conditions of approval shall be reproduced upon page one of building plans submitted to the Building and Safety Division for Plan Check. All conditions of approval shall be met prior to the issuance of a Certificate of Occupancy and release of utilities. All site improvements shall be constructed as indicated on the approved site plan and elevations, with revisions as noted herein. The applicant shall meet all required development standards as set forth in the Lake Elsinore Municipal Code (LEMC). Any other revisions to the approved site plan or building elevations shall be subject to the review of the Community Development Director or his designee. All plans submitted for Building Division Plan Check shall conform to the submitted plans as modified by the conditions of approval. All materials and colors depicted on the approved plans shall be used. lf the applicant wishes to modify any of the approved materials or colors depicted on the plans, the applicant shall submit a proposal setting forth the modifications for review by the Community Development Drrector or his designee. The Applicant shall comply with all applicable City codes and ordinances. A cash bond of $1,000.00 shall be required for any construction trailers placed on the site and used dunng construction. Bonds will be released after removal of trailers and restoration of the site to a state acceptable to and approved by the Community Development Director or his designee. The Applicant shall comply with the City's Noise Ordinance. Construction activity shall be limited to the hours of 7.00 AM to 5.00 PM, Monday through Friday, and no construction activity shall occur on Saturdays, Sundays or legal holidays. Any extenor air conditioning or other mechanical equipment shall be ground mounted and screened so as to be invisible from neighboring property or public streets. Air conditioning units and related equrpment may not encroach more than two-feet (2') into the required minimum side yard setback. Garages or carports shall be constructed to provide a minimum interior clear space of twenty feet (20') x twenty feet (20') for two cars. Three (3) sets of the Final Landscaping / lrrigation Detarl Plans shall be submitted to the Community Development Department with appropriate fees, reviewed by the City's Landscape Architect Consultant and approved by the Community Development Director or designee, prior to issuance of a building permit. a) All planting areas shall have permanent and automatic sprinkler system with 50% plant coverage using a drip irrigation method. b) All planting areas shall be separated from paved areas with a six inch (6") high and six inch (6") wrde concrete curb. Runoff shall be allowed from paved areas rnto landscape areas. Planting within fifteen feet (15') of ingress/egress points shall be no higherthan twenty-four inches (24"). c) Landscape planters shall be planted with an appropriate parking lot shade tree pursuant to the LEMC and Landscape Design Guidelines. d) No required tree planting bed shall be less than 5 feet wide. 12. 13 14 Appiicanls lnirials Page 2 of 10 Conditions of Approval PA 20 1 6-85/RDR 201 6-1 6A/AR 2016-04 Planning Commission:01/1 7/201 7 15 to. e) Root barriers shall be installed for all trees planted within 10 feet of hardscape areas to include sidewalks. f) Any transformers and mechanical or electrical equipment shall be indicated on landscape plan and screened as part of the landscaping plan. g) The landscape plan shall provide for ground cover, shrubs, and trees and meet all requirements of the City's adopted Landscape Guidelines. h) All landscape improvements shall be bonded 100% for material and laborfortwo years from installation sign-off by the City. Release of the landscaping bond shall be requested by the applicant at the end of the required two years with approval/acceptance reviewed by the Landscape Consultant and approved by the Community Development Director or Designee. i) All landscaping and irrigation shall be installed within affected portion of any phase at the time a Certificate of Occupancy is requested for any building. j) Final landscape plan must be consistent with approved site plan. k) Final landscape plans to include planting and irrigation details. l) Final landscape plans shall include drought tolerant planting consistent with Elsinore Valley Municipal Water District standards subject to plan check and approval by the City's landscape plan check consultant. m) No turf shall be permitted. Driveways shall be constructed of concrete per Building and Safety Division standards. All walls and/or fencing need to be located off the property line. lf the Applicant proposes to place any walls and/or fencing on the property line he/she must submit a notarized agreement between the subject property owner and the adjacent property owner to the Planning Department prior to installing the fence. The Applicant shall construct the City's standard six foot (6') vinyl fence along the side and rear property lines as proposed on the submitted plans. Where views exist, the applicant shall have the option of constructing a tubular steel fence. The applicant shall be required to remove any existing chain link fencing and any fencing that is in poor condition and shall replace such fencing in accordance with LEMC S1 7.44.130D. lt shall be the responsibility of the applicant to contact the effected neighboring property owners. lf the existing fencing is in good condition, this requlrement may be waived per the approval of the Community Development Director or his designee. The building address shall be a minimum of four inches (4") high and shall be easily visible from the public right-of-way. Care shall be taken to select colors and materials that contrast with building walls or trim. The Applicant shall provide a flat concrete pad a minimum of 3'- 0" by 7'- 0" adjacent to each dwelling unit. The storage pad for trash barrels shall be concealed from public view. The Applicant shall provide assurance that all required fees to the Lake Elsinore Unified School District have been paid prior to issuance of building permits. 18 17. 21 19. 20 Applicar')ts lnilrals Page 3 of 10 Conditions of Approval PA 201 6-85/RDR 201 6-1 6A/AR 201 6-04 Planning Commission:01 /17 12017 22. Prior to issuance of a building permit, the Applicant shall pay park-in-lieu fees at the rate in effect at the time that the applicant requests the building permit. 23. The Applicant shall satisfy all conditions of approval prior to the issuance of a Certificate of Occupancy and release of utilities. 24. The Applicant shall pay the Multiple Species Habitat Conservation Plan Fee (MSHCP) Local Development Mitigation Fee prior to obtaining building permits. 25. The Applicant shall pay all applicable Library Capital lmprovement Fund fees. 26. lf any of the conditions of approval set forth herein fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted, deny or further condition issuance of all future building permits, deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herern granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. BUILDING OIVISION General Conditions 27. Final Buildinq and Safetv Conditions. Final Building and Safety Conditions will be addressed when building construction plans are submitted to Building and Safety for review. These conditions will be based on occupancy, use, the California Building Code (CBC), and related codes which are enforced at the time of building plan submittal. 28. Compliance with Code. All design components shall comply with applicable provisions of the 201 3 edition of the California Building, Plumbing and Mechanrcal Codes: 2013 California Electrical Code; California Administrative Code, 2013 California Energy Codes, 2013 California Green Building Standards, California fille 24 Disabled Access Regulations, and Lake Elsinore Municipal Code. As of January 1,2017 all California codes will be plan checked under the 2016 California Code of Regulations Title 24. 29. Street Addressinq. Applicant must obtain street addressing for all proposed buildings by requesting street addressing and submitting a site plan for commercial or multiJamily residential projects or a recorded final map for single- family residential projects. 30. Clearance from LEUSD. A receipt or clearance letter from the Lake Elsinore School District shall be submitted to the Building and Safety Department to ensure the payment or exemption from School Mitigation Fees. 31 . Obtain Approvals Prior to Construction. Applicant must obtain all building plans and permit approvals prior to commencement of any construction work. 32.Obtaininq Separate Approvals and Permits. Trash enclosures, patro covers, light Page 4 of 10 Conditions of Approval PA 201 6-85/RDR 201 6-1 6A/AR 201 6-04 Planning Commission:01/1 7/201 7 standards, and any block walls will require separate approvals and permits. 33. Sewer and Water Plan Approvals. On-site sewer and water plans will require separate approvals and permits. Septic systems will need to be approved from Riverside County Environmental Health Department before permit issuance. At Plan Review Submittal 34. Submittinq Plans and Calculations. Applicant must submit to Building and Safety four (4) complete sets of plans and two (2) sets of supporting calculations for review and approval including: a. An electrical plan including load calculations and panel schedule, plumbing schematic, and mechanical plan applicable to scope of work. b. A Sound Transmission Control Study in accordance with the provisions of the Section 1207, of the 201 3 edition of the California Building Code. c. A precise grading plan to verify accessibiiity for the persons with disabilities. d. Truss calculations that have been stamped by the engineer of record of the building and the truss manufacturer engineer. Prior to lssuance of Gradinq Permit(s) 35. Onsite Water and Sewer Plans. Onsrte water and sewer plans, submitted separately from the building plans, shall be submitted to Building and Safety for review and approval. 36. Demolition Permits. A demolition permit shall be obtained if there is an existing structure to be removed as part of the project. Prior to lssuance of Buildinq Permit(s) 37. Plans Require Stamo of Reoistered Professional. Applicant shall provide appropriate stamp of a registered professional with original signature on the plans. Prior to Beqinninq of Construction 38. Pre-Construction Meetino. A pre-construction meeting is required with the building inspector prior to the start of the building construction. ENGINEERING DIVISION General Requirements: 39. A grading plan signed and stamped by a Calif. Registered Civil Engineer shall be required. A grading permit shall still be obtained, and a cursory drainage and flow pattern inspection will be conducted before grading begins. 40. An Encroachment Permit shall be obtained prior to any work on City right-of-way. 41 . Arrangements for relocation of utility company facilities (power poles, vaults, etc.) out of the roadway or alley shall be the responsibility of the property owner or his agent. Applicanls lnitiais:Page 5 of 10 Conditions of Approval PA 201 6-85/RDR 201 6-1 6A/AR 2016-04 Planning Commission:01/1 7/201 7 42. ln accordance with the City's Franchise Agreement for waste disposal & recycling, the applicant shall be required to contract with CR&R lnc. for removal and disposal of all waste material, debris, vegetation and other rubbish generated during cleaning, demolition, clear and grubbing or all other phases of construction. 43. On-site drainage shall be conveyed to a public facility, accepted by adjacent property owners by a letter of drainage acceptance, or conveyed to a drainage easement. 44. All natural drainage traversing the site shall be conveyed through the site, or shall be collected and conveyed by a method approved by the City Engineer. 45. Applicant shall protect all downstream properties from damages caused by alteration of the drainage patterns, i.e., concentrations or dtversion of flow. Protection shall be provided by constructing adequate drainage facilities including enlarging existing facilities and/or by securing a drarnage easement. A maintenance mechanism shall be in place for any private drainage facilities constructed on-site or off-site. Any grading or drainage onto private off site or adjacent property shalt require a written permission to grade and/or a permission to drain letter from the affected landowner. 46. On-site drainage inciuding roof drains should be directed to a landscaped area. 47. Sawcut asphalt for driveway connection; minimum driveway width is 12'. 48. City of Lake Elsinore has adopted ordinances for storm water management and discharge control. ln accordance with state and federal law, these local storm water ordinances prohibit the discharge of waste into storm drain system or local surface waters. This includes non-storm water discharges containing construction waste, oil, grease, detergents, trash, or other waste remains. Prior to lssuance of a Gradinq Permit 49. Submit Soils Report, Hydrology and Hydraulic Reports prepared by a Registered Civil Engineer for approval by the City Engineer. 50. Developer shall mitigate any flooding and/or erosion downstream caused by development of the site and/or diversion of drainage. 51. The site plan or grading plan shall show natural drainage conveyed through the site, or collected and conveyed by a method approved by the City Engineer. 52. The applicant shall obtain all necessary off-site easements for off-site grading and/or drainage acceptance from the adjacent property owners prior to grading permit issuance. 53. Applicant to include minimum erosion control measures as part of their grading plan and construction activities. A handout of the minimum standards can be obtained from the Engineering Division. All Public Works requirements shall be complied with as a condition of development as specifred in the Lake Elsinore Municipal Code (LEMC) prior to building permit. 55. Submit a "Will Serve" letter to the City Engineering Division from the applicable water agency stating that water and sewer arrangements have been made for this project and specifv the technical data for the water service at the location, such as water pressure and volume etc. Submit this letter prior to applying for a building permit. 56. Provide in-lieu payment for future half-width street improvements on Kansas Street and dedicate additional right of way, via Grant of Easement, such that the centerline to propeny line is 30 feet. 57. All required public righlof-way dedications or easements shall be prepared by the developer or his agent and shall be submitted to the Engineering Division for review and approval prior to issuance of building permit. 58. Pay all Development lmpact Fees and Plan Check fees (LEMC 16.34). Prior to Occupancv 59. Pay all fees and meet requirements of an encroachment permit issued by the Engineering Division for construction of public works improvements (LEMC12.08, Res.83-78) All fees and requirements for an encroachment permit shall be fulfilled before Certificate of Occupancy. Submit FEMA Elevation Certificate to the Engineering Department. All compaction reports, grade certifications, monument certifications (with tie notes delineated on 8112" x 11" Mylafl shall be submitted to the Engineering Division. 62. All public improvements shall be completed in accordance with the approved plans to the satisfaction of the City Engineer. 63. Water and sewer improvements shall be completed in accordance with Water District requirements. 64. All required public right-of-way dedications or easements, shall be recorded with a recorded copy provided to the City prior to Certificate of Occupancy. CITY OF LAKE ELSINORE FIRE MARSHAL General Conditions 65. Riverside County Fire Department at Lake Elsinore Office of the Fire Marshal Responsibility - lt is the responsibility of the recipient of these Fire Department conditions to forward them to all interested partres. Phone: (951) 671- 3124 ExL 225. fhe following fire department conditions shall be implemented in accordance with the Lake Elsinore Municipal Code and the adopted codes at the time of project building plan submittal, these conditions are in addition to the adopted code requirements. Blue Dot Reflectors - Blue retro-reflective pavement markers shall be mounted on private streets, public streets and driveways to indicate location of fire hydrants. prior to installation, placement of markers must be approved by the Riverside County Fire Dept. Minimum Hydrant Fire Flow - Minimum requrred fire flow shall be 1,000 GPM for 2 hours duration at 20 PSI residual operating pressure, which must be available before any combustible material is placed on the job site. Average spacing between hydrants 500' and 250' maximum distance from any point on the street or road frontage to hydrant. Standard Fire Hydrants - Standard fire hydrants (6" x 4" x 2 112"), shall be located not less than 25 feet or more than 250 feet from any portion of the building as measured along approved vehicular travel ways. The required fire flow shall be available from any adjacent hydrant (s) in the system Minimum Access Standards - The following access requirements are required to be implemented to ensure fire department and emergency vehicular access. All roadways shall conform to the City of Lake Elsinore approved roadway standards but in no case shall the minimum fire department vehicular access be less the following provisions: 1. Twenty{our feet (24') clear width. Where parking is to be provided, each parking side shall be provided with eight (8') additional feet on each side of the fire department ACCESS 2. Median openings or crossovers between opposing lanes of a divided highway or street shall be located only at approved intersections at intervals of not less than 500 feet. [ord. 529 S 3 2(F), 1973] 3. The required all weather vehicular access shall be able to support no less than 75,OOO lbs. over 2 axles. Roadway gradient shall not exceed '15% on any access road, driveways, and perimeter roads. Turning Radius shall be 24'inside and 48'outside for all access roads. Automatic / Manual Gates - Gate entrances shall be at least two feet wider than the width of the traffic lane (s) serving that gate and no less than 20 feet wide. Any gate providing access from a road to a driveway shall be located at least 35 feet from the roadway and shall open to allow vehicle to stop without obstructing traffrc on the road. Where a one- way road with a single traffic lane provides access to a gate entrance, a 40 foot turning radius shall be used. Gate access shall be equipped with a rapid entry system. plans shall be submitted to the Fire Department for approval prior to installation. Automatic/manual gate pins shall be rated with shear pin force, not to exceed 30 foot pounds. Automalic gates shall be equipped with emergency backup power. Contact the Fire planning office for current plan check fees. Prior to Buildinq Permit lssuance 71. Plan Check Fee - Building plan check fees shall be made payable to the "City of Lake Elsinore", and shall be submitted to the Fire Department at the time of plan submittal. 72. Water System Plans - Applicant and/or developer shall submit 2 sets of water system plans to the Fire Department for review. The plans must be signed by a registered Civil Engineer and/or water purveyor prior to Fire Department review and approval. Mylars will be signed by the Fire Department after review and approval. Two (2) copies of the signed and approved water plans shall be returned to the Fire Department before release of a building permit. 73.
